In reviewing the Zoning Ordinance as it relates to the allowances for parks and
recreation facilities, it has been realized that with amendments to the ordinance in the
past, the provisions for park and recreational facilities in the 0, Open Space
Conservation District have been removed. In March 2001, amendments were made to
the Zoning Ordinance to revise the 0 District so that it would be specifically a "holding"
zone for newly annexed land or land that was not developed. A P-1, Public Industrial
District was created at the same time to provide a zone for school campuses, parks and
City/County/State facilities. The P-1 District exists in the ordinance (Section 401.320)
but none of the properties intended to be zoned to that district were rezoned.
AD of the City parks, the High School, City Hall, the State Correctional Facility, and the
Metropolitan Council's Sewer Treatment Facility are currently zoned 0 District. It is
recommended that the Planning Commission hold a public hearing to again include
municipal parks and recreational facilities, structures and buildings in the 0 District.
That allowed use should not have been removed in 2001. A public hearing has been
scheduled for the Planning Commission's special meeting on June 26, 2006. Once the
Planning Commission reviews this issue further, it may be determined that certain parks
should remain zoned 0 District while others be rezoned to P-1 District. It is further
recommended that in July, the Planning Commission look at the current zoning of the
institutional/park uses versus the P-1 District and then hold a public hearing in August to
pursue rezonings.
A copy of the proposed Planning Commission resolution and Zoning Ordinance
amendment to allow municipal parks and recreational facilities, structures and buildings
in the 0, Open Space Conservation District is attached.
401.21.B. Permitted Uses.

CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
AN ORDINANCE AMENDING SECTION 401.21.B OF THE ZONING ORDINANCE
AS IT RELATES TO ALLOWING MUNICIPAL PARKS AND RECREATIONAL
FACILITIES, STRUCTURES AND BUILDINGS IN THE 0, OPEN SPACE
CONSERVATION DISTRICT AS A PERMITTED USE
THE CITY COUNCIL OF THE CITY OF OAK PARK HEIGHTS,
MINNESOTA ORDAINS:
SECTION t Section 401.21.B, Permitted Uses of the Zoning Ordinance is hereby
amended to read as follows:
Farming and agricultural related buildings and structures subject to Minnesota
Pollution Control Standards, but not including commercial feedlots or other
commercial operations.
2. Nurseries, tree farms and greenhouses all for the growing of plants, but not to
include retail sales.
3. Single family dwellings.

45. Essential services.
.56. Day care facilities serving twelve (12) or fewer persons.
67. Residential care facilities serving six (6) or fewer persons.
78. Cellular telephone antennas located on a public structure as regulated in Section
401.15.P of this Ordinance.
SECTION 2. This Ordinance shall be effective immediately upon its passage and
publication.
PASSED this 26 day of June 2006 by the City Council of the City of Oak Park
Heights.

A RECOMMENDING RESOLUTION
OF THE
PLANNING COMMISSION
CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION ESTABLISHING FINDINGS OF FACT AND
RECOMMENDING TO THE CITY COUNCIL THAT SECTION 401.21.13,
PERMITTED USES OF THE ZONING ORDINANCE SHALL BE
AMENDED TO INCLUDE MUNICIPAL PARKS AND RECREATIONAL
FACILITIES, STRUCTIIRES AND BUILDINGS IN THE 0, OPEN SPACE
CONSERVATION DISTRICT
WHEREAS, the City of Oak Park Heights has initiated a Zoning Ordinance
amendment to Section 401.21.B, Permitted Uses, to include municipal parks, and recreational
facilities, structures, and buildings in the 0, Open Space Conservation District; and after having
conducted a public hearing relative thereto, the Planning Commission of Oak Park Heights
makes the following findings of fact:
1. The City recognizes a need to provide an allowance for municipal parks
and recreational facilities within the areas currently zoned 0, Open Space Conservation District;
and
2. The City staff prepared a planning memo dated June 15, 2006 reviewing
the Zoning Ordinance amendment; and
3. The June 15, 2006 planning memo recommended approval of a Zoning
Ordinance to allow municipal parks and recreational facilities, structures, and buildings as a
permitted use in the 0, Open Space Conservation District; and
4. The Planning Commission held a public hearing at their June 26, 2006
meeting, took comments from the applicants and public, closed the public hearing, and made the
following recommendation
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING
COMMISSION FOR THE CITY OF OAK PARK HEIGHTS THAT THE PLANNING
COMMISSION RECOMMENDS THE FOLLOWING:
A. The initiation by the City of Oak Park Heights for a Zoning Ordinance amendment to
Section 40121.3, Permitted Uses, to include municipal parks, and recreational facilities,
structures, and buildings in the 0, Open Space Conservation District.
