Dear Mr. Continenza:
Enclosed herewith please find a copy of City Council Resolution 04 -05 -27 approving your conditional
use permit request for auto repair use at 12430 55 St. N. This is being provided to you as a reminder
of the specific restrictions and provisions pertaining to the store and its operation practices as part of
the conditional use permit approval.
Please note that one of these provisions is that "all automobile repair activities shall be limited to
within the principal structure and the doors to the service bays shall be kept closed except when
vehicles are being moved in or out of the service areas."
If you are not currently adhering to the provision of keeping the service bay doors closed at all times,
other than when a vehicle is being move inside or out o the service area, you are requested to
immediatelv commence such adherence. This provision is part of the terms of the conditional use
permit issued for the business operations. Failure to adhere to the provisions of the conditional use
permit may result in revocation of the conditional use permit and /or misdemeanor citation for
violation of Oak Park Heights City Ordinances related to the conditional use permit.
It is imperative that you ensure that all staff is aware of the provisions contained within the
conditional use permit that affect daily operation activities, including but not limited to the provision
that the service bay doors remain closed at all times, other than when a vehicle is being moved in or
out of the bay service bay. No additional warning will be provided regarding the conditional use
permit provisions.
I appreciate your assistance in communicating the appropriate provisions to your staff and immediate
compliance with the closure of service bay doors. Please contact me anytime.

RESOLUTION NO. 04 -05 -27
CITY COUNCIL
CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION ESTABLISHING FINDINGS OF FACT AND
RESOLUTION OF THE CITY COUNCIL THAT THE
REQUEST BY STILLWATER AUTO CLINIC
FOR A CONDITIONAL USE PERMIT TO ALLOW FOR
AUTO REPAIR USE IN THE B -3 DISTRICT
AT 12430 55 STREET NORTH
BE APPROVED WITH CONDITIONS
WHEREAS, the City of Oak Park Heights has received a request from Stillwater
Auto Clinic for a conditional use permit to allow for auto repair use in the B -3 District at 12430
55` Street North; and after having conducted a public hearing relative thereto, the Planning
Commission of Oak Park Heights recommended that the application be approved with
conditions. The City Council of the City of Oak Park Heights makes the following findings of
fact and resolution:
1. The real property affected by said application is legally described as
follows, to wit:

2. The applicant has submitted an application and supporting
documentation to the Community Development Department consisting of the following items:

and
3. The subject site is zoned B -3, Highway Business and Warehousing
District in which auto repair use is a conditional use; and
4. City staff prepared a planning report dated May 6, 2004 reviewing the
request; and
5. Said report recommended approval of the conditional use permit subject to
the fulfillment of conditions; and

6. The Planning Commission held a public hearing at their May 13, 2004
meeting, took comments from the applicants and public, closed the public hearing, and
recommended that the application be approved subject to the fulfillment of conditions.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR
THE CITY OF OAK PARK HEIGHTS THAT THE CITY COUNCIL APPROVES THE
FOLLOWING:
A. The application submitted by from Stillwater Auto Clinic for a conditional use permit to
allow for auto repair use in the B -3 District at 12430 55` Street North and affecting the real
property as follows:

Be and the same as hereby approved by the City Council of the City of Oak Park Heights
subject to the following conditions:
1. All automobile repair activities shall be limited to within the principal structure and the
doors to'the service bays shall be kept closed except when vehicles are being moved in or
out of service areas.
2. There shall be no exterior storage of automobile parts, parked cars, or related items on the
site. All storage shall be internal to the building. Any cars to be stored outside of the
building shall be in full working order.
3. All noise created from operations on the site shall be in conformance with Section
401.15.B.11 of the Zoning Ordinance.
4. The applicant shall receive and retain, if required, a Hazardous Generators License from
Washington County for the Stillwater Auto Clinic operation.
5. All proposed signage shall be in compliance with Section 401.15.G of the Zoning
Ordinance.

Conditional Use Permit - Lapse of Approval:
Unless the City Council specifically approves a different time when action is officially
taken on the request, the conditional use permit shall become null and void twelve (12)
months after the date of approval, unless the property owner or applicant has
substantially started the construction of any building, structure, addition or alteration, or
use requested as part of the conditional use. An application to extend the approval of a
conditional use permit shall be submitted to the Zoning Administrator not less than thirty
(30) days before the expiration of said approval. (401.03.C.4.a and b)
