BACKGROUND
Bill Mules, representin Gartner Restaurant Holdin has made application to construct
a Dair Queen at 14447 60"' Street North. The propert is west of the Super America at
the corner of 01ene Avenue North and 60t" Street. The application consists of re
for a conditional use permit for a drive throu and site plan/Desi Guidelines review.
The propert has previousl been a vehicle sales lot and the buildin on the site will be
removed as part of this proposed development.
The site is 56,963 s feet in size and is zoned B-2, General Business District in
which restaurants are a permitted use. The drive thru and convenience food
establishments are allowed throu a conditional use. Site Plan and Desi Guideline
review are re for an redevelopment project.

PROJECT DESCRIPTION
PION
The proposed Dairy Queen is to be located at the corner of Olene Avenue and 60
Street, just west of the Super America. It will b a one story building of 2,164 are
feet with 69 seats. There will also be an outside seating area at the front of the building.
A picnic area is also provided at the rear o f the site. The Dairy Queen will also provide
a drive thru option. Access for the site is from 60 Street. Two access points are
currently provided from 0 and these two accesses will remain. The access nearest
lene will be two way, while the exit to the east will be one way out.
An area directly to the east of the Dairy Queen and west of the Super America will
remain as a paved area, This was a portion of the former used car sales lot. The lot is
platted a a separate parcel that is not part of the proposed Dairy Queen or the Super
America site. All of these properties are under t he sane ownership. The paved parcel
adjacent to the Super America will remain as a parking area for Super America
employees and customers. It is assumed that this lot would be combined with the
Super America site for future development. The parcel cannot b developed as a
separate parcel in that it does not have adequate frontage on 6 Street.
A ten foot grassed area will be created within the parking lot adjacent to the Dairy
Queen site. It will be irrigated from the fairy Queen system and maintained by the
owner of the property, The applicant has provided draft copies of the agreement for
maintenance of this grassed area. The city will require a copy of the final agreement as
a condition of approval.
ISSUES ANALYSIS
Comprehensive Pi . The property is designated as Commercial on the Proposed
Land Use Map. The fairy Queen restaurant will be consistent with this land use
designation.

Zoning. The property is zoned -2 General Business District. Restaurants are a
permitted use, but drive through and convenience food establishments ent are a listed
conditional use. A review of the criteria for this project is as follows. The District
requires a 40 foot front yard setback, 10 foot side yard setback and 20 foot rear yard
setback. The building meets or exceeds these requirements. The building height
maximum in the -2 District is 35 feet. At its highest point, the building will be 20 feet, 6
inches,
Section 401 .301.E of the Zoning Ordinance lists criteria for revie w of drive through and
convenience food establishments. ents. Ail of the issues raised in those criteria have been
addressed in this report. The one item that should be reviewed carefully by the
Planning Commission is the first criterion that specifies compliance with the Design
Guidelines.
Subdivision. The property is currently in a meets and bounds description. The
property owner has the option of plating it as a one lot subdivision and pay park
dedication at this tine, or to leave it in the current description. If left in a meets and
bounds description, 10 foot utility easements along all lot lines will need to be provided
to the city at this time. The applicant has indicated that the lot will not be platted at this
time.
Access. As indicated, the site will be accessed by 00 Street. Two curb cuts on 60
exist at this tine, and the applicant has indicated the sane on the site plan. Staff
discussed the option of an access off of 01ene Avenue but the topography of the site
made this option problematic. if the two accesses did not currently exist, the applicant
would be allowed only one access from 60 Street. The access closest to Olene
Avenue has been moved to the east from its current location. The location of the
access points are subject to review and approval of the city Engineer.
Parking. Section 401 F 1 5, F.9 of the Zoning Ordinance requires one off street parking
stall for each 35 square feet of gross floor area or service and dining area and one
space for each 8 square feet of kitchen and storage area, Additionally, two spaces are
required for the drive-through and 180 feet of drive aisle stacking space must be
included. The parking calculation for this site is as follows:
1 ,029 sg ft (seating /service) x.9 -= 920135 = 27 spaces
1,085 sg ft kitchen /storage) x.9 = 976/ 80 = 13 spaces
2 give through spaces = 2 spaces
Total 42 spaces
The site plan indicates that there are 43 paring stalls planned for the development, two
of which are disability accessible. The layout as designed will meet the required
number of parking stalls and disability accessible stalls.

