Oak Park Heights, MN 55082 Re: Site Issues, including Wall Pack Fixture and Outside Storage Compliance Dear Mr. Leptein: Thank you for meeting with me this past Tuesday to discuss issues related to the Oak Park Heights Fred's Tire site. The primary focus of our meeting was to discuss two outstanding compliance issues: (1) The wall -pack Tight fixtures on the main building and the accessory building on site, and (2) Outside storage. Regarding Non - Compliant Lighting: We discussed full cut -off lighting requirements and possible remedies to the wall pack fixtures. You committed to addressing the necessary corrections by the end of the week. Regarding Outside Storage: Outside storage at this site is permitted only by conditional use permit per City Ordinance 401.30.E.5. City files document a request for and indicate the approval of a Conditional Use Permit for the placement of a 24' x 20' garage to the northeast corner of the property for tire storage, but NOT for outside storage. Accordingly any outside storage, including the outside storage container for used tires behind Fred's Tire is non - compliant with the requirements for outside storage as outlined in the B -2, General Business Zoning District. We also discussed enclosed trailer parking and storage of items on site (ie: portable sign, door frames and similar material at the rear of the building). You were advised that Fred's Tire would need to seek an amendment to its Conditional Use Permit and receive City Council approval in order to have compliant outdoor storage other than that of what is utilized in the garage on the property site. Thus, at this time, these uses are in violation of City Ordinance and are not permitted without an approved amendment to your Conditional Use Permit. Page 2 Enclosed with this letter is a Development Application for your use in seeking a Conditional Use Permit amendment for outside storage. If you would like to schedule a pre - application meeting one Wednesday morning, prior to 11 a.m., please contact me to arrange a date and time. At the culmination of our meeting, the City understands and anticipates the following: 1. That you will review the information provided to you and discussed and also inventory your site to ensure current compliance, taking any steps necessary to meet compliance; 2. That you will address corrections to the lighting at your site immediately including re- securing the Tamp on the pylon sign pole and correcting the wall -pack lighting fixtures on the main store building and the garage building to effectuate full -cut off. You are to communicate your method of full cut -off compliance prior to installation to ensure compliance; 3. That you will conduct a clean -up of outside storage items, such as the portable sign, construction and other material by the dumpsters and such; 4. That you will plan to move forward with obtaining a permit to replace one face set to the pylon sign with the understanding that no such permit shall be issued until the wall pack fixture compliance has been satisfactorily addressed; and 5. That no later than March 16, 2011 you will have commenced the process for an Amended Conditional Use permit for the outside storage of used tires by scheduling a pre - application meeting and /or by submitting your Development Application. However critically note that all final decisions are made by the City Council and is an application that may be denied. Per our follow -up phone conversation, you indicated that the site shall be cleaned up and lighting compliance met, including cut off shields placed internally to the globes effectuating full cut -off by the end of this week.
