In regards to our conversation yesterday afternoon of the
Hardware Hank outdoor display area, I thought I would follow up
on the matter with this memo.
Outdoor service, sales, and storage as an accessory use requires
a CUP in a B -2 District. Such a use cannot automatically be
conducted without receiving the specific approval of the Council.
In the recent approval of the planned unit development CUP for
the Mall expansion, an outdoor display and storage area for the
Hardware Hank store was not included. The site plans never
identified such an area.
If this type of use is to be allowed, then an amendment to the
PUD must be processed. Included in the amendment would be a site
plan depicting the dimensions of the outdoor area and a listing
of the types of items to be stored and displayed and for what
duration. This submission would be subject to the City Council
approval.
Given my understanding of your discussion with Mr. Henning, I
believe it would be correct to have the Hardware Hank tenant
remove its outdoor display and storage materials. This was not a
part of the PUD approval and its establishment would require the
previously described amendment.
I have sent a copy of this memo directly to Mr. Henning. Should
