Oak Park Heights, MN 55082 Re: Stillwater Area High School Building Wall -pack & Student Parking Area Lighting Fixtures Dear Dr. Laager: Thank you for your prompt response to the City's request for full -cut off compliance as above - referenced. Stillwater Area Public Schools Facility and Site Operations Supervisor Tony Willger has provided notice of the parking area lights being scheduled for compliance correction and has also provided us with cut off sheets for the SAHS wall pack lighting fixtures. While the City does appreciate the information, the information provided does not document exemption from Outdoor lighting Ordinance 401.15.b.7 in that the Conditional Use Permit issued to ISD #834 and as agreed upon, for construction of the high school, on page 3 the CUP specifically specifies that "Design of all exterior lighting shall provide hooded or controlled lighting features." That is excerpted and attached hereto for your use. "Hooded or controlled lighting features" would be used to effectuate the full cut -off as required by Ordinance 401.15.b.7; and this type of wall -pack lighting fixtures should have been installed at the time the school was constructed. Regardless of the installation status, they are non - compliant and must be corrected as dictated by both the conditions of the original conditional use permit to the school and by Oak Park Heights Zoning Ordinance 401.15.b.7. The City certainly does appreciate your arranging to have the light pole lamps in the student parking area adjusted by December 15, 2010 and that this date may not be feasible for compliance to all 35 wall pack lighting fixtures. Dr. Ryan Laager —Stillwater Area High School December 2, 2010 Page 2 That being said, the City is willing to extend the compliance deadline for the wall -packs to March 15, 2011 in order to allow you time to facilitate a compliance plan, provide the same to me for approval, and to implement such plan. Building security lighting shall also be specifically identified by the Applicant and Site Plans and subject to approval by the City Engineer. The provisions of Chapter 400 5401.03 of the Code of Ordinance for Oat: Park Heights affecting glare shall be oomplied with. R. Parking Parking shall be initially constructed to that which is shown on Area Site Plans dated septelober 3 1991. Tha . City may require the Applicant to upgrade or add additional parking spaces so as to provide for additional growth or use of the facility to be constructed by the applicant as student populations increase. The ratio to be used to require additional spaces shall be one parking stall per 2.5 students. Actual usage of the school parking facilities and plans by Independent School District No. 834 to effect a limitation on car transportation /parking needs of the facility shall be • considered by the City of Oak Park Heights with regard to future review of parking facilities.
