The meeting was called to order at 7:22 p.m. by Mayor I.3eaudet. Present:
CCouncilmembers Abrahamson, McComber, Runk, and Swenson. Staff present:
City Administrator Johnson, City Attorney Vierling, City Planner Richards, and
City Engineer Long. Absent: None.

meeting of the Planning Commission was September 16 and they
discussed the L`nergy ] fficiency and Conservation Chant and held a public
hearing on the Conditional Use Permit that was on the City Council
Agenda for that evening. Richard reported that the next meeting was
scheduled for October 14 with a continued discussion on the Energy
Iff iciency and Conservation Grant.
13. Parks Co COL1nCilmember McComber reported that the last
niceiing of the Parks Commission was held on Monday, September 20 and
there was a discussion on the parks walltthrough. She reported that the
commission set a worksession in November to discuss project priorities.
MKI.omber reported that the next meeting was set for October 18.
C. Water Manwument Ommni. ation /Middle_St.._Croix_ Mayor 13eaudet
reported that the next meeting of the Middle St. Croix Watershed
Management Organization was scheduled for October 14 at 7:00 p.m. at
the Washington Conservation District Office,
D. Other Liaison /Staff Reports: Councilmember McComber reported
that she and Police Chief DeRosier attended a proclamation ceremony for
the Beyond the Yellow Ribbon Communities designation.
Administrative; Secretary Pinski provided a load report for Fall Clcan -up
which was held on September 25.

stafl'to work out remaining issues on the project. Carried 5 -0.
VII. New Business:
A. Assessment Services Contract with Washington County: Councilmember
McComber, seconded by Councilmember Runk, moved to set a
worksession for October 26 with Kevin Corbid of Washington County.
Carried 5 -0. Councilmernber McComber questioned whether a half hour
would be enough time to allow for the worksession. City Administrator
Johnson confirmed that it would.
13. Request For Conditional Use Permit for A Detached Garage — 15087 64
Street North: City Planner Richards reported that the request was for three

Conditional Use Permits. I-Ie reviewed his planning report. Richards
reported that Conditions were included in the Resolution that the
homeowners were required to remove the existing parking pad and that the
drainage plans be approved by the City Engineer.
Councihneiriber Runk, seconded by Courlcllmember McComber, moved
to approve the Resolution. Roll call vote taken. Carried 5 -0.
C. Consider Resolution for Continuing Participation in the Metrot)olitan
Livable Communities Act: City Planner Richards reviewed his planning;
report. I-le reported that his recommendation was that the City hold off on
participating. He stated there may be grant funds available in the future to
do a housing plan. Ile stated there was no penalty to participate at a later
date.
Councihuember Abrahamson, seconded by Councilmember Runic, moved
to accept staff`s recommendation and to direct the City Administrator to
send a letter to MF'T Council informing them that the City opts not to
participate at this time. Carried 5 -0.

requested that the City purchase two signs noting that it was a Yellow
Ribbon Community.

moved to authorize staff to purchase signs deemed necessary not to exceed

Millennium Projects, LLC d/b/a Oaks Wine & Spirits has applied for a new off-sale
liquor license for a business located at 5905 Neal Avenue North effective November 1,
2010.
All applications have been investigated by the City Attorney and the Police Department
and found to be in compliance with the City ordinance requirements f�or liquor license
issuance. The investigation fee has been paid, and the license fee will be billed. The
previous owner will be refunded the prorated an OfthC license fee already paid for
2010.
City staff recornmends approval of the off-sale liquor license for Millennium Pi
LJX d/b/a Oaks Wine & Spirits contingent on approval from the Minnesota Department
of Public Safety, Alcohol and Gambling Enl'orcement Division.

THIS AGREJ."MEN`I' is made this 13 th day of October, 2010 Between the CI'T'Y
OI OAK IIARK III;IGII'I S, Washington ounty, Minnesota ( "City "), and
Presbyterian 1lomes and Services, a Mi non- profit corporation ( "PI-IS ").
RECITALS
1, 5 -K Itun Rain. The Cit y y hereb authorizes PI -IS organize and conduct a 5 -K
Fun Run to be known as the Presbyterian Homes Foundation "lsunD Raul" in
order to gather residents, friends and family members of PITS, encourage
physical activity and raise funds for Mission Benevolence. The 5 -K Run will be
set up on October 16, 2010 and take place on October 16, 2010.
?, :I'lie I'vents. "there will be a 5 -K Run /Walk and a one (1) mile walk.