The parking spaces are 9 foot vide stalls with at least 22 foot driveway aisles in
compliance Frith the Zoning Ordinance. The parking area will be completely surrounded
by curb and gutter. All of the parking areas are setback from the property lines at least
g feet in compliance with the requirements. There will be landscaped areas at the
front and rear of the building as well as surrounding the parking lot and drive tl ru lane,
Three rain gardens are provided within the parking lot and directly behind the building.
Loading areas /Trash Enclosure L c flon. The loading access to the building will be
from the parking lot and deliveries are made at the rear o f the structure. The
representatives of Dairy Queen have indicated that deliveries are made at off peak
hours so as not to disrupt traffic flow within the site. Additionally, the delivery area will
not impact the drive tbru lanes. The trash enclosure is located at the rear of the site and
is constructed of brick to complement the main structure.
Ga1i /Drainage /lrlitis: Grading, drainage and utility plans have been provided b
the applicant. The City Engineer will provide separate report n engineering issues.
The grading, drainage and utility plans shall be subject to review and approval of the
City Engineer and the Middle St. Croix Watershed District.
Lighting Plans,,
Fixtures. The lighting plan indicates a shoo box style, full cut off light fixture mounted on
a polo and base with a total height of 24 feet in compliance with the lighting
requirements. All of the parking lot fixtures are adequately setback from property linos.
The plans indicate the locations of the full cut off building gall mounted fixtures. Both of
these fixtures are consistent with zoning requirements. The project architect should
specify the color of the pole mounted and building light fixtures.
Photometric s. The lighting plan is in compliance with zoning requirements for lighting
intensity. The light intensity is required to be less than one foot candle at the centerline
of adjacent streets and 0.4 foot candles at the property line.
Tours, Outdoor lighting for parting lots shall be turned off one hour after closing,
except for approved security lighting.
Accent Lighting. The plans call for the use of an LED flexible tube accent lighting at the
front and partially on the sides of the structure. The Design Guidelines do not allover
building color wraps or neon as a building accent. This feature will need to be removed
from the plans.
Landscaping. The submitted plans indicate plantings at the front and rear of the
building, and surrounding the parking lot and drive aisle. The City Arborist has provided
report on the landscaping as attached to this report. The final landscape plan is
subject to the review and approval of the City Arborist.

