PLANNING REPORT TO: Eric Johnson FROM: Scott Richards DATE: December 8, 2010 RE: oak Park Heights — Auto Zone --- 13513 50 Street North TPC FILE: 236.01 -- 1 0.05 BACKGROUND Jeff Kaurez has made application for site plan and Design Guidelines review for an AutoZone retail store at 13613 60 Street North. The proposed building is one story and approximately 7,400 square feet. The site is 1.33 acres and has not been previously developed. An application for an M &I bank had been approved on November 25, 2008, but M &I did not move forward with construction and allowed the approvals to expire. The property is zoned B -4 Limited Business District in which retail stores are a permitted use. The site has been previously platted as Lot 2, Block 1 Wal -Mart Addition. The AutoZone site will include a 35 stall parking lot with access from the private road created as part of the Wal -Mart development. AutoZone is a retail store for the sale of auto parts. There will be no repair of vehicles on site. ISSUES ANALYSIS Comprehensive Plan. The property is designated as Commercial on the Proposed Land Use Map. The AutoZone store will be consistent with this land use designation. Zoning. The property is zoned B -4 Limited Business District. Retail sales are a permitted use in that district. The District requires a 40 foot front yard setback, 10 foot side yard setback and 20 foot rear yard setback. The building meets or exceeds these requirements. The building height maximum in the B -4 District is 35 feet. At its highest point, the building will be 23 feet. Subdivision. The property has been platted as Lot 2, Block 1 of Wal -Mart Addition. The site has the proper easements recorded to allow access through the site to the Wal -Mart that is located directly to the south of the project site. All park dedication has been paid for this lot. Access. As indicated, the site will be accessed by the private road that connects 60 Street with the Wal -Mart parking lot. There are two access driveways that will allow for adequate customer and delivery access. Parking. Section 401.15.F.9 of the Zoning ordinance requires one off street parking stall for each 200 square feet of retail space. The parking calculation for this site is as follows: 7,400 sq ft x .9 = 6,660 1 200 = 33 parking stalls 2 The site plan indicates that there are 35 parking stalls planned for the development, two of which are disability accessible. One of the disability stalls is van accessible. The layout as designed will meet the required number of parking stalls and disability accessible stalls. The parking stalls are 9 feet x 20 feet with 24 foot driveway aisles in compliance with the Zoning Ordinance. The parking area will be completely surrounded by curb and gutter. All of the parking areas are placed at least 10 feet from the property lines. There will be landscaped islands within the parking areas. Delivery Entrance /Trash Enclosure Location. A delivery entrance has been added on the south side of the building. The access driveway and site has been designed to accommodate deliveries at this location. The trash /recycling area will be located near the delivery entrance and will be provided an enclosure with a gate. The area will be enclosed with a wood fence. The Design Guidelines state that the trash enclosure should be constructed of materials similar to the building. The trash enclosure should be constructed of masonry to match the AutoZone building. GradinglDrainage /Utilities. Grading, drainage and utility plans have been provided by the applicant. The City Engineer has provided a separate report on engineering issues. The main concern is the drainage on the west property line and potential impact to Jerry's Auto Detail. The City Engineer has recommended that the grading in this area be redesigned. The grading, drainage and utility plans shall be subject to review and approval of the City Engineer. Lighting Plans. Fixtures. The lighting plan indicated a shoe box style, full cut off light fixture mounted on a pole and base with a total height of 25 feet in compliance with the lighting requirements. All of the parking lot fixtures are adequately setback from property lines. The plans indicate the locations of full cut off wall mounted fixtures. The fixtures must be mounted such that the shield is at 90 degrees to the building and no lenses are exposed below the shield. The parking lot fixtures must also be fitted with a shield that totally covers the lenses. It is recommended that LED lighting be used for the parking lot and wall mounted fixtures. Photometrics. The lighting plan is in compliance with Zoning requirements for lighting intensity. The light intensity is required to be less than one foot candle at the centerline of adjacent streets and 0.4 foot candles at the property line. Hours. Outdoor lighting for parking lots shall be turned off one hour after closing, except for approved security lighting. 