No route deviations shall occur in the City without the prior approval of the.
Chief of Police.
Starting and Finish Line. The 5 -K Run will start and finish in the
Boutwell's I..,arndirng main parking lot located at 5600 Norwich Parkway.
1..,imitations. Ill IS agrees that the number of Race participants for all races
will be limited to a total of 250 participants.
PI-IS seeks a waiver of the City's impact fee irony the City Council
due to the nature of this event. 7Thc event itself is a fundraiser for 1'I IS, a
non -profit organization. All proceeds (pledges and $5 entry fees) go to [lie
PI-IS I"oundation to Be used specifically for Mission Benevolence. Mission
Benevolence helps support residents and families across PHIS who have
outlined their resources anti need financial assistance.
4. ?a in) Con trol. The purpose of the Parkirng conditions is to ensure that
businesses and motorists retain parking availability for their customers during
the 5 -K Race. To further this purpose,

(a) PI -IS will provide ALL NE CE parking on the
grounds of Boutwell's Landing or other parking a reas owned
by PI-IS.
5. Traffic Control Points. The intersections of all streets, roads and paths oil the
Race Course (Course) within the City of Oak Park Heights will be controlled by
trained volunteers as approved by the Police Chief. Volunteers will be
equipped with proper NSTB compliant safety vests and cell phones to be
provided by PHS. PMTS staff will confirm all approved 'FC.'Ps have assigned
volunteers on the day of the race and prior to the event, PI IS will confirm with
the Police Chief what firm provided the training necessary for such volunteers.
MIS will also have available on race day alternate volunteers available to back
f €I1 in the event of no shows by those previously assigned. In the event PtIS
does not provide the needed volunteer's the race SHALL not be permitted to
I1111 through the City. 'Traffic SHALL be allowed to cross the course at every
intersection, runner traffic permitting.
Residences with ]ionic on the course shall receive a direct mailing from PI IS,
not later than October 9, 2010, informing them of specific 16ce timelines and
Will be given a direct "]lot line" number to reach on Race- day, such IIOTLINF,
ntuliber will be staffed at ALL TIMES, including prior to, during and through
6:OOpm on the day of the event.
If applicable and as determined by the Chief of Police, by October 4, 2010, a
Road Closure Plan shall be submitted by PIIS to the Chief of Police for review
and approval. This Road Closure Plan, once in acceptable form shall be shall be
attached Mere to as "FAIlibit C ".
In the event there are any street closures, PI IS shall only perfornn such closure
with materials provided by P1 -IS or their contacts, including high- visibility
barricades and /or cones and placed so as to not allow vehicular traffic to
circumvent the barricades without leaving the roadway or being allowed
through by a traffic control person.
6. Garb-,we and Rubbish Removal. All garbage and refuse generated by the 5 -K
Run, including that left by spectators, will be removed properly and disposed of
by sundown on the day of the Race. PHS will be responsible to reimburse the
City for any subsequent cleaning determined to be necessary by the City as a
result of the Race.
7. Portable Toilets. NOT APPLICABLE.

8. Water Stops and Hirst Aid Stations. Water and first aid stations will be
established at the start /finish, and one other location on the route in keeping
with National Race Standards for 5 -K Races. A First Aid Station shall be in the
parking lot located at 5600 Norwich Parkway and if aid is necessary on the
course, staff drive a car to the individual in need and consistent with regular on-
street parking requirements of the City. All Run participants and aid workers
must park in the designated locations at I3outwells Landing,
c} l r))er� flan. The Race L.mergency flan will be designee{ and completed
by PHS with the assistance of health experts. P]-IS will actively seek input fron)
the City Police and Lakeview Hospital IJmergency Services. The Emergency
Plan must be approved by the Chief of Police For the City and will then be
affixed hereto as "Exhibit D ".
10. Food, Uguor a }dad Vending. PHS will not provide commercial food, liquor or
vending, nor will they license others to provide these services to race
participants in the City. This provision does not prevent MIS from providing
food and nonalcoholic Beverages to Race participants only and shall be
consistent with the intent of this Agreement.
11. Insurance, Hold Harmless, and Indemnity. PII,S agrees to indemnify and hold
harmless the City with regard to any claims, causes of action or demands that
alight be Drought against the City arising out of the events authorized by this
Agreement; and further, PI-IS agrees to provide to the City evidence of
insurance coverage of at least `1,500,000 of combined single limits covering
claims that might be brought against then) that arise out of the events authorized
by this Agreement and to name the City as an additional insured on their policy
"as their interest may appeal "This proof of insurance shall be provided to the
City Administrator not later than October 8, 2010.
12. Public Information, PHS shall make extensive, deliberate, affirmative and
documented efforts to notify property owners and businesses along the
Racecourse of any restrictions that night be placed upon their movements
during the Race. Leaflets providing this information must be delivered to each
such owner by mail one week before the race.
13. Community Participation. The City shall work in good faith with PIJS to
encourage community participation in Race preparation) and Race conduct.

