HomeMy WebLinkAbout1990-07-06 NAC Memo Re Project Approvals & Conditions C(f MEMORANDUM TO: Curt Gutoske FROM: Kris Aaker DATE: 6 July 1990 RE: Oak Park Heights - St. Croix Mall Expansion FILE NO: 798.02 - 88.28 Pursuant to your request, I have reviewed the Oak Park Heights St. Croix Mall expansion file regarding the timing, approval and conditions of approval for the Mall expansion. Below I have listed the sequence of events and _have indicated conditions of expansion approval. It should be noted that the information provided does not include documentation regarding signage issues. If you should require signage approval documentation, please advise. o On October 8, 1986, Oak Park Development Inc./Swager Bros, Inc. submitted a subdivision application with the City of Oak Park Heights to add an additional twelve lots to Block 1, St. Croix Mall PUD by subdividing existing lots for the purposes of financing and construction of additions to the St. Croix Mall. (Please refer to Exhibit A.) o Our office issued a report regarding the St. Croix Mall PUD amendment and subdivision request on October 21, 1986. Based on the review, our office recommended approval of the Mall expansion subject to the following conditions: 1. The satellite building in the southwest corner of the PUD maintain a 10 foot setback from the St. Croix Bowl lot line. 2. Approval of the grading and drainage plan by the City Engineer. 3. Approval of the PUD utility plan by the City Engineer. 4. All 60 degree parking areas be dimensioned to provide at least 56 feet between tiers of parking. 5. The applicant provide concrete islands at the end of the parking tiers to define and segregate the parking stalls from the driveway areas. 6. All on -site parking areas must have a bituminous surface, striped parking stalls, and curbing around the perimeter of the parking lot. 7. The applicant must submit a parking lot light plan that shows light location and type of lighting. 8. The applicant provide a landscape schedule outlining the number, type, and size of plant materials. 9. Applicant provide a signage plan for the Mall expansion. 10. The applicant and the City enter into an updated development contract addressing the items outlined in this report. 2 o A public hearing was conducted by the Oak Park Heights City Council on October 27, 1986 regarding this matter. The following action was taken by the Council: Clerk read public hearing notice, presented affidavit of publication and mailing list for request for subdivision and conditional use permit submitted by Oak Park Development and Swager Bros., Inc. Mayor called for comments and discussion ensued. Torgerson, seconded by O'Neal, moved to close hearing. Five aye votes. Hearing closed. Carufel, seconded by O'Neal, moved to adopt Resolution #86- 10-25 approving the subdivision with an updated development contract to be presented to Council. Roll call vote taken with five aye votes cast. Resolution adopted. Doerr, seconded by Torgerson, moved to approve the conditional use permit providing it meets all the stipulations recommended in City Planner's letter dated October 21, 1986. Also a letter from Oak Park Development to the City stating that the road from the residential area to the Mall along Oren Avenue be closed during construction for the safety of the citizens. Five aye votes. Carried. o The following action was taken at the February 9, 1987 City Council meeting: Seggelke, seconded by Torgerson, moved to approve a forty - five (45) day extension to Oak Park Development for St. Croix Mall PUD to allow additional time to prepare the hard shell. Five aye votes. Carried. o The following action was taken at the May 11, 1987 Oak Park Heights City Council meeting: O'Neal, seconded by Doerr, moved to schedule public hearing Monday, June 8, 1987 at 7:00 PM to amend the St. Croix Mall PUD agreement. Five aye votes. Carried. o The following action was taken at the June 8,, 1987 City Council meeting: Clerk read public hearing notice and presented affidavit of publication on request for amendment to the St. Croix Mall PUD. Mayor called for comments and discussion ensued. O'Neal, seconded by Seggelke, moved to close hearing. Five aye votes. Hearing closed. 3 o On June 19, 1987, the City of Oak Park Heights received a letter from Jon B. Albrightson, attorney representing Swager Bros. Inc. The letter requested a subdivision waiver regarding a lot split of Lot 14, Block 1, St. Croix Mall PUD. o In response to the waiver request, our office issued a letter on June 24, 1987 to Jon B. Albrightson stating that the lot split request would be in accordance with Section 402.01, Subdivision G, part (a) of the Oak Park Heights Subdivision Ordinance. This section states that the City Council may exempt the subdivider from complying with any procedural requirements of this Ordinance deemed appropriate, and allowing the lot split to occur without a public hearing. o On July 8, 1988, our office requested that a determination should be made on the revised parking provisions regarding how many parking spaces exist on the site. o On June 8, 1989, Watson Centers, Inc., Oak Park Development Inc., and Swager Bros. Inc. submitted an application for a concept plan and general plan approval for renovation and expansion of the St. Croix Mall. o On June 21, 1989, our office issued a planning report recommending approval of the St. Croix Mall PUD amendment subject to the following recommendations: 1. Curbed islands are provided as identified in Exhibit D and landscaped in a compatible fashion with the balance of the submitted landscape plan. 2. Typical parking stall and drive aisle dimensions are shown on the site plan in accordance with minimum City standards. 3. The curb cut locations and widths along Osgood Avenue are found to be acceptable by the City Engineer and Washington County. 4. The green area between the east parking lot adjacent to Herbergers and Osgood Avenue is given additional landscaping treatment with shade and /or ornamental trees and shrubbery. 4 5. The east curb cut of the drive aisle across from the small shop area is designated "no parking" to allow for proper truck maneuvering. 6. A trash facility is designated on the site plan in accordance with the comments stated in this report. 7. Specific language be included in the development agreement regarding building facade renovation and requiring specific City Council and /or Building Inspector approval. 8. A comprehensive signage plan is submitted and approved prior to occupancy of any of the expansion area. 9. A grading and drainage plan and utility plan is submitted and approved by the City Engineer. 10. Subject to the comments of other City Staff. o On June 26, 1989, the City Council voted in favor of the St. Croix Mall request subject to the June 21, 1989 NAC planning report. o In September of 1986, it was confirmed by our office that the applicant had resolved all of the recommendations as stated in the June 21, 1989, NAC planning report with only minor exceptions. Those exceptions are as follows and were to be addressed during Mall expansion: 1. The perimeter curbing encompassing and located closest to the Mall is to be painted yellow. 2. "No Parking Anytime /Fire Lane" signs are to be installed along all drive aisles adjacent to the Mall. Spacing of signage is not to exceed seventy -five (75) feet. 3. All curbing encompassing the truck loading area off of Osgood Avenue is to be painted yellow and signed "No Parking /Loading Area ". 4. The exterior placement of any trash containers must be approved separately by the Building Inspector and be screened within a structure built of similar materials and of similar appearance to the principle Mall building. 5 • 5. The City shall review the functioning of the Mall's interior circulation after one (1) year of the Mall's operation after renovation. If the City reasonably determines a safety problem exists where corrective measures need be taken, based upon its review, observation and comments or complaints received from other sources, the Mall owners agree to fully cooperate and implement resultant reasonable corrective measures and pay all reasonable costs incurred through such improvements. 6.
