See attached Resolution 10- 08 -26: A Resolution Vacating Certain Drainage and Utility Easements Container[ within the Plat of Oakgreen Village as Located in City of Oak Park Heights, Washington County, Minnesota RESOLUTION NO. 10 -08 -26 CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION VACATING CERTAIN DRAINAGE AND UTILITY EASEMENTS CONTAINED WITHIN THE PLAT OF OAKGREEN VILLAGE AS LOCATED IN CITY OF OAK PARK HEIGHTS, WASHINGTON COUNTY, MINNESOTA WHEREAS, the City Council for the City of Oak Park Heights has received a request from the Developer and Owner requesting the vacation of certain drainage and utility easements dedicated to the city within the plat of OAKGREEN VILLAGE and otherwise described as SEE ATTACHED EXHII3I ( "A;" and WHEREAS, The City of Oak Park Heights finds that the request is consistent with the City policies and that the easements will be rededicated within the Plat of CARRIAGE HOUSE CO -OP AND ASSISTED LIVING so City has no need to retain the drainage and utility easements in the former plat: and WHEREAS, there will be no loss of revenue for the City in allowing this request as the land shall be put to private roadway use; and WHEREAS, that insofar as the land shall be put to private development and use and the easements will be rededicated within the new plat of CARRIAGE HOUSE CO- OP AND ASSISTED LIVING. NOW, THEREFORE, BE IT RESOLVED BY TIIE CITY COUNCIL FOR TIIE CFI'Y OF OAK PARK HEIGHTS AS FOLLOWS: 1. That the City Council for the City of Oak Parl< Heights does hereby vacate the following lands: SEE ATTACHED TACIIED EXI-II131"h "A" BE IT FURTHER RESOLVED, that the City Administrator shall prepare a notice of completion of these proceedings, which shall contain the name of the City, the identification of the vacation, a statement of the time of completion thereof, and a description of the real estate and the land affected thereby. Such notice shall be presented to the County Auditor - Treasurer who shall enter the same in his transfer records and note upon the instrument over his official signature the words "entered in the transfer records." The notice shall then be filed with the County Recorder, all as required by Minn. Stat. §412.551. August, 2010.
