The existing park is nine acres that includes a park shelter, two play structures, two softball fields, an outdoor skating area with a hockey rink, and a parking lot with spaces for approximately 50 cars. The park is bordered by a DNR wildlife area to the south and single family neighborhoods to the north. The Brekke Park enhancement project utilizes only City park property and the acquisition of additional land is not necessary. Due to the park's central location near established residential land use and the predominance of young families in the area, the park has become a central community focal point. In the 1980s, a play structure, tot lot, and play equipment were constructed on the eastern portion of the park. Although popular, the play areas and equipment were placed on the property as individual objects and not integrated together with an overall plan or design. In 1990, a new play structure was installed at the western portion of the park and is utilized primarily by independent, older children or in conjunction with ball games. The Oak Park Heights Park Committee has prepared a concept master plan for the eastern portion of Brekke Park. The master plan integrates the existing components into a cohesive play area that allows for a diversity of uses and activities. The plan focuses on creating spaces for the child's imaginative play. Walkways are train tracks and raceways, a circular plaza in the central portion of the park is a stage, a turntable, a chalk area, or whatever is imagined by the child. The master plan features the use of landscaping and land forms that create spaces and backdrops for imaginative play. A maze garden, wildlife garden and observation area, a prairie hill, and a landscaping design will transform this portion of the park into a learning and exploratory area. Accessibility and safety of the play area are vital components to the park design. Play equipment that is designed for playful integration for children with a broad range of abilities is to be added to the existing play area with this enhancement project. The circulation routes that tie the design together allow access to all parts of the play areas and creates a safe tricycle pathway for younger children. Shredded hardwood mulch will be utilized within safety zones for safety and accessibility. As a part of this project, the existing skating /hockey rink would be provided with a permanent concrete surface to extend the season for outdoor use and provide a facility for Summer skating activities. During the Winter, the skating facility could be given dedicated hours for open skating versus hockey, thus allowing a wide range of age and ability levels to enjoy the facility. The primary goal of the facility is to expand the utilization of the site for both Summer and Winter activity for all age groups. In order to provide access to all areas of the park and to physically connect the separate uses of the park, an eight foot wide bituminous trail will extend from the west play area, and the softball fields to the east play area, hockey rink, park shelter, and parking lot. The bituminous trail will also connect a park access point from the residential neighborhood to the new trail. When the project is complete, Brekke Park will be a community /neighborhood park that is a focal point of the City and serve all age groups with diverse abilities and interests. It is the goal to include many volunteer groups, including the City's active garden committee, in the implementation of the park improvements so its vision can be carried into the future. ITEM 3A: COST BREAKDOWN - ACQUISITION The proposed project does not require the acquisition of property. If funding from the Outdoor Recreation Funding Program is received, tree transplanting, earthwork, and some of the plant installation and seeding will occur in the late Summer /early Fall of 1997. If late Summer /Fall conditions warrant, the paving and surfacing would also be completed so the park would not need to be closed during the Spring. In the Spring of 1998, the City would organize volunteer groups to install plantings, install benches, signs and play equipment. Brekke Connecting Trail The installation of the connecting trail is also dependent upon when /if grant money is received. If possible, the trail would be completed during the construction seasons of late Summer /early Fall of 1997. If the project needs to be installed in 1998, it would likely have to be completed after Labor Day when the ballfields are not being utilized by organized athletic teams. All work on the park would be completed prior to November 1, 1998. No land acquisition is required for the Brekke Park project. • CITY OF r. ITEM 6: LOCAL GOVERNMENT RESOLUTION A RESOLUTION AUTHORIZING THE CITY ADMINISTRATOR TO MAKE APPLICATION TO THE DEPARTMENT OF NATURAL RESOURCES FOR AN OUTDOOR RECREATION GRANT PROGRAM APPLICATION FOR BREKKE PARK. BE IT RESOLVED that the City of Oak Park Heights act as legal sponsor for the project contained in