I. CONDITIONAL USE PERMIT FOR: construction and use - high school facility ' All uses shall be subject to the following conditions and /or restrictions imposed by the City Council of the City of Oak Park Heights. General Description: 1. Property shall be used for the construction of a senior high school with related facilities as are currently described and shown in site plans and drawings attached to and incorporated within the Developer's Agreement to be executed between the ' Developer and the City prior to issuance of the Conditional Use ' Permit. 2. Construction of any facilities, buildings or structures i not specifically shown within the existing site plan drawings shall 1 1 not be allowed except upon application to amend the Conditional Use Permit., 1 3. Curb cuts and median cuts in excess of 24 feet as shown along 58th Street as depicted on -site drawings September 3, 1991. 1 4. Applicant has received a variance as to height allowing 1 the high school to exceed the 35 ft. height restrictions otherwise set forth within the ordinance in order to allow construction of 1 portions of the building to exceed that limitation as follows: Auditorium to 60 feet in height; cafeteria to 39 feet in height; administrative /media .building 43.8 feet in height (Resolution granting variance attached as Exhibit I.4. 5. Applicant has received a variance to signage allowing 1 high school to host identification signage in excess of that which is provided for by the ordinance. Resolution granting variance as to signage attached hereto as Exhibit I.5. 1 II. ADDITIONAL RESTRICTIONS AND PROVISIONS. The following additional restrictions and provisions being part of the Conditional Use Permit to be issued herein affecting the following matters shall be: A. Accessory Buildings None other than those which presently exist on the site and which are displayed on the site plan, being the Southwest Site Plan dated September 3, 1991. B. Fencing 1 Cyclone fencing to be constructed along the west, south and east property borders per fencing and screening plan attached 1 hereto as Exhibit B. 2 1 1 1. 1 C. Exterior Storage None other than seasonal athletic equipment which may be displayed and left out on the athletic fields. ' D. Chemical /Pollutant Storage and Disposal ' Applicant /Permit Holder shall obtain a Hazardous Waste Generator's license from the Minnesota Pollution Control Agency /Washington County Department of Health, and comply with all MPCA and Department of Health Regulations with regard to waste and hazardous waste disposal. E. Screening Per attached Exhibit B - Fencing, Landscaping and Screening Plan. ' P. Landscaping Per attached Exhibit B. I G . Lighting • Design of all exterior lighting shall provide hooded or controlled lighting features. Building security lighting shall also be specifically identified by the Applicant and Site Plans and subject to approval by the ' City Engineer. The provisions of Chapter 400 S401.03 of the Code of Ordinance for Oak Park Heights affecting glare shall be complied with. • H. Parking Parking shall be initially constructed to that which is ' shown on Area Site Plans dated September 3 1991. The City may require the Applicant to upgrade or add additional parking spaces so as to provide for additional ' growth or use of the facility to be constructed by the applicant as student populations increase. The ratio to be used to require additional spaces shall be one parking ' stall per 2.5 students. Actual usage of the school parking facilities and plans by Independent School District No. 834 to effect a limitation on car ' transportation /parking needs of the facility shall be considered by the City of Oak Park Heights with regard to future review of parking facilities. I. Hours of Operation Not applicable. 3 1 1 J. Advertising / Signage Signage allowed per Signage Plan - -also see•I.5. R. Drainage , Must conform to city approved Drainage Plan (Exhibit E) and Valley Branch Watershed District permits and regulations. (See Valley Branch Watershed District letter dated November 20, 1991 and additional documentation provided by Valley Branch WAtershed District attached as Exhibit II.K.) L. Circulation and Access Three access P oints to the site shall be provided as is demonstrated within the Applicant's Site Plan. A second • access onto 58th Street leading directly into the bus I corral shall be restricted to bus or truck traffic only, leading to the bus, loading area. Vehicle circulation around the building up to the kitchen 1 loading dock is provided for. Applicant /Permit Holder shall provide sufficient access I required by the City Planner and City Engineer to the entire exterior of the building for emergency vehicles without constructing driveway around the entire building. 