The landscape area along the east property line will abut the existing parking lot of the
former used vehicle lot. The elevations of the parking lot and landscape area have
been matched. As indicated the applicant will install a 10 foot grassed area on the
adjacent site as a transition to the parking lot.
Mlhn *ll Screening. The plans indicate that the parapet galls are designed to
totally screen the mechanical equipment.
Sig.
Freestanding Sign. The Zoning ordinance allows for one freestanding sign not
exceeding 20 feet in height and 100 square feet in sign area. A freestanding sign is
proposed at the front of the lot rear the easterly exit. The sign is 20 feet in height, and
the signage is total of 87 square feet. A brick planter is provided at the base in
compliance with the requirements. The Design Guidelines indicate that ground
remounted or monument signs are preferred over pylon signs. The Planning Commission
should comment on the design of the sign. It right be more attractive as a 20 foot
monument sign with the three signage elements incorporated within.
Wall Signage. The Zoning Ordinance allows for a total of two wall signs, each on
separate facades. The proposed sign plan indicates two wail signs, one on the front
fagade facing 0 Street and the other facing west. on the front fag de, the signage is
to separate sign bones, but in that they are only separated b y a gap of six inches staff
regards them as one sign. This is consistent with past practice.
Total Allowable Signage. The total square footage of signage shall not exceed Soo
square feet for the site. The wall signs are a total of 82 square feet. The total signage
proposed for the site is 169 square feet. The sign plans indicate the location and type of
directional signs. The directional signs do not include advertising which is consistent
with the requirements. The signage, including all directional signs shall be subject to
review and approval of City Staff at the time of sign permit application.
Sign Illumination. The Dairy Queen logo signs Grill and Chill signs and the manual
reader board is to be internally lit. The sign plans show that when the signs are
illuminated at night, only the logo portion of the sign will be lit. The signs as designed
should c omply with the Zoning ordinance lighting requirements. Staff will approve the
lighting specifications for the signs at the time of permitting.
Design Guidelines
Sustainable Guidelines. City staff has questioned the applicant on how the project has
been designed to achieve at least a certain degree of sustaina ility. The applicant will
need to discuss the methods in building construction and site design with the Planning
Comm ission of hover these issues have been add ressed,

made Treatments
The building will have a definite base, middle and top. The Planning Commission
should discuss the metal cooler at the rear of the building and the blue and red
color accents on the building facades.
Ground Level Expression
This is a one story building with a raised parapet feature at the Center of the front
f g de. The rain entrance is well defined by the awnings and sign age,

The building uses glass on all of the facades except for the rear w hich is partially
obscured by the metal cooler. The Design Guidelines requires at least a 20
percent transparency on ground floor, street facing facades. The fa de facing
60 Street is approximately 19,1 percent transparent. The two side facades
closest to the front have transparencies of 20 percent and over. The planning
Commission should discuss this.
Entries
The building features a prominent entry with a raised parapet, stone wall
materials and awnings,
Roof Design,
The rooflino is broken at the front by a raised parapet feature. The rooftop
mechanical equipment will be completely screened within the parapet of the
building.
Building Materials and co lors
The applicant has provided color elevations for review. The primary building
materials of brick, stone and glass will exceed the 60 percent requirement. None
of the prohibited building materials will be used, The Planning Commission
should discuss the use of the blue metal panels and the red the accents on the
sides of the building. Building material samples will be available at the Planning
Commission meeting.
Franchise Architectu
The buildin g is a franchise design but it is consistent with the basic principles of
the Design Guidelines. This should be discussed by the Planning Commission.
Site Design Guidelines
Building Placem
The proposed building has a well defined entrance facing bo Street. The
building is set back to allow for parking and landscaping.
Parking Areas
The parking area is landscaped with perimeter plantings and rain gardens.
Storm water
Storm water will be addressed in the city Engineer's report.
Pedestrian and Common Space
Currently, there is no trail along 0t" street at this location. It is expected that
MN of will install a trail when improvements er ents are made to the frontage roads of
60 street. The Planning Commission sho Ild comment about creating a trail
connection through the site at this tire.

Building entrance plantings are required and are provided at the main parking lot
entrance and along the on the west side of the building. An outdoor seating area
is provided adjacent to the front fagade. That area is landscaped and fenced.
Trees /Shrubs
The trees and shrubs used in the landscape plan shall be subject to the review
and approval of the City A rborist. The Arborist has indicated that the plan is well
designed with a good v ariety of plant materials.
Fencing
The fence in the front yard, around the outdoor seating area, is three feet in
height and to be constructed of an open wrought iron. The fence is in
compliance with the requ irements.

