The pla -r :also proposed to remove 54 existing parking spaces located within the vicinity of the hondball%roquetuoir court and add 49 spaces just east of the proposed facility. This represents a loss of 5 parking spaces for the bowling alley. In addition, 55 future parking spaces are provided for in a location just south of the handball /raquetbeil The applicant initially requested approval of a Spey :al ;ke ermit for a commercial recreation facility in the area to the seuriiwe�t of the St. Croix Bowl. Upon ana'ysis of the initial request, it was deter: ined that a nu mber of concerns existed and should be resolved or layoui r+edune prior to further consideration of the request. In the review of a rev sec : four con- siderations are before the amity Council. These cry 1) a rez - wing from L. Is. (Limited Business) to R -B (Retail Business, (2, a mincr sub - 'iv;s;Un, ;;:) A Specia! Use Permit for Commercial Recreational Use within the P -B District and (4) Design and layout of a commercial structure. ANALYSIS AND EVALUATION A copy of the revised site plan is attached to this report. In compliance wits. suggestions mode by the City, the building has been relocated to a site abuttin.7 Olene Avenue. This revision eliminates a former problem of the facility havin7 no street frontage which, if found acceptable would hove required a variance creating a highly questionable precedent. As proposed, the building entrance would be toward the east. Such is desireable to minimize the impact of the facility on the residential property to the west one relates the structure more properly to existing commercial activities. Access is to be via Omaha Avenue and through private property located to the east. In this repard, no information has been presented demonstrating access by private easement. The area immediately south of the facility on the NSP Power line easement has been designated for parking. Fifty five spaces are suggested. Additional parking. is proposed on other small areas of the lot. A significant factor, however, is removal of several spaces adjacent to the Olene Avenue property line and con- version of the space into landscaping. The landscape concept suggested for the Olene Avenue Boulevard extending southward from the VFW Club has been extended along the full border of the site. This extension is beyond the street into the lot line adjoining the City park located within the NSP easement. Utility locations and drainage have been proposed and indicated on the site plot. A review of this information has not as yet been completed by the City Engineer to determine acceptability. Building plans as of this date have not been completed and subr fitted to the Cit; for review and acceptance. A registered land survey defining the new proper� division in compliance with SectionjX(G) of the subdivision ordinance has also not been completed or submitted for review. Such a situation is considered acceptable for the moment pending the City's general determination on the pion as now proposed. REC O&UPAE NDAT I ON The conclusion reached upon analysis of information submitted and the subseque:,t evaluation as summarized by the preceding section is that the City Council should proceed to approve the rezoning, subdivision, and Special Use Permit request subject to the following conditions: 1. A revised registered land survey be prepared, submitted and filed in compliance with the provisions of Section 5 of the Subdivision Regulations. Such survey shall be considered acceptable if it substantiates revised plans currently under consideration. �F pak Park Heights Mayor and City Council " G 8 F Development Corporation dune 24, 1977 Page Three 2. A legal drawn and registered easement is prepared wl­!ch guarantees vehicular access to the facility across all private property from the end of public access at Omaha Avenue. Acceptability of such a document shol I be subject to the City .Attorney's review and approve! . 3. No vehicular access, other than emergency vehicle access be permitted to the property along Clone Avenue. 4. The area designated as future parking be developed in conjunction with the initial construction of the facility. 5. The utility service and drainage plans be reviewed by the City Eng;neer and final design acceptance shall be subject to his approval . 6. The area between the building and the C Iene Avenue property line La landscaped in a fashion subject to the approval of the City ''lvnner. 7. The boulevard landscaping plan established by the City beginning at the VFW site and extending southward along Clone Avenue shall be extended along the full western border of the property in question. 8. Building and sits plan details are to be submitted for review and subject to the acceptor,• , c of the City Council prior to the issuing of building permits. 9. Performance bonds to assure compliance with improvements stipulate -.i be provided and applied in the following f60,'!on: a. The City shall be provided with a surety bond, cash escrow, certificate of deposit, securities or cash deposit prior to the issuing of a building permit or initiation of work on the pro- posed improvements or development. Said security shall be cancellable and shall guarantee conformance and complionce with the conditions of the request approval and the ordinances of the C i ty . b.