1 M. Trash Receptacles Applicant shall provide . within its drawings, specific ' locations for trash receptacles and clearly identify same. If trash containers are to be located on the exterior portions of the building, all trash containers I must be screened from view from residential areas. Screening materials shall be provided as recommended by the City Planner. (See II.E. above) N. Other: Subject to Development Agreement to be executed between 1 the parties and resolution of drainage plans and permits with Valley Branch Watershed District. III. REVIEW: , Periodic review of this Conditional Use Permit is imposed as a condition of its grant. This Conditional Use Permit shall be reviewed annually by the City Council which shall notify the permit 4 1 1 1 - holder of the date of the annual review at least thirty (30) days I prior to the review hearing. The City of Oak Park Heights shall provide to the Applicant /Permit Holder staff comments as it affects compliance issues with the Conditional Use Permit at least fifteen (15) days prior to the permit review date. Activities and uses not I specifically provided for within this permit are prohibited. Applications to amend this permit may be applied for in the manner set forth within the zoning ordinance of the City of Oak Park I Heights. Issuance of the Conditional Use Permit is awaiting final II resolution of drainage plans and permits from Valley Branch Watershed District. Independent School District No. 834 recognizing that it proceeds in this matter at its own risk as it relates to issues involved in final approvals by Valley Branch II Watershed District. It RESOLUTION 91 -12 -64 • CITY OF OAK PARK HEIGIHTS WASHINGTON COUNTY MINNESOTA • • A RESOLUTION GRANTING A VARIANCE AS TO II HEIGHT RESTRICTIONS FOR INDEPENDENT SCHOOL DISTRICT NO. 834 WHEREAS, the City of Oak Park Heights has received an application for variance submitted by Independent School District II No. 834 seeking to vary from the height restrictions and dimensions set forth within the zoning code of the City of Oak Park Ileights; and, WHEREAS, publication and notice is required within the II Ordinance has been duly 'provided for; and, • WHEREAS, the City Council for the City of Oak Park II Heights has received public comment at the public hearing in this matter; and, WHEREAS, the City Council has considered before it all the files, records and proceedings herein. NOW, THEREFORE, BE .IT RESOLVED by the City Council for the City of Oak Park Heights that: 1. The variance sought by Independent School District I No. 834 as to height of the auditorium to the level of 60 feet, the cafeteria as to 39 feet in height, to the administrative /media . building to 43.8 feet in height, is hereby granted. 2. The City Council specifically finds hardship due to the nature of the facility that is being constructed upon the land is so located and given the unique nature of the facility, the Council has determined that a hardship does exist so that if the Council were to require Independent School District No. 834 to construct the building within the existing height limitations of the zoning ordinance that such standards are unreasonable given the magnitude of the facility sought to be constructed and the purposes for which it would be used. BE IT FURTHER RESOLVED that the City Council specifically II finds that there is no adverse impact to any adjoining property owner as a result of the grant of this variance nor is their likely to be impact upon future uses of adjoining lands as a result of the issuance of this variance. NOW, THEREFORE, BE IT RESOLVED by the City Council for the City of Oak Park Heights that the application for variance as to signage in . the manner applied for by Independent School District II No. 834 as it effects the final construction location of the Stillwater Senior High School facility to be constructed within the • City of Oak Park Heights is hereby granted subject to the conditions and the review of the City Planner as contained within the annexed report attached hereto as Exhibit 1 and incorporated by reference herein. Amendment is granted to the Conditional use Permit as issued to allow the construction of a High School Stadium including 90 foot high light poles with fixtures at other than a 90 degree cutoff, and a variance to allow the two bleacher structures to exceed the building height standards for accessory buildings. II. ADDITIONAL RESTRICTIONS AND PROVISIONS. 1 1 1 The following additional restrictions and provisions being part of the Third Amendment to Conditional Use Permit and Variance to be issued herein shall be: 1. No activity at the stadium shall be illuminated with the outdoor lighting system after 11:00 PM or at any 1 time on Sundays. 