WITNESSETH; That: WHEREAS, the Developer has made application to the City Council for approval of a Planned Unit Development, Conditional Use Permit, Vacation of Right of Way, Preliminary and Final Plat affecting land within the corporate limits of the City described as follows: CARRIAGE HOUSE CO -OP AND ASSISTED LIVING Block 1, Lots 1 & 2, Outlots A and B See Attached Exhibit A (the "Subdivision "); and, WHEREAS, the City Council has on June 9th, 2010, granted approval to the Planned Unit Development, on the condition that the Developer enter into this Agreement stipulating the conditions for the installation of street, water, sewer and other public improvements as well as the development of on -site improvements hereinafter described, all in accordance with the terms and conditions hereinafter set forth. NOW, THEREFORE, in consideration of the premises and of the mutual promises and conditions hereinafter contained, it is hereby agreed as follows: Designation of Improvements: Improvements to be installed at Developer's expense by the Developer as hereinafter provided are hereinafter referred to as "Plan A & B Improvements ". 1. PLAN A & B IMPROVEMENTS: The Developer will construct at Developer's expense the following improvements under Plan A according to the following terms and conditions: A. The Developer shall do all site grading, common greenway and open spaces, storm water storage ponds, surface drainage ways and all private driveways including sodding of boulevards, all in accordance with the approved grading, drainage and site plan. A grading plan with maximum two (2) foot contours, pad elevations, drainage provisions, erosion control provisions and cross sections, as necessary, shall be submitted to and approved by the City kefit.A.Aev - Commercial Partners Title, LLC 200 South Sixth Street Suite 1300 Minneapolis, MN 55402 ' $ 1S z 6 et_ • prior to commencement of any site grading. Any changes to the grading plan during construction shall be submitted to the City for approval. Each building site must conform to the grading plan approved by the Building Inspector of the City of Oak Park Heights prior to a building permit being issued. B. The Developer shall control soil erosion ensuring: 1. All development shall conform to the natural limitations presented by the topography and soil of the subdivision in order to create the best potential for preventing soil erosion. The Developer shall submit an erosion control plan, detailing all erosion control measures to be implemented during construction, said plan shall be approved by the City prior to the commencement of site grading or construction. 2. Erosion and siltation control measures shall be coordinated with the different stages of development. Appropriate control measures as required by the City Engineer shall be installed prior to development and as may be necessary to control erosion. 3. Land shall be developed in increments of workable size such that adequate erosion and siltation controls can be provided as construction progresses. The smallest practical area of land shall be exposed at any one period of time. 4. Where the topsoil is removed, sufficient arable soil shall be set aside for respreading over the developed area. The topsoil shall be restored to a depth of at least four (4) inches and shall be of a quality at least equal to the soil quality prior to development. 5. The Developer shall not locate its equipment within the right -of -way of 58th Street as acquired by the City of Oak Park Heights adjacent to this development without the express written consent of the City Engineer. C. The Developer shall place iron monuments at all lot and block corners and at all other angle points on boundary lines. Iron monuments shall be replaced after all street and lawn grading has been completed in order to preserve the lot markers. D. The Developer shall be responsible for maintaining the location of and protecting curb stops, water services and sewer services. Any service or 2 - curb stop damaged shall be repaired or replaced as specified by the City. The Developer shall make all necessary adjustments to the curb stops to bring them flush with the topsoil (after grading) or driveway surface. E. The Developer shall be required to provide landscaping and screening as determined by the City and as required by the ordinances of the City. Final landscaping plans must be submitted to the office of the City Planner for approval . F. The Developer shall be responsible for street maintenance, including curbs, boulevards, sod and street sweeping until the project is complete. All streets shall be maintained free of debris and soil until the subdivision is completed. Warning signs shall be placed when hazards develop in streets to prevent the public from traveling on same and directing attention to detours. The repair of any damage done to the streets or public utilities by Developer or any of its Contractors or Subcontractors, shall remain the