the Outdoor Recreation Grant Program Application to be submitted on 28 March 1997 and that the City Administrator is hereby authorized to apply to the Department of Natural Resources for funding of this project on behalf of the City of Oak Park Heights. BE IT FURTHER RESOLVED that the City of Oak Park Heights has the legal authority to apply for financial assistance, and the institutional, managerial, and financial capability to ensure adequate construction, operation, maintenance and replacement of the proposed project for its design life. BE IT FURTHER RESOLVED that the City of Oak Park Heights has not incurred any costs and has not entered into any written agreements to purchase property. BE IT FURTHER RESOLVED that the City of Oak Park Heights has not violated any Federal, State, or Local laws pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest or other unlawful or corrupt practice. BE IT FURTHER RESOLVED that upon approval of its application by the State, the City of Oak Park Heights may enter into an agreement with the State of Minnesota for the above referenced project, and that the City of Oak Park Heights certifies that it will comply with all applicable laws and regulations as stated in the contract agreement and described in the Compliances section of the Outdoor Recreation Grant Program Application. NOW, THEREFORE, BE IT RESOLVED that the City Administrator is hereby authorized to execute such agreements as are necessary to implement the project on behalf of the applicant. New Business: Resolution 97 -03 -15 - A Resolution Approving the Decertification of Housing Tax Increment Financing District No. 1 - Councilmember Turnquist, seconded by Swenson, moved to adopt Resolution 97 -03- 15 - A Resolution approving the decertification of Housing Tax Increment Financing District No. 1. Carried 5 -0. Review of MNDOT Memorandum of Opposition - Council reviewed the MNDOT Memorandum of Opposition. City Attorney Vierling stated that Oak Park Heights Motion to Intervene in the Sierra Club vs. Pena, et. al, suit was denied. Manning Avenue Corridor Study - Council directed City Planner Richards and City Engineer Anderlik review the study and make recommendations. Correspondence: Washington County Public Works Department - Bicycle and Pedestrian Facilities Review for Osgood Avenue - Council reviewed correspondence from Washington County regarding the City's desire to add provisions for bicycle and pedestrian traffic into the County's CSAH 24 pavement preservation project. Washington County plans to construct an off road trail as part of the 1999 CIP. Councilmember Robert questioned whether the County could strip a bike lane between Highway 36 and 56th Street in the interim. State Senate Hearing on NSP's Property Tax Relief Proposal - Council reviewed a memo prepared by Councilmember Swenson summarizing testimony he gave at a recent Senate Hearing on NSP's property tax relief proposal. NO action was taken. ITEM 7: COMPLIANCES All projects must comply with applicable State and Federal laws, rules and regulations that apply to the Outdoor Recreation Grant Program including, but not limited to: 1. OMB Circular A -128 - Implements the Single Audit Act of 1984 (P.L. 98 -502), which establishes audit requirements for State and Local governments receiving Federal funds. 2. OMB Circular A -87 - Establishes "Principles for Determining Costs Applicable to Grants and Contracts with State, Local and Federally Recognized Indian Tribal Governments ". 3. Section 504 of the Federal Rehabilitation Act of 1973 and MN Laws, Chapter 363 Minnesota Human Rights Act - Require that all public facilities and programs be designed and constructed to be accessible to the physically handicapped. 4. Architectural Barriers Act of 1968 (P.L. 90 -480) - Ensures that certain buildings financed with Federal funds are designed and constructed to be accessible to the physically handicapped. 5. Americans with Disabilities Act (ADA P.L. 101 -336, 104 Stat. 327, July 30, 1990) - Ensures the elimination of discrimination against individuals with disabilities. 6. Title VI of the Civic Rights Act of 1964 (P.L. 88 -352) and subsequent regulations - Ensures access to facilities or programs regardless of race, color, religion, sex, or national origin. 7. Executive Order 11246, as amended by Executive Orders 11375 and 12086 and subsequent regulations - Prohibits employment discrimination on the basis of race, color, religion, sex or national origin. 8. Title II of the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 as amended and subsequent regulations - Identifies procedures for the acquisition of property and relocation of persons and businesses. 9. Executive Orders 11988 and 12148, Floodplain Management - Requires action to minimize the impact of floods on assisted projects. 10. Clean Water Act and Executive Order 11288 - Requires protection of surface and ground water resources. 