2. When constructed, the outdoor lighting system shall be tested to assure compliance with the lighting ' requirements founds in Section 401.15.B.7(d) and (e) of the Zoning Ordinance. Meter readings shall be provided to the City in compliance with methods of measuring light intensity as found in the Zoning Ordinance. The light fixtures shall be subject to City staff review and approval prior to and after 1 installation to assure compliance with the Zoning Ordinance and the conditional use permit. 3. The CUP will be granted to allow the stadium lighting to be constructed and operating within two years of the time of initial completion of the stadium complex. If the lighting is not erected within this period, its subsequent construction will require application for necessary permits and approval of the City Council. 1 4. All events held at the stadium shall comply with State MPCA standards applicable to sound. The City shall require limitations on use of loud speakers if noise levels are found to exceed State MPCA 1 standards. Upon installation of the sound system, meter readings shall be submitted to the City demonstrating compliance with MPCA standards, subject to City staff review and approval. 5. A lighting plan shall be provided by the District indicating provisions for lighting the area between the parking lots to the entrance gates and bleachers. The plan shall be subject to review and approval of the City Council, City Engineer, and staff. All light fixtures for the stadium entrance gate and bleachers shall be subject to City staff review and approval prior to and after installation to assure compliance with the Zoning Ordinance and the conditional use permit. 6. The emergency access drive and gate shall be appropriately marked and accessible to emergency personnel at all times subject to review and approval of the Police Chief. 1 7. The District has established an Emergency Evacuation Plan for the stadium, subject to review and approval of the City Administrator with consultation of the Police Chief and City Engineer. 8. The District shall provide plans for securing satellite toilet facilities to the ground, subject to review and approval of the Building Official. 1 9. Any plans for signage shall comply with Section 401.15.G of the Zoning Ordinance and be subject to City review and approval. 10. Any plans to replace the existing score board shall be submitted to the City for review and approval. Any plans to erect a new score board shall require a new application. 1 11. All landscape and transplanting plans shall be subject to review and approval of the City Arborist. 12. Drainage calculations for the proposed changes to the site shall be submitted to the City Engineer. All 1 • 1 grading and drainage plans shall be subject to the review and approval of the City Engineer and applicable watershed authority. 1 13. The District has provided material and color samples of the bleachers and press box. The Planning Commission has recommended bleacher colors in red, black, or silver with complementary colors for the 1 press box as presented by the District. 14. The District has provided a Parking and Traffic Management Plan for event parking, detailing when it will be put into effect, and how it will be implemented, subject to review and approval of the City Administrator, with consultation of the Police Chief and City Engineer. The City reserves the right to readdress the parking and traffic management plan and /or the on and off-site parking requirements in ' such a manner that will promote the public health, safety and welfare of the community. In its review, the City may require the District to add additional on -site parking to accommodate highly attended events: I 15. This approval does not include the future concession/ticket and rest room facility. Detailed P lans would need to be submitted for amended conditional use permit approval at the time of proposed construction. 1 The District shall abide by State laws in providingnecessary rest room facilities, subject to future review by the City Council. NE'�{ICS � • wwo,rq.ur.sra {�m�wyeeer .r ■ 1 . • 1 EMERGENCY EVACUATION PLAN ' Stillwater High School Stadium 1 March 2002 1 The following is an emergency evacuation plan for implementation at all formal 1 events held at the Stillwater High School Stadium, located at 5701 Stillwater Boulevard North, Oak Park Heights, Minnesota. 1 Section 1. Defined Terms. "C_yt " means the City of Oak Park Heights, Minnesota. 