3 Landscaping. The submitted plans indicate plantings within the parking lot and around the perimeter of the site. The City Arborist was not favorable to the first plan submitted by the applicant, but has been working with their landscape architect to improve the design and material selection. A revised landscape plan has been submitted that is subject to review and approval of the City Arborist. Mechanical Screening. The plans indicate a roof detail where the mechanical units are totally screened by the parapet walls. The Building official will verify the final design and screening as part of building permit review. Signage. Freestanding Signage. A pylon sign is proposed at the front of the site near the private road. The sign is 20 feet in height (20 feet allowed) and the signage is 100 feet (100 feet allowed). The sign does not include the landscaped base as required by the Zoning Ordinance. The Design Guidelines indicate that ground or monument signs are encouraged over pylon signs. Staff has asked the applicant to provide an alternate plan for a monument sign. Most of the freestanding signage in the City since the Design Guidelines were implemented has been a monument sign. Wall Signage. The Zoning Ordinance allows for a total of two wall signs, each on separate facades. The proposed sign plan indicates two wall signs, one facing east and one facing 60 Street. one of the wall signs is 106 square feet and the other is 103 square feet. Total Allowable Signage. The total square footage of signage, including the monument sign shall not exceed 300 square feet for the site. The total of all requested signage is 309 square feet. The applicant will need to revise the sizing of the signage to comply with the Zoning. Ordinance. Sign Illumination. The AutoZone sign on the pylon will be internally lit. The plans do not indicate the color of the background or how it will be lit. If the background is a dark color with the AutoZone logo and name illuminated it will be compliance with the Zoning Ordinance. Additional information will need to be provided. The two wall signs are also to be internally illuminated. The signs as designed indicate a white border around the letters and logo. This feature of the sign should be eliminated if it will appear as white when the sign is lit. Staff will approve the lighting specifications for the signs at the time of permitting. Design Guidelines Sustainable Guidelines. City staff has questioned the applicant on how the project has been designed to achieve at least a certain degree of sustainability. The applicant will need to discuss the methods in building construction and site design with the Planning Commission of how these issues have been addressed. 4 Architectural Guidelines. Facade Treatments The building will have a definite base, middle and top, especially in the front facade facing Go Street. The base is defined by the detailing in the brick, the middle by the placement of the windows and the top by the use of the EIFS type material. The building is broken up by vertical pillars on all facades. There is a primary entrance well defined by the detailing and use of materials. Ground Level Expression This is a one story building with a raised parapet at the corner. The main entrance, that faces east, is well defined with the columns, raised parapet, and use of building materials. Transparencv The building uses glass on the north and east facades. The Design Guidelines requires at least a 20 percent transparency on ground floor, street facing facades. The facade facing Go Street is approximately 2 1.6 percent transparent. Entries The building features a prominent entry. Roof Design The roofline is broken at the northeast corner by the raised parapet. The rooftop mechanical equipment will be screened. Buildinq Materials and Colors The applicant has provided color elevations for review. The primary building materials of brick and glass will exceed the 60 percent requirement. None of the prohibited building materials will be used. Building material samples will be available at the Planning Commission meeting. Franchise Architecture The building design and material selection will be consistent with the Cities design goals. Site Design Guidelines Buildinq Placement The proposed building has a well defined entrance facing east to the parking lot. The building is set back to allow for parking and landscaping. Pa rki nq Areas The parking area is landscaped with adequately sized islands. 