Revised plans and additional information has been submitted by the applicant. The following information has been submitted: Revised Site/Landscape Plan. 2. Revised Warehouse Elevations. 3. Revised Gate Canopy Elevations. 4. Revised Photometric Plan. 5. Cut Sheets for Existing Exterior Lighting. Additionally, the applicant has been asked to provide a letter explaining the reasons why the lumber yard entrance must be moved from its current location to the east side of the property. The applicant's representative has explained to City staff and the Planning Commission why moving the entrance is necessary and what the hardship would be if the City required it to remain in its current location. The letter will assist the City Council in understanding Menards position on this issue. The following revisions have been made to the plans based upon Planning Commission and City Council recommendations: I . The applicant has provided new lighting plans that include all existing and new outdoor lighting in the photometric plan. Cut sheets have also been provided showing the existing and proposed lighting. Alt of the new lighting and the photometrics for the areas that will receive that lighting are compliant with the lighting regulations. The only site lighting that is non - conforming is the existing parking lot pole lights. The fixtures are not full cut off and the lighting slightly exceeds the new allowances of 0.4 foot candles at the property lines. The Zoning Ordinance, in Section 401.15.B.7.c, makes allowances for non- conforming lighting installed before 1997. The City Council has the option to leave the arkin lot lighting as it exists or require the applicant to change the p 9 0 9 fixtures to be compliant as part of the conditional use permit conditions. 2. The parking on the east property line has been removed. A 10 foot landscaped area is now shown on the site plan. With this plan, a variance of the driveway /parking lot setback is no longer needed. 3. The fence structure directly adjacent to the south edge of the pond has been moved away from the pond's high water mark. The City Engineer has indicated that he will need to review detailed foundation and grading plans for the fence. 4. The plans indicate the general areas that will be utilized for garden center ground stacking. This is in the area of the existing lumber yard entrance. 5. The elevations have been revised to indicate a vertical wooden fence on the east side of the new lumber yard entrance canopy. This replaces the chain fink fence that was represented before. 6. The elevations have been revised to indicate vertical siding on the west side of the new warehouse building instead of horizontal siding. The Planning Commission had requested this so that the look of the building will blend with the appearance of the fence structure. 7. The City Council has also discussed the need for street lighting in this area. This issue will be addressed as a separate issue that will involve an accessed street lighting project for both Menards and Kohls. City staff has had discussions with Menards representatives and the property owner, Bob Brackey, related to the access issues for the property that will remain after the Menards expansion is complete. Mr. Brackey has contacted the current property owners of Oak Park Ponds but has received no response as to a possible westerly access. Shelly Johnson, the City's Traffic Engineer, has indicated that if the remaining property is developed as commercial retail, a connection to the retail development to the west is highly advantageous. This issue should be resolved, as required by the development agreement for Americlnn, before allowing Menards to proceed with their project. It is recommended that the City Council hold on any Menards approvals until the traffic issues are resolved. The application for this project was received on August 21, 2003. A letter was sent to Menards on August 26, 2003 from our office extending the review 2 period to 120 days.