1 "District" means Independent School District No. 834. "Emergency" means, in the case of a Stadium .Event, any event or occurrence which presents in the reasonable judgment of . the then acting Responsible Officials an emergency situation creating a substantial risk of endangerment of the life, safety or security of attendees at such Stadium Event, including both players and spectators, such that Emergency Evacuation is deemed in the reasonable judgment of such Responsible Officials to be necessary or prudent for the protection of . such attendees. An illustrative list of such emergency situations includes, fire, violent weather (including thunderstorms, dangerously high winds or tornado activity), bomb scares, terrorist activity, flash floods and other similar occurrences. 1 "Emergency Evacuation" means any evacuation of the Stadium in connection with any Emergency, as a result of, or pursuant to, the decision of the then 1 acting Responsible Officials. "Emergency Evacuation Plan" means this emergency evacuation plan, or 1 such amended emergency evacuation plan as may be adopted from time to time hereafter, whether as a supplement to, or in replacement of this emergency evacuation plan. 1 "Emergency Exits" means the following entrance/exit gates located at the Stadium (all as depicted on Exhibit A attached to this Plan): (a) the main entrancelexit gate located at the northerly end of the Stadium; and (b) the emergency access gate, located at the northwesterly end of the Stadium and proximate to the visitors' bleachers. ' "Evacuation Staging Areas" means those open areas located within the Stadium and immediately to the north and south of each of the home and visitors' bleachers (all as depicted on Exhibit A attached to this Plan). 1 RB RIDER BENNETT ' BGAN &ARUNDEL • • "Responsible Officials" means in each case (a) those officials employed by the District, or by Stadium Event organizers or sponsors (in the case of events sponsored by other than the District), who are designated by the District, or such Stadium Event organizers or sponsors, as being responsible for supervising a Stadium Event; and (b) such law enforcement personnel as may be employed by the City and have authority under applicable law to exercise emergency powers to preserve or protect the safety, security and /or welfare of Stadium attendees. "Security Personnel" means those security personnel, if any, employed by the District, or by Stadium Event organizers or sponsors (in the case of events sponsored by other than the District), then located at the Stadium during a Stadium Event. 1 "Stadium" means the Stillwater High School Stadium, located at 5701 Stillwater Boulevard North, Oak Park Heights, Minnesota. 1 "Stadium Event" means any formal event held within the Stadium, whether District sponsored or otherwise formally sanctioned or permitted by the District. 1 Section 2. Evacuation Protocol. Upon the occurrence of any Emergency resulting in the decision by the Responsible Officials to declare an Emergency Evacuation, the following rules shall apply: • (a) All attendees shall be promptly instructed to immediately depart the bleachers and other Stadium areas in an orderly manner, and shall be provided such other directions as may be appropriate under the circumstances. In the event the Stadium public address system is in use for the applicable Stadium Event, the public address system announcer shall provide such instructions. If the public address system is not in use, or if for any reason such system is not then operational, the Responsible Officials, with the assistance of any Security Personnel, shall provide such instructions. (b) All Security Personnel, if any, or such Responsible Officials, in the absence of any Security Personnel, shall immediately assist in directing spectators out of the bleachers and into the closest available Evacuation Staging Areas, and shall otherwise assist in • facilitating a prompt and orderly evacuation of the Stadium by way of the Emergency Exits. 1 (c) If, in the opinion of the Responsible Officials, the applicable emergency conditions warrant providing emergency shelter to the attendees, such attendees shall be directed to the school building entrance serving the gymnasium areas, and such attendees shall be encouraged to seek shelter within the gymnasium areas for their safety and security. ♦`B 2 RIDER BENNETT 810018 -5 2 EGAN &ARUNDEL 1 1 • Section 3. Emergency Exits /Evacuation Staging Areas. At all times during any Stadium Event the Emergency Exits and Evacuation Staging Areas shall remain free of any temporary or permanent physical obstructions so as to facilitate unhindered egress from the Stadium in the event of any Emergency Evacuation; provided, however, location of one or more trash receptacles within an Evacuation Staging Area shall not 1 be deemed a temporary or permanent physical obstruction for purposes of this Section. Section 4. Emergency Instruction/Training. The District shall undertake the following instructional /training steps in connection with the implementation of this Emergency Evacuation Plan: 1 (a) The District shall incorporate this Emergency Evacuation