Upon authorization of the Oak P*rk Heights Mayor and City Council, this
letter is being written at your rust to document the status of the City's
processing of the St. Croix Mall PUa application.
Based upon information and plans submitted, the Oak Park Heights City
Council on 11 September, 1978 grave preliminary approval to the St. Croix
Mall PU4 and plat contingent upon several factors which had yet to be
completed or finalized. Based upon your report to the City Council on
14 October, 1978, it appears that all these gutters are being attended to
the general satisfaction of the City. In this regard, it is recognized that
several detailed items yet remain to be completed. However, none would
appear to present a significant problem which can not be resolved.
A difficulty being encountered is the completion of the final plat "Hard
Shell." Due to what is apporcantly a failure to provide monumeentation by
Washington County and the Minnesota Department of Transportation, the
registered land surveyor cannot complete his work. from indications
supplied by yourslalf, it would appear a two week delay in submission of
the final plat will be experienced. Jncedhis is completed and arrangements
finalized on the other matters, the project should be able to proceed.
We would also comment that the continued processing of the application would,
in our opinion, not delay or disrupt transactions regarding the proposed K-mart
ctctivisibion. While the City cannot recognize a fond transfer until a final
plat Is approved and filed, it would appear feasible for the attorney's involved
to draft appropriate agreements conveying the land, subject to its eventual final
plat being recorded. This should not be a time obstical for K-m art, as we were
informed by their engineer can 14 October that there are several changes again
being made to the site plan. Building plans,,os a consequence, may have to be

modified. once available, the final building plans tan be reviewed and if
necessary, processed simutaniously with the final plat.
