RE: WETLAND DRAINAGE PROBLEM, HALL PROPERTY, WASHINGTON COUNTY
Dear Ms. O'Neal:
Thank you for organizing the on -site meeting on 9 -11 -92 with the property
owner, Joe Anderlik (Bonestroo, Rosene, Anderlik & Assoc.) and me. We
discussed the possibility of outletting a stormwater holding pond into
DNR protected wetland 82 -310 (Prison Pond). Currently, the pond has no
outlet and is negatively impacting the adjacent Hall property.
In searching the files, I only found correspondence between 1979 and 1981
relating to the construction of Swager Pond #1. Mr. Anderlik has agreed
to examine his files to provide more recent information.
It is likely that a DNR permit would be required if an outlet structure
is proposed to be placed below the ordinary high water elevation (OHW) of
wetland 82 -310. If a swale is cut to drain the pond to basin 310, a
permit would only be required if there is actual grading performed below
the OHW. Approval would have to be secured either by lease or easement
from the DNR Section of Wildlife before any type of work is performed
within the DNR Wildlife Management Area (old prison property). Tim
Wallace, Area Wildlife Manager should be contacted early into the process
to determine feasibility of the project.