Plan in all appropriate emergency instruction and training programs which may be conducted by the District for District personnel from time to time. • (b) In the case of Stadium Events other than District sponsored 1 Stadium Events, the District shall furnish a copy of the Emergency Evacuation Plan to the Responsible Officials designated by the sponsoring entity. (c) A copy of the Emergency Evacuation Plan will be furnished to all Security Personnel. (d) A copy of the Emergency Evacuation Plan will be posted within the Stadium press box. 1 Section 5. Amendments to Emergency Evacuation Plan. The Emergency Evacuation Plan may be modified from time to time upon the approval, or at the request, 1 of the then acting police chief for the City. Carpenter, Esq. 1 1 1 1 . 1 PARKING AND TRAFFIC MANAGEMENT PLAN Stillwater High School Stadium 1 March 2002 The following is the parking and traffic management plan for implementation at all events held at the Stillwater High School Stadium, located at 5701 Stillwater Boulevard 1 North, Oak Park Heights, Minnesota. • Section 1.Defined Terms. 1 "City" means the City of Oak Park Heights, Minnesota. 1 "District" means Independent School District No. 834. "Highly Attended Event" means, in the case of a Stadium Event, any event ' with attendance of over 3,000 persons. The District shall project which Stadium Events will be classified as Highly Attended Events by using the historical data of attendance at such events. Historically, based upon the attendance, the homecoming football game I would be considered a Highly Attended . Event. The District shall evaluate the attendance at other events to ascertain if any such other events will be considered Highly Attended Events. 1 "High School Property" means Stillwater High School property, located at 5701 Stillwater Boulevard North, Oak Park Heights, Minnesota. 1 "Non- Highly Attended Event" means, in the case of a Stadium Event, any event other than a Highly Attended Event. 1 • "Off -site Parking Lot" means any parking lot not located on the High School Property, as designated by the District from time to time, and approved by then acting police chief for the City, as an Off -site Parking Lot for the purpose of Stadium event parking. Unless another designation of a Shuttle Route is made in accordance with this Parking and Traffic Management Plan, the Off -site Parking Lots shall be as 1 shown on the attached Exhibit A. • "On -site Parking Lots" means the then existing parking lots located on the 1 High School Property. "Parking and Traffic Management Plan" means this parking and traffic 1 management plan, or such amended parking and traffic management plan as may be RB RIDER BENNETT ECAN &ARUNDEL • adopted from time to time hereafter, whether as a supplement to, or in replacement of this parking and traffic management plan. "Responsible Officials" means in each case (a) those officials employed 1 by the District, or by Stadium Event organizers or sponsors (in the case of events sponsored by other than the District), who are designated by the District, or such Stadium Event organizers or sponsors, as being responsible for supervising a Stadium Event; and (b) such law enforcement personnel as may be employed by the City and have authority under applicable law to exercise emergency powers to preserve or protect the safety, security and /or welfare of Stadium attendees. "Security Personnel" means those security personnel, if any, employed by the District, or by Stadium Event organizers or sponsors (in the case of events sponsored by other than the District), then located at the Stadium during a Stadium Event. "Shuttle Route" means, the route shuttle buses will take to drop-off and pick -up Stadium Event attendees, as designated by the District from time to time, and approved by then acting city administrator for the City, after consultation with the City's then acting police chief and city engineer. Unless another designation of a Shuttle Route is made in accordance with this Parking and Traffic Management Plan, the . Shuttle Routes shall be as shown on the attached Exhibit A. "Stadium" means the Stillwater High School Stadium, located on the High School Property. 