HomeMy WebLinkAbout2003-02-13 PC Recommending Resolution (unsigned) • A RECOMMENDING RESOLUTION OF THE PLANNING COMMISSION CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA L- A RESOLUTION ESTABLISHING FINDINGS OF FACT AND RECOMMENDING TO THE CITY COUNCIL THAT THE REQUEST BY DDD LLC FOR A CONDITIONAL USE PERMIT/PLANNED UNIT DEVELOPMENT AMENDMENT TO ALLOW FOR BUILDING AND SITE PLAN CHANGES FOR CONSTRUCTION OF BUILDING TWO AT MEMORIAL AVENUE NORTH AND 55 STREET NORTH SHOULD BE APPROVED WITH CONDITIONS WHEREAS, the City of Oak Park Heights has received a request from DDD LLC for a conditional use permit /planned unit development amendment to allow for building and site plan changes for construction of Building Two at Memorial Avenue North and 55 Street North; and after having conducted a public hearing relative thereto, the Planning Commission of Oak Park Heights makes the following findings of fact: 1. The real property affected by said application is legally described as follows, to wit: SEE ATTACHMENT A and 2. The applicant has submitted an application and supporting documentation to the Community Development Department consisting of the following items: SEE ATTACHMENT B and 3. The subject site is zoned B -3, Highway Business and Warehousing District, in which business warehousing activities and commercial and professional offices are permitted uses; and 4. The proposed site plan changes include increasing the number of parking spaces to a total of 99 and decreasing the size of Building Two to 7,604 square feet; and 5. The City staff prepared a memorandum dated February 6, 2003 reviewing the request; and 6. The memorandum dated February 6, 2003 recommended that the request be approved with conditions; and • • 7. The Planning Commission held a public hearing at their February 13 2003 meeting, took comments from the applicants and public, closed the public hearing, and made the following recommendation: NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION FOR THE CITY OF OAK PARK HEIGHTS THAT THE PLANNING COMMISSION RECOMMENDS THE FOLLOWING: A. The application submitted by DDD LLC for a conditional use permit /planned unit development amendment to allow for building and site plan changes for construction of Building Two at Memorial Avenue North and 55 Street North and affecting the real property as follows: SEE ATTACHMENT A Be and the same as hereby recommended to the City Council of the City of Oak Park Heights for approval subject to the following conditions: 1. The applicant should explore incorporating additional vertical features in the facade of Building 2. 2. The grading, drainage, and utility plans are subject to review and approval of the City Engineer. 3. The landscape plan is subject to review and approval of the City Arborist. 4. The site plan that includes parking up to the east property line and is labeled Exhibit 7 in the planning report is rejected.