CONCLUSION / RECOMMENDATION
Upon review of the requests for Conditional Use Permit, Site Plan and Design
Guidelines review, City Staff would recommend the project with the conditions as
follows:
1. The applicant shall provide an executed copy of the Boundary
Development a greement prior to issuance of the building permit.
2. Ten foot utility and drainage easements along all lot lines shall be
provided to the City. The easement shall be recorded on the property
subject to review and approval of the City Attorney and City Engineer,
3. The two access points are subject to review and approval of the City
Engineer and permitting by the Minnesota Department of T ransportation.
The grading, drainage and utility plans shall be subject to the review and
approval of the City Engineer. The drainage plans shall be subject to the
review of the fiddle St. Croix Watershed District.
5. All lighting fitures shall be full cut off and installed in compliance with the
lighting standards of the Zoning Ordinance.
6, The outdoor lighting shall be turned off one hour after closing, except for
approved security lighting.
7. The applicant should specify the color of the pole mounted and building
light fixtures.
The LED flexible tube accent lighting shall not be used and shall be
removed from the final plans.
9. The landscape plans are subject to review and approval of the City
rborist.
10. All sign age, including directional signs, shall be subject to final review and
approval of City Staff.
11. The Planning Commission should comment on the proposed pylon sign.
The Design Guidelines indicate a preference for monument signs.
12. Mechanical equipment that is located on the roof and visible from street
level or from neighborhood properties shall be screened with materials
that blend harmoniously with the building fgade materials.
3. The applicant shall address lust in bility initiatives with the Planning
Commission.
14 . The Planning Commission shall discuss the front fagade transparency and
determine compatibility with the Design Standards.
15. The Planning Commission should comment on the building material
selection and colors, and the awnings. In particular the Planning
Commission should discuss the color accents and the metal cooler at the
rear of the building.

from the site.

| have reviewed the landscape plan for the proposed Dairy Queen site and visited the site to inspect the trees. | have the
following comments
1. | would not recommend trying to preserve the large cottonwood onthe west side of the property since this type of tree |s
weak-wooded and not structurally sound. The tree will also suffer markedly from construction damage unless all
construction activity is kept away from the trunk a minimum of 25 feet on all sides. The boxe|der(#3 8O1). which \s
indicated bobe saved in that same area, has multiple trunks, several mf which are dead ordying and this species |oalso
considered weak-wooded and not structurally sound, Saving trees such aa these /nan area where public seating iaalso
planned, would be a potential risk io users ofthe area. | would instead recommend planting more trees which can
eventually shade the eating area, or covering the eating area with a pergola or trellis of some kind.
2. Other tree work� The cottonwood on the south side of the property. vvM|oh is mostly dead should be removed. This tree
is in poor condition and will not count toward tree replacement requirements. For other trees which are iobe kept onthe
property, dead branches should bo pruned out of the canopies. All other dead or dying trees should also be removed from
the site.
3. The proposed landscape plan |s very nice. There io good variety of plant material, the plan 1s attractive and the plant
species are hardy, attractive, and relatively insect and disease resistant. There are several rain gar-dens in the proposed
plan and the species listed for those areas are also appropriate for the site.
4. There |s underground irrigation specified for the rain garden areas
is this usual and/or necessary?
5. The "Planting Detail" which accompanies the plan is accurate and complete. The plantings will be inspected for
adherence to the planting detail and, if not planted properly, the work will have to be re-done.

