FIE COPY September 26, 1989 Mr. Matthew Seltzer Dorsey & Whitney 2200 First Bank Place Minneapolis, MN 55402 RE: Oak Park Heights - St. Croix Mall Expansion FILE NO: 798.02 - 88.28 Dear Mr. Seltzer: In reference to the above project, the City Council of Oak Park Heights approved a PUD amendment on June 26, 1989 subject to the resolution of the ten (10) recommendations contained on page two of the planning report by Northwest Associated Consultants dated June 21, 1989. Watson Centers, Inc. (the applicant) has since resolved all of the recommendations contained in the 21 June 1989 report with only minor exceptions. These exceptions are listed in a separate document entitled St. Croix Mall Site Plan Attachment. This document is enclosed with this letter. The resolution of these items are to be addressed during the construction of the mall expansion. No further City review or City Council approval is necessary to issue building permits. The conditions on the Site Plan Attachment are simply to become part of the building permit issuance and will be addressed during the appropriate time of construction or the appropriate time of operation as specified in the attachment. CROIX MALL SITE PLAN ATTACHMENT The following items are to be constructed, installed and agreed to by the applicant as part of final site plan approval and building permit issuance. 1. The perimeter curbing encompassing and located closest to the Mall is to be painted yellow. 2. "No Parking Anytime /Fire Lane" signs are to be installed along all drive aisles adjacent to the Mall. Spacing of signage is not to exceed seventy -five (75) feet. 3. All curbing encompassing the truck loading area off of Osgood Avenue is to be painted yellow and signed "No Parking /Loading Area ". 4. The exterior placement of any trash containers must be approved separately by the Building Inspector and be screened within a structure built of similar materials and of similar appearance to the principle Mall building. 5. The City shall review the functioning of the Mall's interior circulation after one (1) year of the Mall's operation after renovation. If the City reasonably determines a safety problem exists where corrective measures need be taken, based upon its review, observation and comments or complaints received from other sources, the Mall owners agree to fully cooperate and implement resultant reasonable corrective measure and pay all reasonable costs incurred through such improvements. 6. Ornamental and /or shade trees in compliance with all Ordinance standards shall be provided in all parking lot islands with the exception of those indicated not to receive such treatment located nearest the south facade of the Mall as illustrated in the landscape plan signed 8/29/89.
