If we make them stop now we have a lar hole in the g round and a lar pile of dirt that will cause sediment problems for their nei I su that we provide them with a permit for foundations and basement walls to the point that the can backfill to the basement wall. This will drasticall reduce the size of the hole in the g round and the size of the pile of dirt on site. Dennis had clearl stated that he recommended that we not issue a permit until the MNDOT permit was in hand (MNDOT has the permit under review) and that the chan the curb on their south propert line to a valle g utter and show how the water will g o from the valle g utter to the MNDOT ditch, and the commit to makin chan to the Ea club pavement to assure that the new valle g utter match the pavement. The plans received 6/5103 show a valle curb but then in the middle it transitions back to a barrier curb in the drive aisle between the Ea and this project. This transition will make a 6 inch tall lon speed bump. this transition is to accommodate the storm water inlet. This inlet needs to be chan to a concave g utter inlet so the curb can sta as a valle g utter. The have not shown how the water will g et from the valle g utter into the ditch. It appears that the water will flow out into the fronta road and down the road to the next MNDOT storm water inlet. I do not think this is ade With their updated drawin the provide flow calculations. These calculations were onl for the water on their site. The water from Ea and from McCormick's both currentl flow onto the Montanari site and down the propert line to the MNDOT ditch. Should the storm flows and desi include all area currentl tributar to the site. The construction proposed will block the water from McCormick's but it will still move into the MNDOT ditch east of the current entrance or j ust pond up in the McCormick entrance and out to the MNDOT ri of wa The Ea flow that currentl moves alon the propert line will now flow in the valle curb. MNDOT will take three weeks or more to review the permit. If the re better flow data that will increase the time. The have not even talked to Browns Creek. ( I do not know the histor of Mantanarl and Browns Creek but I think Montanari has developed in the water shed before. If we issue a permit rather than a stop work order the permit needs to clearl state: This permit is for installin erosion control measures, excavation of the buildin area, foundations, basement walls and backfillin to the basement walls ONLY. Erosion control will be installed around the stock pile in such a manner acceptable to the Cit En Public Works Director, IVINDOT, and Browns Creek Watershed District. The erosion control will prevent (as far as is technicall feasible) the movement of sediment from the stockpile or an other disturbed area into adjacent propert or into the MNDOT storm water ditch. NO Plumbin NO Storm Sewers, No Sanitar Sewer, NO Water, NO work in the MNDOT Ri of Wa NO structural work other than the foundation and basement walls can be performed under this permit. All work under this permit is at the risk of the permittee. It is the responsibilit of the permittee to obtain permits from all g overnmental a havin jurisdiction of over the project. The Cit of Oak Park Hei is has informed the permittee and/or his en that the need permits from IVINDOT to chan the storm water flow into the IVINDOT storm water s to excavate within the IVINDOT ri of wa to connect to Cit sewer and water, and IVINDOT access permit for chan the access points on the propert This lot is part of Browns Creek Watershed District and re a permit from the District. If any governmental agency having jurisdiction over this project request the City to "STOP WORK " on this project the City may honor that request. If anyone else has any ideas we need to act on this site as fast as possible. Jay