11. Executive Order 12549, Debarment and Suspension (43 CFR, Part 12, Section 12.510) - Requires a certification regarding Federal Debarment, suspension and other responsibility matters. 12. Restrictions on Lobbying with Appropriated Fund (P.L. 101 -121 Section 319 (31 USC Section 1352) - Requires a certification that no Federal funds be utilized to lobby or gain undue influence in connection with a Federal grant or loan. 13. Contract Work Hours and Safety Standards Act of 1962 (40 USC, Section 327 -333), State Laws - Requires payment of wages, at hourly rates, as established by the Department of Labor. 14. The Archeological and Historic Preservation Act of 1974, as amended (P.L. 93 -291, 16 USC, Section 469 et. seq.), Minnesota Statutes 138 - Requires a review by the Historical Society to determine if there are any known or suspected historic or cultural properties within the proposed project area. An archeological survey of the site could be required before the project receives approval for construction. 15. The National Preservation Act of 1966, as amended (P.L. 88 -655, 16 USC Section 470 et. seq.) - Requires a review to determine if the site is eligible for listing on the National Register of Historic Places. 16. The National Environment Policy Act of 1969 (42 USC, Section 4321 et. seq.) and other related acts to the environment - Requires an analysis of the project's environmental impact and a description of efforts to mitigate the impact. 17. State Executive Order 91 -3, Wetlands; Executive Order 11990, Protection of Wetlands - Requires a review of the proposed project to determine if any wetlands would be adversely affected and if any alterations are approved to apply the principles of no- net -loss of wetlands during the conduct of their project. 18. Emergency Wetlands Resource Act of 1986 (P.L. 99 -645). 19. The Uniform Administrative Requirements for Grants and Cooperative Agreements to State and Local Governments (Federal Register March 11, 1988, Volume 53, Number 48) - Establishes requirements for procurement and financial management. 20. Executive Order 12432, Minority Business Enterprise Development - Encourages recipients to award construction, supply and professional service contracts to minority and women's business enterprises. 21. Land and Water Conservation Fund Program of Assistance to States: Post - Completion Compliance Responsibilities (36 CFR Part 59). 22. Other applicable statutes, executive orders and regulations as may be promulgated from time to time. The applicant certifies that it will comply with the above referenced list and when necessary, complete any action required to meet these compliances prior to project approval, within a set time frame. The time frame will be determined by the State depending on the required action. Signed: ichael Robertson, City A dministrator Date • ITEM 8: PUBLIC HEARING Citizen Participation Process - Public Hearing Requirement The proposed improvements to Brekke Park were considered by the Oak Park Heights Park Commission at their regularly scheduled meeting on 15 April 1996 and on 17 March 1997. Both meetings were noticed and citizen input on the Brekke Park project was encouraged as part of these discussions. The public hearing for the Brekke Park Outdoor Recreation Grant Application was held at the 22 April 1996, Oak Park Heights City Council meeting. The hearing was specifically noticed by the Courier News on 11 April 1996 in compliance with the notice requirements of the City of Oak Park Heights. The public hearing was held at the Oak Park Heights City Hall which is fully accessible and was broadcast on Channel 12, the cable access channel for the City. The Brekke Park project was presented by the City Planner and included a discussion of the project scope, implementation schedule, costs, and source of funding, and ongoing maintenance costs and issues associated with the proposal. After discussion of the project, the City Council made minor revisions to the site plan and directed staff to move forward with the application for submittal in 1997. James Humphrey, 14932 North 60th Street was present and stated he was a neighbor of the Kelly's and has no objection to the variance. Councilmember Robert stated that a utility shed already installed on the property is not in compliance with current ordinances. Robert questioned the size of the proposed shed. Councilmember Kern, seconded by Schaaf, moved to table the Public Hearing until the next meeting scheduled May 13th, 1996 so the Kellys could be present to address these concerns. Carried 4 -0. Council directed Robertson to have copies of the ordinance pertaining to storage sheds and a written recommendation from the Building Inspector on this issue available at the next meeting. HOF Outdoor Recreation Grant Application - City Planner Richards reviewed the Outdoor Recreation Grant Application. Richards stated that the Minnesota State Legislature did not authorize any funding for the program this session. Therefore, the application deadline for the Grant has been changed to March 31, 1997. Richards