Dear LaVonne:
This letter is being submitted to record the recent activity relating to our attempt to work with the
Minnesota Department of Natural Resources to provide an outlet route for the storm water pond
south of 53rd Street in the Swager Ninth Addition.
We had, for some time, been working with Molly Schodeen and submitted a proposal with the
necessary surveys and engineering drawings to lower the water level in this pond which adversely
affects the Hall Property. After review, Ms. Schodeen determined that the proposal did not involve
DNR protected wetlands and so the matter was referred to Mr. Tim Wallace, Area Wildlife
Supervisor who apparently manages the DNR property immediately south of the City.
Recently we have contacted Mr. Wallace to reactivate the review and approval process. Initially he
did not want to be involved in resolving what was perceived as someone else's problem. After some
discussion, the plans were reviewed, but because of his work schedule, he was not able to view the
site until July 26th. After that inspection, he advised that there may be a way of lowering the water
level if some intermediate storage is provided along the drainageway. It was further agreed that we
would meet on the site at 10:30 a.m. on Monday, August 2nd, so that we could identify specifically
what may be allowed.
After our discussion of July 26th, Mr. Wallace also submitted a letter, which is attached. This letter
contains some unfounded conclusions relating to the hydrology of the area and the plat and ponding
design. While he is willing to meet, the letter does not contain a lot of concern or optimism. We
will advise you on the results of our meeting in the field.
