Dear Mr. Turrantine:
We are in receipt of your correspondence dated 14 February relative to the
St. Croix Mall PU D. In this regard, we are somewhat confused as to what is
intended by the "Real EstatodDevelopmeant Agreement ". Is this document intended
to replace the "Restrictive Covenants and Cross Easements" which was submitted
last WI? If such Is the case, we do not agree with the changes which have been
made. They are much more than cosmetic in nature.
The difficulty currently being encounterd centers on what we understand to be
:led Owl's objections. As only a leasee of the St. Croix Mall, and not an owner
of property, we fall to sere why they are involved In the F'iet place. Also, there
has been an inference that the PLED designation would alter zoning rights currently
enjoyed. It Is our assumption that the St. Croix Mall and its surrounding related
uses area legal but would be general designated con - conforming unless a PLID
designation is applied.
At this paint In time, we would also suggest that your client restate In total what
In fact has been agreed to as part of the PUD permit and what is requested as being
waved. .Duo to the continual ploosmool erosion of the PUD approval, through
the various variance which hove been requested, It Is doubted that anyone understands
what has: or hasn't been established. Such Is sewn as a benefit for both the developer
as well as the City.