The Manning Commission, at it's meeting on September 16 , 2010, discussed the draft
goal and policy additions to the Comprehensive Plan that had been provided for the
Energy Efficiency and Conservation Grant project. The Planning Commission also
discussed the regulations for wind energy and solar energy systems. The discussion
.provided direction for staff to make changes to the Comprehensive Plan amendments
and in drafting the regulations for alternative energy systems.
For the October 14, 20 10 meeting, the Planning Commission will be asked to review the
draft Alternative Energy Systems ordinance. This will be a totally new section of the
Zoning ordinance and will be added as section 401.17. Please note that it addresses
definitions solar energy systems, wind energ y systems and ground source heat pumps.
Once the Planning Commission discusses what will be allowed in each Zoning District,
the final ordinance will include the alternative energy system by District.
The Planning Commission should review the draft in detail so that we can discuss it at
the October 14, 2010 meeting, The Planning Commission should also schedule a
public hearing for the November 11 } 2010 meeting to consider the Comprehensive Plan
and Zoning ordinance revisions for the Energy Efficiency and Conservation project.
401.1 7. ALTERNATIVE ENERGY SYSTEMS ORDINANCE
401.17.A. . Scope# This section of the Zoning Ordinance applies to all
alternative energy systems in all zoning districts.
401.17. B., Purpose and Intent. It is the goal of the City, as expressed in
the Comprehensive Plan, n, t the commitment of preservation of the environment
and to the principle that each generation of residents rust meet the needs of the
present without compromising the ability of future residents to root their own
needs. in accordance with that goal, the City rinds that it is in the public interest
to encourage alternative energy systems that have a positive impact on energy
production and conservation while not having an adverse impact on the
community. Therefore the purposes of this Ordinance include:
To promote rather than restrict development of alternative energy sources
by removing regulatory barriers and creating a clear regulatory path for
approving alternative energy systems.
2. To create a livable community where development incorporates
sustainable design elements such as resource and energy conservation
grid use of renewable energy,
3. To protect and enhance air qualit limit the effects of climate change and
decrease use o f fossil fuels.
4. To encourage alternative energy development in locations where the
technology is viable and environmental, economic and social impacts can
be mitigated.
401.17.C. DEFINITHONS
Alternative Energy Systems Related:
1. Accessory: For the purposes o f this section, means a system
designed as a secondary use to existing buildings or facilities,
wherein the poorer generated is used primarily for on -site
c onsumption.
2. Alternative energy s ysterw A ground source heat pump, wind
o r solar energy system,
3. Building - integrated solar energy system: A solar energy system
that is n integral part of a principal or accessory building,
rather than a separate mechanical device, replacing or
substituting for an architectural or structural component of the
building including, but not limited to, photovoltaic r hot water
solar systems contained within roofing materials, rindo s,
skylights and awnings,
4. Closed loop ground source heat pump system: A system that
circulates a heat transfer fluid, typically food -grade antifreeze,
through pipes or coils burled beneath the land surface or anchored
to the bottom in a body of water,
5. lush- mounted solar energy system: A roof-mounted systern
mounted directly abutting the roof. The pitch of the solar collector
may exceed the pitch of the roof up to five percent but shall not
b higher than ten o inches above the roof.
6. Ground source heat pump systern: A stern that uses the
relatively constant temperature of the earth or a body of water to
provide heating in the winter and cooling in the summer. System
components include open or closed loops of pipe, coils or plates;
fluid that absorbs and transfers heat; and a heat pump unit that
processes heat for use or disperses heat for cooling; and an air
distribution system.
`. Horizontal ont l ground source heat pump system: A closed loop
ground source heat pump Bern where the loops or coils are
installed horizontally in a trench or series of trenches no
more than twenty 20 feet below the land surface.
8 Heat transfer fluid: A non -toxic and food grade fluid such as
potable water, aqueous solutions of propylene glycol not to exceed
twenty 2 percent by weight or aqueous solutions of potassium
acetate not to exceed twenty 2 percent by weight.
Horizontal axis wind turbine: A wind turbine design in which the
rotor shaft is parallel to the ground and the blades are
perpendicular to the ground.
10. Hub: The center of a Arvind generator rotor, which holds the blades
in place and attaches to the shaft.
11. Hub height: The distance measured from natural grade to the
center of the turbine hub.