5 Sto rmwate r Stormwater will be addressed in the City Engineer's report. Pedestrian and Common Space A trail location has been added on the plans along 60 Street. There are no trail connections on either side of this property at this time. The applicant shall provide the City a trail easement and agree to build the trail at a later date when required by the City. A walkway has been added on the plans between the 60 Street trail and the front entrance of the building. Front entrance does not plan for any common space or seating areas. The Planning Commission should comment. Landscaping Building entrance plantings are required. The applicant should address a plan for adding plantings at the front entrance to the building. Trees /Shrubs The trees and shrubs used in the landscape plan shall be subject to the review and approval of the City Arborist. Utilites/ Service /Loading /Drive - Through /Storage Areas Addressed elsewhere in the planning report. Liq htinq Addressed elsewhere in the planning report. Siqnaqe Addressed elsewhere in the planning report. Pedestrian/ Bicvcle Routes A bike rack should be added near the front entrance of the building. CONCLUSION 1 RECOMMENDATION Upon review of the requests for site plan and Design Guidelines review, City Staff would recommend the project with the conditions as follows: 1. There shall be no repair of vehicles on the premises or in the building associated with this use. 2. The grading, drainage and utility plans shall be subject to the review and approval of the City Engineer. 6 3. All lighting fixtures shall be full cut off and installed in compliance with the lighting standards of the Zoning ordinance. All visible interior lighting shall also be full.cut off. 4. The outdoor lighting shall be turned off one hour after closing, except for approved security lighting. 5. The applicant shall consider the use of LED lighting for the parking lot and building lighting. 6. The landscape plans are subject to review and approval of the City Arborist. 7. Mechanical equipment that is located on the roof and visible from street level or from neighborhood properties shall be screened with materials that blend harmoniously with the building facade materials. The Building Official shall verify the final design and screening of the mechanical equipment. 8. The applicant shall provide plans for screening the trash enclosure with masonry materials to match the AutoZone building subject to review and approval of the City Planner. 9. The applicant shall provide an alternate plan for the freestanding sign as a ground or monument sign. The sign shall be subject to review and approval of the Planning Commission and City council. 10. The signage plan shall be revised so that the total signage on site is less than 300 square feet. 11. The sign specifications and methods of illumination shall be subject to review and approval of the City Planner at the time of permitting. 12. The applicant shall address sustainability initiatives with the Planning Commission. 13. The Planning Commission should comment on the building material selection and colors. 14. The City Council intends to construct an eight foot bituminous trail on the south side of bo Street North adjacent to the AutoZone. AutoZone agrees to a special assessment for this improvement and does hereby waive all rights they have by Minnesota State Statutes 429.081 or otherwise challenge the amount or validity of the assessments or procedures used by the City in levying the assessments. AutoZone's execution of the Conditional Use Permit document acknowledges this waiver. 7 15. The applicant shall provide a trail easement, which shall include the waiver of special assessment (found in item #14 above), subject to review and approval of the City Attorney for the 60 Street Trail. 16. The Planning Commission should comment on the need for common space and seating areas at the front entrance. 17. The applicant shall provide a plan for the addition of front entrance plantings. 18. The new plant types chosen are hardy, attractive, relatively insect and disease resistant, and they should do well on that site. The "Planting Detail" has been changed to include language regarding removal of the top rungs of any wire basket surrounding the root ball of B &B (balled and burlapped) planting stock. An infiltration basin on the north side of the project will be planted with native wetland plants, all of which are appropriate for that area. Following are our initial comments and/or recommendations. Sheet CZ — Demolition Plan 1. At the curb removal locations the bituminous shall be saw cut at a minimum of 18" into the existing wear course pavement on the Private Road (see detail plate STR -30). The current condition of the road is relatively poor with several patches already in place. The removal and patching should be discussed with the owner, as a mill and overlay or other street maintenance may be required in the future or in conjunction with this project. Sheet C3 — Cradina Plan 1. The contours along the west side of the proposed AutoZone shows a steep slope (approximately 3:1), with a swale along the edge of the existing bituminous parking lot. This area should be re- designed to incorporate storm sewer drainage inlets and/or a possible retaining wall. Storm water runoffs may pond or undermine the existing bituminous as currently designed. Maintaining the grass along this side will be difficult with the steep slope as proposed. 