Dear Marls:
As per your letter of 5 November 1579, I have researched our riles in order to attempt
to determine what in fact has been completed relative to the St. Croix Mall PUD and
Plot.
It is my understanding that the conditions outlined in the Midwest PlonnirQ memo dated
11 September 1978 were the stipulations accepted ord approved by the City Council
for the project and development. How many of these requirements have been met is
the question. in this regard, I have attached a copy of the 11 September memo which
was sent to herd Swagger on 2 October 1978 indicating items which were still needed,
Also enclosed Is a copy of a letter iced presented at a City Council meeting on or ablaut
10 October 1978.
As I recall, K -Mart as well as Red Owl subsequently objected to the proposed
restrictions. This prompted a letter from our office dated 20 February 1979, which
explained our position relative to the zoning of the property, as well as Its non -
conforming status. A copy of this letter is also enclosed.
As the matter stands now, our position remains the scarce ars expressed In our
11 September memorandum and as to those items accepted by Swagers In their
10 October letter. We believe that if these are not included in the dead restrictions
against the properties, that they should be part of the PUD conditions approved by
the City and filed against the titles.
As Indicated earlier, we are somewhat uncertain as to the submission of all required
materials. Possibly you should contact Red to hove him, provide a total set of items
for the City files.

Also to the nest of my knowledge, no final plat was over accepted by the City.
We could possibly prohibit K -Mart from a certificate of occupancy until this is
completed. The final plat will also have to take Into account the Oasis Gas
Station question, as they are suggesting a property madlfication from what was
formerly Texaco.

assistance. We would also appreciate a review of the PUD agreement prior to
finalization.