1 "Stadium Event" means any formal event held within the Stadium, whether District sponsored or otherwise formally sanctioned or permitted by the District. • Section 2. Marketing /Parking Information. (a) Highly Attended Events. With respect to Highly Attended Events, the District, or Stadium Event organizers or sponsors (in the case of events sponsored by other than the District), shall implement such 1 marketing and parking informational strategies as the District or such Stadium Event organizers or sponsors deem reasonably prudent and effective to inform Stadium Event attendees of applicable event parking arrangements, including without limitation the following: (i) The prohibition against curbside or other parking in other than On -site and Off -site Parking Lots, together with such other parking restrictions related thereto as may be communicated by the City to the District from time to time; and RB RIDER BENNETT 810299 -4 2 EGAN&ARUNDEL 1 1 \,C 1 (11) The location of Off -site Parking Lots, the location of drop -off and pick -up sites, and the availability of shuttle bus I transportation services to and from the Stadium, and to encourage car pooling, and the use of such Off-site Parking Lots and shuttle services. 1 (b) Non - Highly Attended Events. With respect to Non - Highly Attended Events, the District, or Stadium Event organizers or sponsors (in I the case of events sponsored by other than the District), shall implement such marketing and parking informational strategies as the District or such Stadium Event organizers or sponsors deem I reasonably prudent and effective to inform Stadium Event attendees of applicable event parking arrangements, including without limitation the following: 1 (1) The prohibition against curbside or other parking in other than On -site and Off-site Parking Lots, together with such I other parking restrictions related thereto as may be communicated by the City to the District from time to time. (ii) Such other marketing and /or parking informational strategies I as the District deems appropriate under the circumstances. • (c) Illustrative Marketing And Parking Informational Strategies. Such I marketing and parking informational strategies may include any of such efforts as (1) newspaper and /or radio advertising, (ii) postings at District school, or such other organizer or sponsor, facilities, I (iii) District, or such other organizer or sponsor, website postings, (iv) informational flyers to District students and /or other prospective I attendees, (v) notifications to season ticket holders, (vi) informational notifications to school districts for visiting teams (in the case of game events) or otherwise to groups or entities I sponsoring or representing potential attendee groups (in the case of non -game events), or (vii) such other or additional strategies as the District, or such other organizer or sponsor, determines, from 1 time to time, to be useful and effective. Section 3. Intersection Traffic Management. The District, or Stadium Event I organizers or sponsors (in the case of events sponsored by other than the District), shall provide a minimum of four (4) Security Personnel for all home football games and all Highly Attended Events to perform the following duties with respect to traffic 1 management: (a) Security Personnel shall direct traffic at the following intersections 1 and parking lot entrances (or as needed at other locations): I R RIDER 3 a ENNETT 810299 -4 EGAN &ARUNDEL 1 • (i) TH 5/58 Street; (ii) 58 Street/Neal Avenue; (iii) the right -in /right -out entrance /exit on TH 5 servin g the westerly On -site Parking Lots; and • (iv) the easterly entrance /exit on 58th Street. (b) Except to the extent such duties are allocated to flag persons 1 performing parking lot management duties pursuant to Section 4 below, Security Personnel shall monitor the availability of parking spaces within the On -site Parking Lots and, as necessary, shall 1 close such On -site Parking Lots and post appropriate temporary signage at all On -site Parking Lots entrances and /or those intersections identified in (a) above, advising potential event 1 attendees when the On -site Parking Lots are full, and directing such potential attendees to any alternative Off -site Parking Lots. (c) Security Personnel shall communicate with each other to direct traffic as necessitated by variable traffic flow. Section 4. On -site Parking Lot Management. The District, or Stadium Event organizers or sponsors (in the case of events sponsored by other than the District), shall utilize flag persons for all Highly Attended Events to perform the following duties with 1 respect to On -site Parking Lot management: (a) Such flag persons shall work in coordination with Security Personnel performing traffic management duties in accordance with Section 3 above, to direct traffic flow within the On -site Parking Lots for all Highly Attended Events. 