Licht DATE: 28 August 1978 RE: Oak Park Heights - St. Croix Mall - PUD Covenants (Review of Draft received 24 and 28 August 1978) 1 . Is Kentucky Fried Chicken included? 2. Section 1 .a. - Suggest adding the wording ....By the parties hereto as identified on the attached site (plat) plan. 3. Section 5 - Seems weak - more detail and control needed. 4. In parking /accessAuiI ding section - maintenance is not covered for protection of other owners. Some standards should be imposed. 5. Section 7 - A means of changing membership and votes on the Management Committee would appear to be necessary. The formula utilized for votes and participation should probably be outlined. 6. Landscaping plans, materials, and maintenance should be included. The Olene Avenue situation is a prime example. 7. Sign control or limitations subject to City ordinances should be included. 8. Lighting standards and similar utility structures should be covered. 9. Permitted uses should be addressed. 10. Some attention to drainage and water runoff should possibly be added. This does not appear to be covered adequately by Section 3. The various. owners may also wish to consider costs of installation, maintenance and repair. 11. The covenants should also be tied in some fashion or another to the City's conditions for PUD approval. 28 August 1978 Page Two 12. City approval of change in the covenants should be noted. It would appear advisable to include such a stipulation in the convenants to ensure that such a requirement is adequately publicized. 13. Public easement access for emergency vehicles, postal service, etc. should be considered. Possibly such can be noted on the final plat. (798.02)
