Re: Restrictive Covenants and Cross Easements
for the St. Croix Mall
Dear Bob:
As I indicated to you in our telephone conversation
of September 20, 1978 we have reviewed your final draft of the
Restrictive Covenants and Cross Easements for the St. Croix Mall
with respect to our recommendations as were set forth in a letter
to you of September 7, 1978.
We find that all recommendations with the exceptions of
the 1st and 7th recommendations of the 9 -7 -78 letter, have been
adopted and incorporated into your draft of the Restrictive
Covenants. For your information and review the first recommendation
we made in our letter of 9 -7 -78 was that accurate legal descriptions
be provided to identify each and every property owners' interest
in the area. The seventh recommendation was that the site plan be
attached and incorporated by reference and have a clear designation
of parking area available to each party upon their tract of land.
As you indicated to me in our telephone conversation, both those
recommendations will be adopted and provided for in the Restrictive
Covenants upon a final survey of the premises which is to be made
in the very near future. With the understanding thatthose recommen-
dations will be provided for after the survey has been made, be
advised that the City Attorney's office ofthe City of Oak Park Heights
finds your draft of the Restrictive Covenants and Cross Easements
of the St. Croix Mall to be in order and that we have no objections
thereto.