1 (b) Such flag persons shall monitor the availability of parking spaces within the On -site Parking Lots and, as necessary, shall close such On -site Parking Lots and post appropriate temporary signage at all On -site Parking Lots entrances and/or those intersections identified in Section 3(a) above, advising potential event attendees when the On -site Parking Lots are full, and directing such potential attendees to any alternative Off -site Parking Lots. Section 5. Off -site Parking and Shuttle Bus Services: The District, or Stadium Event organizers or sponsors (in the case of events sponsored by other than the District), shall provide off -site parking and shuttle bus services for all Highly Attended 1 Events as follows: (a) The District, or such organizers or sponsors, shall make available 1 to Stadium event attendees off -site parking in one or more of the lB RIDERBENNETT 810299 -4 4 ECAN &ARUNDEL 1 1 1 Off-site Parking Lots, and shall provide appropriate shuttle bus services between such Off -site Parking Lots and the High School ' Property, in connection with each Highly Attended Event. Except to the extent Shuttle Routes may not be accessible or otherwise • useable (e.g., road construction detours, obstructions due to ' accidents or other emergencies, etc.), Shuttle buses shall adhere to the Shuttle Routes. In each case, the number of required Off -site Parking Lots and shuttle buses shall be determined by the District, ' or such organizers or sponsors, in accordance with the District's, or such organizers' or sponsors', projections for Stadium event attendance and for Off-site Parking Lot usage. 1 (b) The District, or such organizers or sponsors, shall furnish one or more shuttle attendants at the High School Property shuttle drop off ' location(s), as shown on the attached Exhibit A, and /or at each Off -site Parking Lot used by the District, or by such organizers or sponsors, to direct the loading and unloading of shuttle buses. 1 (c) The District, or such organizers or sponsors, shall furnish one or more flag persons at each Off -site Parking Lot used by the District, or by such organizers or sponsors, to direct traffic flow within such On -site Parking Lot. (d) The District, or such organizers or sponsors, shall post appropriate temporary signage at each Off -site Parking Lot and shuttle drop off location used by the District, or by such organizers or sponsors, ' providing appropriate directional and /or other information for potential event attendees with respect to the availability and implementation of off -site Stadium Event parking and shuttle bus services. Section 6. Parking and Traffic Management Instruction/Training. 1 (a) The District shall provide instruction or training of Security Personnel and parking lot flag persons. 1 (b) In the case of Stadium Events other than District sponsored Stadium Events, the District shall furnish a copy of the Parking and Traffic Management Plan to the Responsible Officials designated by the sponsoring entity. ' (c) A copy of the Parking and Traffic Management Plan will be furnished to all Security Personnel. ' Section 7. Day Football Games and Highly Attended Events. Until such time as the District constructs Stadium lighting to enable it to hold lighted evening events at 1 B 5 RIDER BENNETT 8102994 EGAN&ARUNDEL • 1 the Stadium, all football games and Highly Attended Events to be scheduled during 1 daylight hours shall be scheduled not earlier than one (1) hour following the time by which the District projects that the On -site Parking Lots shall be reasonably cleared, subject to holdover parking by students, teachers and /or other District employees who may be intending to remain on the High School Property for purposes of attending such game or other event. , Section 8. Parking Fees: The District does not presently anticipate charging fees, or permitting the charging of fees by Stadium Event organizers or sponsors (in the case of events sponsored by other than the District), for parking in connection with any Stadium events. If the District desires to charge fees, or permit the charging of fees by such organizers or sponsors, for Stadium event parking in the future, the District will amend this Parking and Traffic Management Plan in accordance with Section 10 below. Section 9. Non - District Sponsored Events. With respect to Stadium events organized or sponsored by other than the District, the District shall coordinate with the applicable Responsible Officials to encourage and supervise implementation of the obligations and responsibilities allocated to such organizers or sponsors under this Plan, as applicable. Section 10. Amendments to Parking and Traffic Management Plan: The Parking and Traffic Management Plan may be modified from time to time upon the approval, or at the request, of the then acting city administrator for the City, after consultation with the City's then acting police chief and city engineer. We have had discussions with Paul Hoppe, the owner of the local satellite toilet company, to determine 1 the most appropriate way of securing the units to minimize vandalism (tipping, moving, etc.). He stated that toilet units are typically secured to chain link fencing with cable and