2. Monopole tower: A tower constructed of tapered tubes that fit
together symmetrically and are stacked one section on top of
another and bolted to a concrete foundation without support
cables,

groundwater as heat transfer fluid by drawing groundwater from a
well to a heat pump and then discharging the water over land
directly in a water body or into an injection well.

transferring the energy via a heat exchanger.
15. Photovoltaic y tet : A solar energy system that converts solar
energy directly into electricity.
6. Residential wind turbine: A wind turbine of ten o kilowatt k\N
nameplate generating capacity or less.
17. Small wind turbin : Awind turbine of one hundred (loo) kVV
nameplate generating capacity or less.
18. Solar energy system: A device or structural design feature, a
substantial purpose of which is to provide daylight for interior
lighting or provide for the collection, storage and distribution of solar
energy for space heating or cooling, electricity generation or water
heating.
g. Total height: The highest point above natural grade reached by a
rotor tip or any other part of a wind turbine.
20. Tower: A vertical structure that supports a wind turbine.
21. Utility wind turbine: A wind turbine of more than one hundred (100)
kVV nameplate generating capacity.
22. Vertical axis wind turbine: A type of wind turbine where the main
rotor shaft runs vertically.
23. Vertical ground source heat pump system: A closed loop ground
source heat pump system where the loops or coils are installed
vertically in one or more borings below the land surface.
2 . Wind energy system An electrical generating facility that consists
of a wind turbine, feeder fines, and associated controls and may
include a tower.
25. Wind turbine: Any piece of electrical generating equipment that
converts the kinetic energy of blowing Arvind into electrical energy
through the use of airfoils or similar devices to capture the wind.
401.17.D. solar Energy systems.
1. Zoning District Allowances. solar energy systems in accordance with the
standards of this section are allowed as a permitted accessory use in all
zoning districts.
2. Stand
a. Exemption. Passive or building - integrated solar energy systems
are exempt from the requirements of this section and shall be
regulated as any other building element,
b. Minimum Lot Size, In all zoning districts, a minirnum lot size of
eight thousand (8,000) square feet is required for ground-mounted
solar energy systems.
C. Height, roof - mounted solar energy systems shall comply with the
maximum um height requirements of the applicable zoning district.
Ground - mounted solar energy systems shall not exceed fifteen (1 5
feet in height.
. Location. In residential zoning districts, ground - mounted solar
energy systems are limited to the rear yard. In non - residential
zoning districts, ground - mounted solar energy systems may be
permitted in the front yard of any lot or the side yards on corner
lots.
e. setbacks, In all zoning districts, ground - mounted solar energy
systems including any appurtenant equipment shall be set back a
minimum of fifteen 5 feet from all property lines and a minimum
of thirty 30 feet from all dwellings or buildings located on adjacent
lots. roof - mounted systems shall comply with all building setbacks
in the applicable zoning district and shall not extend beyond the
exterior perimeter of the building on which the system is mounted.

Roof mounting. Roof-mounted solar collectors shall be flush
mounted on pitched roofs. Solar collectors may be bracket
mounted on flat roofs.
9. Easements. Solar energy systems shall not encroach on public
drainage, utility roadway or trail easements.
h. Screening. Solar energy systems shall be screened from view to
the extent possible without reducing their efficiency. Screening
may include wall-s, fences or landscaping.
i. Maximum um Area. In residential zoning districts, ground - mounted
s olar energy systems shall be limited to a maximum ur lot area
consistent with the accessory structure limitations in Section
40...4. of this ordinance which specifies no more than twenty
fire 25 percent of the roar yard for all structures.
. Aesthetics. All solar energy systems shall use colors that blond
with the color of the roof or other structure. Reflection angles from
collector surfaces shall be oriented away from neighboring
windows. Where necessary, screening may be required to address
glare.