2. Retention Pond a. This should be constructed as an infiltration basin or rain garden with plantings. b. Have borings been completed for this site? Provide geotechnical report. c. Augmented soils should be installed as directed by the Brown's Creek watershed District. d. An emergency overflow (EOF) needs to be shown. e. Install rip rap at the bottom of the concrete swale. Oak Park Heights Page 2 AutoZone December 6, 2010 f.' The design of the basin needs to be completed with the consideration of a future trail along 60 Street North, and an access trail or walk to the proposed AutoZone. 3. The existing storm sewer may require re- design with the future trail proposed along 60 Street North. Sheet C4 — Erosion Control Plan 1. Install inlet protection at both existing catch basins located on the Private Road, northeast corner of the site (see detail ERO -4C }. Sheet C5 — Utilitv Plan 1. Identify and label the existing 8" VCP sanitary sewer and 10" DIP sanitary sewer force main. Verify all the existing utilities are shown accurately, comparing it to the utility chip maps provided by the City. 2. Identify and label the existing 35' utility easement located on the northern portion of the site (see sheet 4/9 of the attached record plan drawing from 1991). This easement shall be revised to incorporate. the future trail use and maintenance. 3. The 6" water service connection to the existing 12" DIP shall be by wet tap in order to avoid temporary shut down of water to existing businesses. 4. The 6" sanitary sewer service shall be connected by core drilling into the existing 8" VCP sanitary sewer. 5. Maintain 7' of cover for water main and service. Insulation may be required for the water service at the infiltration basin area (see detail plate SAN -6). Drainage Comments The submitted drainage calculations have not been reviewed in detail. Following the re- design of the retention basin, the drainage to the west of the proposed AutoZone, and inclusion of the future trail and walkways, drainage calculations shall then be submitted. The initial calculations do show a decrease from the existing conditions in proposed peak storm water discharge rates. General Comments 1. A copy of the MnDOT permits for access and utility work within the right of way of 60 Street north shall be submitted to the City. 2. A copy of the Approval letter from the Brown's Creek watershed District shall be submitted to the City. 3. The scales shown on the 11 "x17" size plans are not drawn correctly. The 22 "x34" size plans show the scales accurately. 4. Following the review of a previous wetland delineation report, Ben Meyer with Bonestroo completed a Minnesota wetland Conservation Act — Notice of Decision: 'A wetland delineation report dated September 23, 2010 was submitted by Arrowhead Environmental Consulting for an approximately 1.33 acre parcel Oak Park Heights Page 3 AutoZone December 6, 2010 located south of 60' St N near the north entrance to Walmart in Oak Park Heights. This site was previously delineated in a report dated October 28, 2008 by MFRA for a proposed bank on Lot 2, Block 1, Walmart Addition. A Notice of Decision, dated December 8, 2008, was sent approving the wetland boundary and exemption for "Incidental Wetland': Therefore, the current wetland boundary application is approved and any proposed impacts to the wetlands would qualify under "No Loss" per MN Rule 8420.0415 A. " 5. Verify all area /connection charges have been previously collected. 6. As part of the City's continued interest in energy conservation, it is recommended to consider the use of LED lighting for the street lighting and wall packs. 7. Access to the AutoZone site is proposed showing two entrances from the Private Road. The Private Road is currently owned by Wal -Mart. Private easements for the maintenance of this street shall be reviewed by all parties. 8. Discussions with AutoZone and Jerry's Auto Detail need to occur in order to resolve the drainage concerns (listed above in the Grading Plan comments) between the properties. Also, a guard post currently resides just east of the Jerry's Auto Detail property line and needs to be addressed. 9. The plat information shown on the plans has not been reviewed with the original Wal- Mart Addition plat. 10. Several City standard detail plates are provided as attachments.