locks. Generally, a maximum of two units are cabled together to eliminateexcessive slack in the cable. The cable is strung through the wood skids at the base of the toilet unit and through the fence. Keys are then held by school maintenance staff and the satellite toilet company. In connection with the foregoing, please find enclosed copies of email transmissions sent and received by India Boulton of our office to and from Scott D. McLellan of the State of Minnesota. Although we have had conversations with others within the State of Minnesota on this issue (all of which have been consistent with the information now furnished by Mr. I McLellan), we have focused our efforts to obtain clarification directly from Mr. McLellan as we understand that he is the person who had previously been in contact with the City staff on this matter. Mr. McLellan's comments pertain directly to the Minnesota Department of Administration, Building Codes and Standards Division, Policy No. PR -04 on the issue of "Required Plumbing Fixture?, a copy of which policy was previously furnished to the City. As I you will recall, that Policy provided in part as follows: The Division will recognize the use of the following to satisfy this requirement: a) permanent fixtures located either on site or available in an adjacent building; b) portable temporary fixtures that will be available on site during times when the bleacher 1 seating is in use. 1 1 1 • v • RYDER, BENNETT, EGAD.,,, t UNDEL, LLP •. ,./ 1 Ms. Kris Danielson • Mr. Scott Richards 1 April 26, 2002 Page 2 1 . . Confusion on this issue between the City and the District generally focused on whether items (a) I and (b) above were "alternatively" or "collectively" required in order to comply with State law. Mr. McLellan's responsive email makes it clear that such items are in fact "alternative" requirements. 1 As reflected in the enclosed entails, it is clearly the State's policy that the School District may satisfy the requirements for toilet facilities by either (a) providing permanent fixtures on site or in an adjacent building, oi (b) providing portable fixtures on site. Consequently, the District I will be in compliance with State law by furnishing only portable temporary toilets on site. It would be the District's intent to keep the school building locked and inaccessible for stadium I restroom use; provided, however, as Lyle Koski, the high school principal, indicated at the March 26, 2002 City Council meeting, the District would most certainly be willing to provide limited building access in unique situations where the circumstances indicated that an individual would not be able to use a portable facility. This is anticipated to be an infrequent occurrence. I While we recognize that there may remain some concern by the City over the lack of general access to the school building, I am advised by the District that there are a number of 1 compelling reasons which support this position. These reasons including the following: 1. Access to the school building poses significant security and vandalism issues both I on the school grounds and within the school building generally, as well as within the school building restrooms specifically. I 2. Granting access to the school building would require the District to implement a process for stamping hands, re- ticketing, or otherwise enabling stadium attendees to regain access to the stadium area after leaving the arca to use school building . restrooms. This would present serious control problems. I 3. These same drainage calculations were submitted to the Valley Branch Watershed District 1 and approved and permitted by VBWD on 3/28/02. The drainage calculations are acceptable as submitted. The school proposes to use two infiltration trenches and an infiltration basin on the west side I of the proposed home bleachers to handle the increased rate of storm water runoff, basically not increasing the storm water runoff rate by more than 2% for the 2, 10; and 100 -year storm events. We would not normally consider I infiltration into our more conservative storm water runoff modeling if this were to be a city -owned and maintained system, however, since these improvements will be privately owned and maintained and have been approved by the VBWD, the proposed improvements are acceptable. The school will need to maintain these trenches and basin on an on -going basis to assure infiltration is in fact occurring as modeled. As previously noted, the visitors bleachers are proposed to be constructed ' on top of an existing 15" storm sewer that is part of the school's privately owned and maintained football field /track storm sewer system. This storm sewer should probably be relocated around the proposed bleachers to avoid potential future maintenance issues. Dennis M.
