Swager Brothers 9th Addition - Pond Overflow

Dear Ms. Wilson:
In May of 1989 the Halls requested that the city evaluate and remedy the prob-
lem of water overflow from the Swager 9th Addition pond onto the southeast
portion of the property owned by Dr. Hall. After inspecting the site we came
up with several alternatives to remove the water from the Hall's property. 'le
are only presenting these alternatives and not making any recommendations,
because the city's budget for this issue is not known.
The first alternative involves ditching or piping water from the overflow area
to the south, across state owned land which is managed by the Department of
Natural Resources (DNR). This alternative would lower the high water level
and solve the problem with minimal cost. We contacted the DNR in October and
supplied them with the proposal and information necessary. They were not very
responsive or interested in helping the city with this problem. We pursued
this alternative further and scheduled a meeting with the DNR on Friday,
January 26, 1990, at the job site. The DNR was more responsive this time but

issue for them was the reduction of existing wetlands. They even hinted that
whatever reductions were made would have to be replaced at the city's expense.
The second alternative would involve filling the portion of the Hall's yard
with off -site material. We estimate it would take eight hundred and thirty
cubic yards to fill the natural depression within the lot lines of the Hall's
property. The cost of this alternative would be approximately five thousand
dollars, assuming six dollars per cubic yard for the material.
The last alternative involves doing nothing. There is a case for this, be-
cause the Hall's property has remained unchanged from the time prior to the
construction of the Swager 9th Addition. The only difference is that the pond
created in 1987, as part of the Swager 9th Addition, reduced the size of the

overflow area. Further surveying showed that the natural overflow for this
area is at the same elevation as the foundation for the shed on the south side
of their house. The basement of the house is 1.2 feet above this critical
elevation and would not be in danger of flooding.
Based on the alternatives listed above, the city should have enough informa-
tion to make a decision on this matter. If you have any further questions, we
