RE: St. Croix Mall Entrance Road Feasibility Study
Dear Council Members:
This letter outlines M.A. Brekke's and our position relative to
the land dedication outlined in the St. Croix Mall entrance road
feasibility study. It is our position that two roadway accesses
(57th and 58th) to Osgood Avenue must be maintained to ensure
public safety for •the present and future property owners.
We agree to dedicate the land described in the feasibility study
for the 57th and 58th access changes to Osgood Avenue. This
agreement is contingent on the following conditions:
1. The vacated 57th and 58th roadways shall be removed and
reconditioned to the surrounding elevation at the sole cost
and expense of the city. The vacated roadway property
ownership reverts from the city to the appropriate owner
(Brekke or Olsen).
2. The existing utilities with the exception of the main
sewer trunk line shall be removed and relocated at the sole
cost and expense of the city. The water line shall be
relocated adjacent and parallel to the sewer line and
relocated along the Osman or Osgood right -a -way.
(The final location must be negotiated based on reviewing
the water line drawings. According to Watson Centers,
these drawings have not been made available either at
Bonestroo, Rosene, Anderlik & Associates office or by mail.)
3. No assessment on the aforementioned property shall be
made for any costs associated with implementation of these
roadway and utility changes.
4. The city shall absorb all administrative, engineering,
consulting, legal and other costs related to the land
transfer and construction.