Ordinance may be permitted through a conditional use
permit in accordance with Section 401.17.D, and Section 401.03 of
this ordinance.
3. Safety.
a. Standards and certification.
1 Standards. Solar energy systems shall meet the minimum
standards outlined by the International Electrotechnical
Commission (1 EC) the American Society of Heating,
Refrigerating, and Air- conditioning Engineers SHl,
STM International, British Standards Institution (BSI),

2 Certification. Solar energy systems shall be certified by
U nderwriters Laboratories, Inc. and the National Renewable

Energy Laboratory, the Solar Rating and Certification
Corporation or other body a s determined by the
City Administrator. The city reserves the right to deny a
building permit for proposed solar energy systems deemed
to have inadequate certification.
b. Utility Connection. All grid connected systems shall have an
agreement with the local utility prior to the issuance of a building
permit, A visible external disconnect must be provided it required by
the utility,
4. Abandonment. It the solar energy system remains nonfunctional or
inoperative for a continuous period of one 1 year, the system shall be
deemed to be abandoned and shall constitute a pUblic nuisance.
The owner shall remove the abandoned system a t their expense
after a demolition permit has been obtained. Removal l includes the
entire structure including transmission equipment.
5. Permits. A building permit and conditional use permit, if
required, shall be obtained for any solar energy system prior to
installation.
401.17.C. Wind Energy Systems
Zoning District Allowances. Wind turbines in accordance with the
standards of this section are permitted accessory uses on lots at least
three 3 acres in the o Open Space Conservation District and the l
Industrial District, and on lots at least 1.5 acres in size in the -3 Highway
y
Business and Warehouse e District, the -W Busi ness/VVareho se
District, and the P-1 Public Institutional District provided the wind turbine is
located at least three hundred feet from a residential zoning district, find
energy systems are not permitted in any other zoning districts including all
districts zoned PUD, Planned Unit Development.
2. Standards.
a. Number. No more than one 1 wind energy system is permitted
per parcel.

b. Height, In the o open space Conservation District and the 1
Industrial District, a maximum hub height of sixty (60) feet is
allowed as a permitted accessory use; additional height up to one
hundred twenty 20 feet in total height m ay be permitted as
conditional use in accordance with section 401.17.D and
Section 401.03 of this ordinance. in the -3 Highway Business
and Warehouse District, and the -w BusinessMarehouse
District, a maximum hub height of forty fire is allowed as
permitted accessory use. Additional height, up to seventy five
(75) feet in total height, may be permitted a s a conditional use in
accordance with section 401.17.D and section 401.03 of this
Ordinance.
C. Blade length. A maxiMm blade length of fifteen feet is
perm fitted.
d. Roof mounting. Roof mounted wind turbines are not permitted.
e. Setbacks, The base of the wind turbine tower shall be set back
from all property lines a distance equal to the hub height. Mind
energy systems shall not be installed in the front yard of any lot or
in the side yard of a corner lot adjacent to public right -of wary. All
wind energy systems shall be located at least three hundred Soo
feet from any residential zoning district.
f. Easements, Wind energy systems shall not encroach on public
drainage, utility roadway or trail easements.
g. Noise. Wind energy systems shall comply with Minnesota Pollution
Control Agency standards outlined in Minnesota Rules chapter
7030 at all property lines.
h. screening. Wind energy systems are exempt from the
requirements of section 401,15.E of this Ordinance.
i. Aesthetics, All portions of the wind energy system shall be a non -
reflective, non - obtrusive color, subject to the approval of the city
Administrator. only monopole towers are permitted, The
appearance of the turbine, tower and any other related components
shall be maintained throughout the life of the wind energy system
pursuant to industry standards, systems shall not be used for
displaying any advertising. systems shall not be illuminated.
j. Feeder lines. The electrical collection system shall be placed
underground within the interior of each parcel. The collection
system may be placed overhead near substations or points of
interconnection to the electric grid,
k. Deviations. Any deviation from the required standards of this
Ordinance may be permitted through a conditional use permit in
accordance with Section 401.17.D and 401.03 of this Ordinance.
3. Safety.

Association's W Snarl Wind Turbine Performance nce and
Safety Standard or other standards a s determined by the
City Administrator.