14. Police Power, Angie Swetland of PITS shall maintain and monitor his /her
personal cell phone at all times on the day of the race, and such phone ]lumber
(612- 968 -1339) shall be provided to the City Police Department.
15. Use of Citv Parks, PITS may separately request in writing the use of various

City Parlcs during set up, execution of the Race, and tear -down. The City shall
endeavor to facilitate such use subject to prior reservations of record and that
PITS agrees in all situations to allow continued casual public use of the Parks
during this period. PI -IS use of City Parks may not displace the general
enjoyment of City Parks by the public.
16. Cittr Costs. I'llS must reimburse the City for all costs incurred by the City to
allow such Race, including but not limited to City Police Department, Public
Works Department, and Fire Department and as needed to safely conduct and
maintain the 5 -K Run and supporting events as agreed herein. A refundable
cash deposit of `1,000.00 must be made to the City by 1 -IS no later than
October 8, 2010, 'flus amount shall serve as a security to the City and shall be
reimbursed to PITS at s€.€ch time P] ]S pays to the C:'ity all costs incurred by the

17. Namin Ri 3ig Its Rights to the name "5 -K Race" and lily logo or brand
developed for the Race will remain the property of 1 Registration of tile
name or logo as a trade name or trademark is reserved in PI IS,
18.' The term of this Agreement is for six- months unless terminated earlier
by the City.
19. Failure on the part of 1 -IS to comply with specific provisions of this
Agreement, including the providing of the preparatory documents and actions
may result in the City implementing monetary penalties in the amount of
$200.00 for each violation and /or the City's revocation of PI-IS's permission to
hold this race within the City. The City will provide written notice to PI-1S for
each violation and will mill PITS for such violation. "The City may also conclude,
through the decision of the Chief of Police that 1 has not provided the
required documentation and in the required timelines and the City may then
revolve the permission to hold the race within the City limits, as determined by
the Chief of Police. It remains PIIS's responsibility to provide the required
documents in a fashion wholly consistent with the dates stated in this
Agreement.

'] "his letter is to inform you that we have an upcoming 5K Fun Run that will come by your
home the moniing of October 16, 2010. The event begins at gam and we anticipate
approximately 50 runners and /or walkers to be out on the course between 9 -1 Dam. ']'his
event is not a competitive racy, but a fundraiser for Presbyterian Homes Foundation with
proceeds going; to our Mission Benevolence fund. The Mission Benevolence fund is used
to Delp support residents NN111e11 they outlive their resources.
The course as outlined below will be supported by volunteers at over) traffic control point
to assure runners /walkers stay on course. Due to the relatively small number of
participants expected we don't Feel it's necessary to sign the course or requiring; vehicles to
be moved from the roadside. Should you encounter any problems during the event, please
contact the Boutwells I.,anding Reception Desk at 651 -275- 5000. Thank you for sharing;
your beautiful neighborhood for this special event.

Road Closure flan
We respectfully request the ability to sign Norwich Parkway closed at the intersection of
Norwich Parkway and 58` Street and at the intersection of Nolan Avenue North and
Norwich Parkway. As this roadway is primarily traveled by residents and visitors of
Boutwells Landing we believe that this road closure will not adversely affect the traffic
pattern on 58 Street.
This plan would also continue to allow residents of Boutwells Landing Village Homes and
Brownstones to access their homes via Nolan Avenue North.
`I assure emergency vehicle access, staiTpersons will be stationed at these control points
to prove barricades as necessary.

The E Play
The PFIS Fund Run Committee lead by Angie Swetland will Monitor severe weather in the
area via television radar and weather radio alerts. If weather is suspicious, a determination
will be made one half-hour prior to the race start time if weather warrants the delay or
cancellation of the run /walk. The television and weather radio are located at the front desk
of the 5600 Norwich Parkway building. The shelter area for participants and volunteers is
also located at 5600 Norwich Parkway. 11' severe weather comes up unexpectedly during
the run /walk, the traffic point volunteers will be alerted via cell phone and told to instruct
all participants to return to the plain building.
First Aid supplies will be available at the Start and Finish. The first aid tent will be
attended to be a Pl IS staff person who will have cell phone communication with the traffic
point volunteers out on the course. Should first aid supplies be needed out on the course, a
PI IS staff person will respond and access that person via bicycle or car obeying traffic laws
111 the process.
Should emergency personnel he needed on the course, traffic control point volunteers will
have cell phone communication and inform 1'1 IS staff of the need who will in turn call 911.
The road closure points will be attended by a Ill IS staff person who will move barricades
to allow for emergency vehicle access on Norwich Parkway.
