HomeMy WebLinkAbout2008 CJDN NCIC Agreement with OPH and WCSO Abreement between the Oak Park Heights Police Department 14168 Oak Park Boulevard Oak Park Heights, MN 55082 and the Washington County Sheriffs Office 1501562 nd Street North Stillwater, MN 55082 relating to National Crime Information Center Telecommunications WHEREAS, the Oak Park Heights Police Department has access to certain Criminal Justice Data Network (CJDN) data bases including "Wanted Person", "Missing Persons ", and "Stolen Property" records and; WHEREAS, it is in the public interest for the Washington County Sheriff's Office to perform certain categories of CJDN telecommunication messages for the Oak Park Heights Police Department, and; WHEREAS, it is required by the National Crime Information Center (NCIC) rules and regulations to enter into the following Agreement setting forth the rights and responsibilities assumed by the parties in this agreement relating to the telecommunications of CJDN data, THEREFORE, in consideration of the mutual covenants contained herein, the parties herein agree as follows: 1. All CJDN communications on behalf of the Oak Park Heights Police Department between 1630hrs — 0800hrs Monday through Friday and all day Saturday and Sunday, shall be relayed through the Washington County Sheriffs Office dispatch center terminals within a reasonable amount of time after requests are received from the Oak Park Heights Police Department. 2. All NCIC communications entered into the CJDN by the Washington County Sheriffs Office on behalf of the Oak Park Heights Police Department shall use the Oak Park Heights Police Department's ORI and note the Washington County Sheriffs Office as the after hours point of contact agency in the miscellaneous field of the entry. 3. The Oak Park Heights Police Department remains responsible for accuracy of the law enforcement data provided to the Washington County Sheriffs Office and remains responsible for notifying the Washington County Sheriffs Office in a timely manner of any modifications or cancellations of those messages which it has introduced into the CJDN through the Washington County Sheriffs Office. 4. The Washington County Sheriffs Office agrees to modify or cancel the messages described in this Agreement pursuant to the authority of the Oak Park Heights Police Department within a reasonable time after receipt of request from the Oak Park Heights Police Department. 5. The Oak Park Heights Police Department agrees to maintain all original law enforcement records as required by NCIC regulations, and applicable data practices, statues, rules, and regulations. The Oak Park Heights Police Department will remain responsible for completing all CJDN validation reports. 6. Washington County Sheriffs Office liability will be limited to the timely and accurate transmission of the Oak Park Heights Police Department's messages, records, and data described in this Agreement. 7. The Washington County Sheriffs Office agrees to respond within ten (10) minutes to all hit confirmation requests marked "urgent" and one hour on all requests marked "routine ". Washington County Sheriffs Office's response shall indicate a positive or negative confirmation, or a notice of the estimated amount of time necessary to confirm or reject the record confirmation. 8. The entire Agreement of the parties is contained herein and this Agreement supersedes all other oral or written Agreements and negotiations had between the parties relating to the subject matter hereof. 9. Any alterations, amendments, deletions, or waivers of the provisions of this Agreement shall be valid only when reduced to writing and duly signed by the parties herein. 10. The term of the Agreement is from the date of the last signature hereto and shall continue until terminated as provided herein. 11. This Agreement may be terminated by either party at any time with or without cause, upon sixty (60) days written notice delivered to the address of the parties specified above. 12. This Agreement will automatically be terminated sixty (60) days from the date that the Oak Park Heights Police Department becomes a "24 -7" terminal agency having direct access to the CJDN. At the earliest practicable date, the Oak Park Heights Police Department will notify the Washington County Sheriffs Office in writing delivered to the Washington County Sheriffs Office, that the Oak Park Heights Police Department will or has become a "24 -7" terminal agency.