said the estimated costs for the proposed improvements is $94,000. The City will receive half of the cost of financing the project if the City is awarded the Grant. New Business: Arbor Month Proclamation - Mayor O'Neal read a proclamation declaring April 26, 1996 to be Arbor Day, and the month of May, 1996 to be Arbor Month in the City of Oak Park Heights. Resolution 96 -04 -11 - A Resolution Setting Area Connection Charges for City Utilities - Councilmember Kern, seconded by Schaaf, moved to approve Resolution 96 -04 -11 - A Resolution Setting Area Connection Charges for City Utilities per recommendation of the City Engineer. Carried 4 -0. Approval of Autumn Ridge Phase III Improvement Bids - Councilmember Schaaf, seconded by Kern, moved to approve the Autumn Ridge Phase III Improvement Bid of Tower Asphalt, Inc., with a low bid of $177,984.00. Carried 4 -0. Proposed Mandatory Business Recycling - Mary Sharbono, 14630 North 57th Street, was present to discuss mandatory recycling for businesses. Sharbono reported that businesses generate between 50 -60 percent of the municipal waste. The largest waste material generated by businesses is office paper which is recyclable. Sharbono expressed concern about the amount of waste generated by businesses that is not being recycled. ITEM 9: PROJECTED OPERATION AND MAINTENANCE COSTS Brekke Park is an existing park that currently has operations and maintenance costs that are budgeted by the City. The proposed enhancements to the park will require that the current operation and maintenance costs be raised. The following is an estimate of additional costs that will be needed with the park enhancements. THE CITY COUNCIL OF THE CITY OF OAK PARK HEIGHTS, WASHINGTON COUNTY, MINNESOTA, DOES HEREBY ORDAIN: 205.01 Establishment of a Commission. A City Parks, Playgrounds and Recreation Commission for the City of Oak Park Heights, Washington County, Minnesota, is hereby established. 205.02. Composition. Said Parks, Playgrounds and Recreation Commission shall consist of five (5) members, and said members shall be appointed by the City Council. The members of the Commission first appointed shall be as follows: Two (2) for the term of one (1) year; two (2) for the term of two (2) years; and one (1) for the term of three (3) years. Their successors shall be appointed for terms of three (3) years. Both original and successive appointees shall hold office until their successors are appointed and have qualified. Access and circulation are the main reasons for the proposed improvements to the park. In Brekke Park East, the proposed circulation layout will allow persons with disabilities access to the entire park area. The 10 foot wide train track walkway and tricycle raceway provides a hard surface that will provide access to the play areas. Existing sand /pea gravel and turf safety landing areas are to be replaced by shredded hardwood mulch, a material that provides a safe landing surface as well as accessibility. The ring walkway around the existing tot lot provides access to the new ramp which will allow wheel chair access to the existing "goods wagon ". "Aladdin's Cave" is a piece of play equipment for beginners that also incorporates ways for playful integration for those with disabilities. The walkways to the more natural area of Brekke Park East are made up of crushed stone or stone and will provide access to this portion of the park. This area will be made up of various outdoor rooms, accessible to all that will allow for a wide range of sensory stimulation. From the children's garden, the maze garden, and the wildlife garden and observation area, it is felt that persons of all ages and abilities will appreciate this reflective portion of the park. The proposed trailway connecting trail will allow elderly and disabled persons to access the park and will be an off road connection to the City's bicycle and pedestrian trial system. The existing park has handicapped accessible rest rooms and accessible parking areas established. The proposed revisions include the installation of curb cuts to provide better access to all areas of the park. • ITEM 13: ENVIRONMENTAL INTRUSIONS The land within or adjacent to the park boundary of Brekke Park has no environmental intrusions such as overhead power lines, lift stations, or other utility structure, easements, or roadways which have an effect on the property ITEM 14: PERMITS TO WORK IN PUBLIC WATERS The Brekke Park enhancement project does not propose the development or alteration of shoreland adjacent to rivers, streams, lakes or other public waterbodies. ITEM 15: AGREEMENTS The project as proposed will not require any agreements or contracts with another party. The development, operation and maintenance of the park and its proposed improvements will be done by the City of Oak Park Heights. A local garden committee will plant and maintain the garden areas of the park which has not in the past or will now require an agreement or contract with that organization.
