I. SITE PLAN PERMIT FOR: Improvement to Store- Garden Center and Yard Access
Site modifications
All uses shall be subject to the following conditions and /or restrictions imposed by the City
Council of the City of Oak Park Heights and are in addition to not in replacement of
previous variances and Conditional Use permits issues Menards by the City in 1995, 1998,
and 2003.
The City of Oak Park Heights in May of 2007 has received a request from Menard Inc.
for a site plan/Design Guidelines review for a remodel of the exterior of the garden
center, including the addition of bi -fold doors and a new entrance for the Menards store at
5 800 Krueger Lane North; and after having conducted a review relative thereto, the
Planning Commission of Oak Park Heights recommended that the application be
approved with conditions.
The City Council has granted a Site Plan Review and Permit allowing the installation of
the Bi -Fold doors and conditioned the approval based upon the following:
1. All changes to the sidewalk, crosswalk and addition of the bollards are subject to review
and approval of the City Engineer.
2. The green overhang panels shall be installed above the door hinges to the roof line for the
bi-fold and overhead doors on the west elevation of the garden center.
3. Green overhang panels shall be added on the south elevation to cover existing storage
racks, resulting in a consistent overhang on the facade.
4. The City Council intends to construct an eight foot bituminous trail to be added on the
north side of 58 Street adjacent to Menards. Menards agrees to a special assessment for
this improvement and does hereby waive all rights they have by virtue of Minnesota State
Statutes 429.081 or otherwise to challenge the amount or validity of the assessments or
the procedures used by the City in levying the assessments. Menards execution of this
permit acknowledges this waiver.
5. The garden center lights under the canopy shall be shielded to full cut off. Plans for
shielding the lights shall be subject to review and approval of City staff.
6. Menards shall provide a plan for screening the materials storage area that faces east and is
visible from 58 Street. At a minimum, the fence on the south property line shall be
raised to the lower eave level of the accessory storage building and extend east to a point
that fully screens the building materials and as approved by City staff.
The above approvals may grant specific benefits andior site specific authorizations. Unless
specifically listed herein, all improvements and site conditions must remain compliant with
City Ordinances.

As per your request, 1 have reviewed the materials storage area screening plans for
Menards dated September 14, 2006 and May 21, 2008. These plans were submitted to
address a condition of screening for a site plan/Design Standards review approved by
the City Council on June 19, 2007. Condition 6 of that resolution stated the following:
6. Menards shalt provide a plan for screening the materials storage
area that faces east and is visible from 58 Street. At a minimum,
the fence on the south property line shall be raised to the lower
eave level of the accessory storage building and extend east to a
point that fully screens the building materials and as approved by
City staff.
The plans indicate that three new sections of fencing will be added, each raised to a
height that addresses the change of grade. The first section will be at the lower eave
level of the accessory storage building as required in the condition. The plan, as
submitted, shall provide an adequate screening of the building materials.
The applicant must also provide the screening as specified in condition 3 as follows:
