Again, the request is to determine if it is possible to lower the water level in the ponding area by ditching or piping across land owned by the State of Minnesota to prevent further flooding and damage to the Hall property. Further, Mayor O'Neal noted that minutes and agendas of both of those organizations are on file in the City offices. Mayor O'Neal requested further consideration by the public of volunteering to be the Oak Park representative on the various water management organizations and water shed districts, however, if no volunteers will be forthcoming an appointment will be made by her at the next council meeting. Motion was made by Seggelke and seconded by Carufel to authorize the execution of contracts with regards to the Blackwood Storm Sewer Construction Project. 5 aye votes. Carried. O'Neal noted that the City had received a correspondence from the Metropolitan Waste Control Commission indicating that the City's monthly installment per their records would be re- established at the rate of $17,257.00, up from $13,000.00 per month as was the previous rate. After review by the City Auditor and contact with his office to the Metropolitan Waste Control Commission the figure has now been revised to $15,256.00 per month, as they were not aware that the high school facility would not be in 12 month continuous use, but rather would be used only 9 months out of the year on a full -time basis. The City noted the need to appoint a Civil Defense Director and the public was requested to inquire if there was anyone with any interest at the City Hall. The Mayor noted that she had a meeting with Drs. Hall and the Department of Natural Resources Representative, Molly Shodeen and Joe Anderlik at the Hall residence with regard to the drainage issue which the Halls raised as it affected the pond next to their property. She noted that the DNR would be sending a letter proposing a solution to the issue which should be forwarded from the Department of Natural Resources offices in the near future. Mayor O'Neal noted that the public hearing previously scheduled on the application of Heritage for subdivision for September 28, 1992 had been cancelled. The Mayor noted that she had had a meeting with Mr. Keifer and Mr. Ruvelson, City Attorney Mark Vierling, and Joe Anderlik at the Keifer /Ruvelson property regarding drainage issues. Motion was made by Seggelke, seconded by Doerr, authorizing the City Engineer to meet with Mr. Keifer /Ruvelson's representative, Mr. Folz, to discuss the drainage issues. Our property at 14201 53rd St. N., is directly to the east of the holding pond on 53rd and O'Brien. This pond does not seem to fill up to it capacity, instead it runs off into a back up pond on the DNR land and has expanded onto our property. Flooding occurs with each rain of an inch or more. The water table has risen resulting in the destruction of 9 Norway pines approximately 20 -25 years old and a 50+ year old oak tree. It has also resulted in flooding of our vegetable garden. We be- lieve that this may result in a health hazard to our family. Previous action taken by the council on this has not resolved the problem. Something different need to be done. Seggelke, seconded by Carufel, moved to adopt Resolution #92 -08- 35 requesting the development of a cooperative construction between the City of Oak Park Heights and Minnesota Department of Transportation for improvements at Trunk Highway 36 /Norell Avenue Intersection. Roll call vote taken with 5 aye votes cast. Resolution adopted. Drs. Dan and Lois Hall discussed flooding problems on their property. Seggelke, seconded by Kern, moved to direct staff and engineer to work on a resolution to the Hall family ponding problem. 5 aye votes. Carried. Park Commission will meet Monday, September 21st at 6:30 p.m. at City Hall. Seggelke, seconded by Doerr, moved to hire Chris La Motte as new park attendant to complete the summer season. 5 aye votes. Carried. Doerr, seconded by Kern, moved to direct Deputy Chief Lindy Swanson to pursue the purchase of two squad cars on the state bid. 5 aye votes. Carried. Seggelke, seconded by Carufel, moved adopt Resolution #92 -08 -36 approving the transfer of $4,400.00 for tree pruning as follows: $2,250.00 from Municipal Building Utilities to Tree and Weed Removal Other Contractual Services and $2,150.00 from Fire Protection Other Contractual Services to Tree and Weed Removal Other Contractual Services. Roll call vote taken with 5 aye votes cast. Resolution adopted. Carufel, seconded by Kern, moved to authorize Ken Kaiser, Tree Inspector, to enter into a contract for tree trimming with Abrahamson Nurseries in the amount of $4,400.00. Dear Mr. Lines: I am writing to find out the status of our proposal to drain the existing ponded water from the south end of Swager Brothers 9th Addition across state -owned land managed by the DNR. Since our first telephone conversation, October 18, 1989, we have agreed that the discharge from the pond was ponding in the natural depression to the south, on state -owned land. It was agreed that this problem should have been addressed at the time of construction, but that this is not the issue at hand. Regardless, the problem of removing the ponded water still needs to be solved at the request of the City of Oak Park Heights, due to complaints from an adjacent resident. On October 27, 1989 I called you again to see how we could solve this problem. You informed me that you would bring the issue up with your supervisor the following week, when he returned, and then return my call. Please understand our need to attend to this matter because the 1990 spring thaw vill only escalate the problem. Please inform me as to your decisions at your earliest convenience. As I mentioned to Kevin Lines, the only alternative is to drain the water to the south, across state owned land, which is managed by the DNR. Kevin told me that after discussions with you, it was decided that the DNR was not interested in becoming involved. Due to our lack of alternatives, we are requesting a meeting with you at the project site at your earliest convenience. Our inspector, Chuck Erickson, and I would like to meet you on the site so that any questions can be addressed at that time and a solution can be reached as soon as possible.
