DECLARANT - WITNESSETH St. Cr oix Bowl LTD, Oak Park Development Co., Swager Bros., Inc. WHEREAS,, the Declarant is owner of real property, to the restrictions, covenant;, reservations, easements, liens and charges hereinafter set fort'], each and all of which is and are for the benefit of said property and for each owner thereof, and shall iA re to the benefit of and pass with said said property, and each and every parcel thereof, and shall apply to and bind the successors in interest, and any owner thereof; NOW, THE$�EFORE, Oak Park Development Co., St. Croix Bowl LTD, and Swager Ms., Inc. hereby declare that the property described Croix MA' 1 P -FJ.D. is and shall be held, transferred, wo ," and conveyed subject .o the conditions, restrictions, convenants, ►' rvations, easement,, liens and charges hereinafter set forth. DEFINITION OF TERMS BUILDING SITE shall mean any subdivision, or portion thereof, or any two or more contiguous subdivisior6 or a parcel of land of record and in a single ownership and upon which a building may be erected in conformance with requirements of these convenants. OWNERS small mean Fee Holder. PROPERTY SUBJECT TO THIS DECLARATION The real property which is, and shall be, held and shall be conveyed, transferred, and sold subject to the conditions, restrictions, convenants, reservations, easements, liens and charges with respect to the various portions thereof set forth in the various subdivsions of this Declaration is located in the City of Oak Park Heights, County of Washington, State of Minnesota. GENERAL PURPOSES OF CONDITIONS The real property described in P.U.D. is subjected to the covenants, restrictions, conditions, reservations, liens and charges hereby declared to insure the best use and the most appropriate development and improve- ment of building sites thereof; the protect the owners of building sites against such improper use of surrounding building sites as will depreciate the value of their property; to preserve so far as practicable, the natural beauty cf such property; to guard against the erection thereon of poorly designee or proportioned structures, and structures built of improper or unsuitatle materials; to insure the highest and best development of said property; to encourage and secure the erection of attractive buildings thereon,, with appropriate locations thereof on building sites; to prevent haphazard and inharmonious improvements of building sites; and in general to provide adequately for a high type and quality of improvement in said property, and thereby to enhance the values of investments made by purchasers of builcing sites therein. These Covenants are to run with the land and shall be binding on all parties and all persons claiming under them until January 1, 1979, at which time said Covenants shall be automatically extended for successive periods , Of 10 years unless by vote of a majority of the then owners of the lots or tracts it is agreed to change said Covenants in whole or in part. `-- Invalidation of any one of these Covenants by judgement or court order shall i,r no way affect any of the other provisions which shall remain in full forse and effect. BUILDING HEIGHTS All buildings built within the area will maintain a roof height �¢ not to exceed present St. Croix Mall Buildings. b PARKING AND LOADING There shall be no parking, loading or truck service between the`, C °J� building lines and the street property line. The follwing types of uses shall provide a minimum of off street parking space, as indicated, shich parking space shall have proper access from a street. Owners agree to maintain present amounts of parking or six cars ppr 1Qn sq. ft. of building, not including common area. Each owner agrees to allow cross parking and trafic flow. All off street parking areas shall be surfaced with black top. s� BUILDING MATERIALS Any building erected on the property shall be equivalent to present structures of exterior walls. MAINTENANCE OF VACANT LAND Owners of vacant land must keep said land clean, keep weeds cut and maintain the land in a manner that will not depreciate other property within overall area.
