Ranum Ranum Law Offices 104 North Main Street Stillwater, Minnesota 55082 Re: City of Oak Park Heights v. Jerry Bjorkman Dear Mr. Ranum: With regard to your correspondence of July 23, 2001, a copy of which I have received relative to this matter, I can certainly grant you an extension of time in which to place an Answer but would suggest that you have an Answer to me within the next week to ten days. The extension should not, and will not, be construed, however, as a delay consented to by the City of Oak Park Heights. The property in question is unquestionably hazardous to the public and we are not in a position to allow this matter to go later into the fall. Consequently, I will be notifying the Court that we have a contested case at this stage and will be preparing a Motion for Summary Judgment inasmuch as I do not believe and have not by informed by either yourself on behalf of your client or the insurance company of any cause as to why this property is not qualified as a hazardous property under the Statute under the present circumstances. Yours very truly, Mark J. Vierling MJV /dcb cc: Thomas Melena CO