Underwriters Laboratories, Inc. and the National Renewable
Energy L aboratory, the Small Wind certification council or
other body as determined by the city Administrator. the city
reserves the right to deny a building permit for proposed
grind energy systems deemed to have inadequate
certification or testing for operation in a severe winter
climate.
3 Maintenance. hind energy systems shall be maintained
under an agreement or contract by the manufacturer or other
qualified entity.
b. Utility connection. All grid connected systems shall have an
agreement with the local utility prior to the issuance of a building
permit. A visible external disconnect rust be provided if required
b the utility.
4. Abandonment. If the grind energy system remains nonfunctional or
inoperative for a continuous period of one year, the system shall be
deemed to be abandoned and shall constitute a public nuisance. The
o wner shall remove the abandoned system at their expense after a
demolition permit has been obtained. Removal includes the entire
structure including foundations to below natural grade and transmission
equipment.

5. Gerrit. A building permit and conditional use permit, if required shall be
obtained for any w ind energy system prior to installation.
401.1 7.C. Ground Source Heat Pumps
Zoning District A llowances. Ground source heat pump systems in
accordance with the standards of this section are allowed as a permitted
accessory use in all zoning districts,
2. Standards.
a. System Requirements.
1 Only closed loop ground source heat pump systems utilizing
heat transfer fluids as defined in Section 401.17.C.4 of this
Ordinance are permitted. Open loop ground source heat
pump systems are not permitted,
2 Ground source heat pump systems in public waters may be
permitted as a conditional use in accordance with
Section 401.17.D and Section 401.03 of this Ordinance,
subject to approval from the Minnesota Department of
Natural Resources and subject to written consent of all
property owners and/or approval b an association in
accordance with its adopted bylaws.
3 Ground source heat pump systems in water bodies owned or
managed b y the city of Oak mark Heights are not permitted.
. Setbacks.
1) III components of ground source heat pump systems
including pumps, borings and loops shall be set back at least
five feet from interior side lot lines and at least ten (10)
feet from rear lot lines.
2 Above - ground equipment associated with ground source
heat pumps shall net be installed in the front yard of any rot
or the side yard of a corner lot adjacent to a public right -of-
way and shall meet all required setbacks for the applicable
zoning district.
C' Easements. Ground source heat pump systems shall not encroach

Laboratories, Inc. and meet the requirements of the state Building Code.
4. Abandonment. if the ground source heat pump system remains
nonfunctional or inoperative for a continuous period of one yeas }, the
system shall be deemed to be abandoned and shall constitute a public
nuisance. The owner shall remove the abandoned system at their
expense after a demolition pert it has been obtained in accordance with
the following:
a. The heat pump and any external mechanical equipment shall be
removed.
b. Pipes or coils below the land surface shall be filled with grout to
displace the heat transfer fluid. The heat transfer fluid shall be
captured and disposed of in accordance with applicable
regulations. The top of the pipe, coil or boring shall be uncovered
and grouted.
C. Lake ground source heat pump systems shall be completely
removed from the bottom of the body of grater.
5. Permits. A building permit and a conditional use permit if required
shall be obtained for any ground source heat pump system prior to
installation. Borings for vertical systems are subject to approval from the
Minnesota Department of Public Health.
401.17.D. Condl*lfional Use Permits. Application for a conditional use
permit under this sub - section shall be regulated by section 401.03 of this
Ordinance. such a conditional use permit may be granted provided that:
1.0
That the deviation is required to allover for the improved operation of the
alternative energy system;
2. That the alternative energy system has a net energy gain;
3. That the alternative energy system does net adversely affect solar access
to adjacent properties;
4 . That the alternative energy system complies with all other engineering
building, safety and fire regulations;
5. That the alternative energy system is found to not have any adverse
impacts on the area, including the health safety and general welfare of
occupants of neighboring properties and users of public rights - of - way; and
6 . The provisions of Section 0.03.A. of this Ordinance shall be
considered and a determination ode that the proposed activity is in
c ompliance with such criteria.
