Permitted uses set forth in Ordinance 401 Section 401.300
I. CONDITIONAL USE PERMIT FOR:
Applicants have applied for an amendment to the CUP/PUD to permit building site changes to reduce the
proposed size of building #2 of this phased project. Modifications have been allowed to allow a slightly
smaller building as displayed in the attached site plan.
All uses shall be subject to the following conditions and/or restrictions imposed by the City Council of the
City of Oak Park Heights.
II. ADDITIONAL RESTRICTIONS AND PROVISIONS:
The following additional restrictions and provisions being part of the Third Amended Conditional Use and
the Planned Unit Development Permit to be issued herein shall include the following matters:
Pursuant to the Second Amendment the following was approved:
1. The site plan has been revised to allow for a 572 square foot addition to building #2 to allow for
trash storage.
2. The parking lot site plan has been revised to eliminate eight parking stalls within the center
parking island.
3. The grading, drainage and utility plans are subject to review and approval of the City Engineer.
4. The lighting plans should be revised to comply with the lighting standards of the Zoning
Ordinance or the fixtures are removed from the northeast side of building #2.
5. The landscape plan is subject to review and approval of the City Arborist.
6. The building department of the city will monitor parking allotment/allocations between
warehouse and office space utilized on the site. Any combination of uses on the premises that
exceeds parking requirements as outlined in the city ordinances shall require the owners to apply
for and obtain a variance prior to implementing such use or uses on the site.
Pursuant to the Third Amendment the following was approved:
1. Buildings #1 and #2 shall be permitted a total of 17,604 square feet of floor area for office use in
combination with a total of 7,200 square feet of floor area of warehouse space based upon a total
parking capacity of 99 stalls on site.
2. Grading, Drainage and Utility plans are subject to the approval of the city engineer and
engineering comments contained within the Letter to Bonestroo, Rosene, Anderlik & Associates
dated February 11, 2003 as directed to Acting City Administrator, Judy Holst. (Exhibit B).
3. Landscaping plans shall be subject to the review and approval of the city Arborist.
