(Erickson Post, Inc.) Sign Permit Request BACKGROUND Application has been filed by Dependable Ford - Mercury, Inc. for construction of an additional sign on their premises. The proposed sign which is an illuminated double face, six by six (72 square feet) structure, is to be fourteen feet high. The sign is to identify a separate franchise for Scotti Mufflers. According to calculations supplied, the current operation has five primary signs constituting 796 square feet. These signs are identified by number which correspond to attached photos. 1. Bulkhead lettering 234 Square Feet 2. "Ford - Mercury Brand" 310 Square Feet 3. Used Cars 146 Square Feet 4. "Ford Trucks" 64 Square Feet 5. "Service" 42 Sqaure Feet It should be noted that these calculations have been supplied by the operator and have not been checked. In this regard, there is some question as to accuracy. The basis of the concern is that from a general visable inspection the "Used Cars" and "Ford Truck" signs appear to be the same size. The calculations supplied vary signifi- cantly. Also to be recognized is that there is substantial additional signing and advertising on the building. The attached photos, numbers 6 - 8, illustrate additional signing painted or attached to the building. Two large window advertisements are shown in photos 9 and 10. A final advertising devise are the banners or pennants which are strung along the front of the property. These can be seen in photos 1 through 5. Page Two 25 July 1977 REVIEW AND EVALUATION Signing within the community is governed by the zoning district classification appli- cable to the property in question. The current zoning of the Dependable Ford property is agricultural . Under consideration and scheduled for public hearing on 1 August 1977 is rezoning of the entire Summit Park area. At present the Dependable Ford property is proposed for "L -B" Limited Business use. Due to the anticipated change to a commercial zoning classification, the standards applied to business properties will be utilized in this review and evaluation. The standards from Sections 8.07 of the Zoning Ordinance are as follows: L. B. DISTRICTS Type: Business, identification, wall, roof, combination, ground, and pedestal . Number: One per principal entrance. Size:1 Not more than an aggregate total of forty (40) square feet per lot frontage. Height: No more than two (2) feet above highest outside wall of building. Projection: Any sign over five (5) square feet may project only two (2) feet into required yard area. Illumination: Illuminated but non - flashing signs permitted. R.B. DISTRICTS Type: Identification, business, wall, roof, combination, ground pedestal . Size: No combination of signs shall exceed fifty (50) square feet per lot frontage plus one (1) square foot for each 100 square feet of floor area over 3,000 square feet. (180 square feet maximum for overall shopping center sign.) Height: Not over six (6) feet above highest outside wall or parapet except that an overall shopping center sign may be 35 feet above average ro roof height. Projection: No sign over ten (10) square feet may project further than eight (8) feet into any required yard except than an overall shopping center sign may be located in any yard area but not within ten (10) feet of any street right -of -way line or within five (5) feet of any other lot line. Illumination: Illuminated and flashing signs permitted. • • Oak Park Heights Mayor and City Council Dependable Ford - Mercury, Inc. (Erickson Post, Inc.) 25 July 1977 Page Three As can be determined from the regulations which may be applied to the property, the L.B District would allow all signing to a maximum of only 40 square feet. An R -B District would permit a miximum of 204 square feet. In each case, the current signing which is estimated in excess of 1,000 square feet far exceeds that level which is permitted. As part of our evaluation of this request, we have also checked with a number of communities in the area which have major car dealerships within their jurisdiction. The communities consulted were Roseville, Golden Valley, St. Louis Park, Plymouth and Brooklyn Center. In the majority of cases consulted, the maximum number of business identification signs (similar to those identified in photos 1 through 5 or the sign which is requested) are limited by square feet but the number can not exceed two or three separate and individual signs. It should also be noted that in almost every specific dealership checked, the size of property was considerably greater than Dependables lot. Another consideration is the location of the proposed sign. It is to be sited along the front yard property line, in an alignment with the three existing free standing structures while the precise distances between the free standing signs has not been calculated. Another structure is considered to add only confusion to the situation. The objective of achieving communication of business or product is not seen as a result. A final consideration is that the "Scotti Muffler" sign requested is viewed as an advertising sign. It is questionable whether the ordinance should be waived on such a basis.