financial responsibility of the Developer. G. The Developer shall furnish site lighting in accordance with the City Ordinance requirements pursuant to a plan which must receive the approval of the City Planner. General Requirements: H. The Developer shall dedicate a reasonable portion of this proposed subdivision as the City Council reasonably determines to the public for public uses as parks, playgrounds, public open space, trails, or other conditions as required by the City and as shown on the final plat. In lieu of complete land dedication, Developer shall upon execution of this Developer's Agreement, pay a park dedication fee now prescribed by ordinance and/or resolution. The cash park dedication fee for this subdivision is in the amount of $241,440.00 for the affected portions of the plat that formerly lay within Baytown Township and were not included in prior plats.' I. The Developer shall dedicate and survey all drainage and storm water holding ponds as required by the City and to be shown on the final plat. The Developer shall be responsible for storm sewer cleaning and holding pond dredging, as required, by the City prior to completion of the development. The City of Oak Park Heights is requiring Developer to dedicate storm water 1 Portions of the platted area have previously paid park dedication fees. Those portions were excluded for the purposes of this computation 3 - Y drainage areas and holding ponds to serve Developer's project. Such areas are incorporated within the drainage easement depicted on the final plat and upon execution of this Development Agreement and the recording of the final plat conveyed to the City of Oak Park Heights. J. The Developer shall be responsible for securing all necessary approvals, PUDs, CUPs and permits from all appropriate federal, state, regional and local jurisdictions prior to the commencement of site grading or construction and prior to the City awarding construction contracts for public utilities. K. Drainage and utility easements. 10 foot drainage and utility easements shall be provided along all lot lines in within the platted area. L. Wetland Designation. All areas classified as wetlands shall be displayed upon the plat and those so specified by the City Engineer shall be dedicated to the public for that purpose. M. Tree Protection and Clearing: The Developer must have the City Arborist or a person under her designation providing on -site supervision and direction during the final clearing process. Prior to the clearing operation being initiated all clearing limits and trees to be protected shall be clearly marked. Tree protection fencing shall be installed and maintained until after grading is complete. All fencing shall be installed at least 20 feet distant from the trunks of large shade trees (deciduous) and around coniferous trees no closer than the drip line. Silt fencing may not be used as a substitute for tree protection fencing. Fencing shall be orange in color with steel posts at 6 -8 foot intervals. The City Arborist shall be contacted by Developer for an inspection after the fencing is installed. All tree replacement fees due the City pursuant to the City Tree Protection ordinance following shall be paid within 10 days following the Arborists certification of amounts due. O. Warranty of Title. By its execution hereof Developer hereby warrants and represents that it has the exclusive and marketable fee title to the subject property. Developer further warrants and represents that there are no liens or encumbrances against the title and that it is fully authorized to execute this agreement as the fee owner of the subject lands. P. Fire Hydrants. All fire hydrants throughout the development shall incorporate an AFC - Waterous Storz Nozzle. The hydrant pumper nozzle shall be of one -piece design, compatible with a five inch Storz hose coupling. The nozzle shall be 4 an integral part of the fire hydrants and must be furnished by the manufacturer or authorized distributor designated by the manufacturer. Storz adapters will not be accepted. All private fire hydrants shall be painted Red in color and shall be exclusively maintained by the Developer. Q. Utility Locations in City Right of Way. In order to maintain compliance with regulations promulgated from the Minnesota Office of Pipeline Safety the developer, its contractors , subcontractors, and agents shall comply with the following requirements: 1. All right of way work shall require an application with a plan that shall be submitted for city review prior to any work performed in the right of way areas. 2. The layout of utilities, including depths, off -sets and materials shall be documented during construction and confirmed with city staff during the installation process. 3. Single family residential lots are required to submit an accurate tie card showing the utilities installed and measurements from fixed objects (corner of house, fire hydrants, etc.) to the curb stop, location pins, clean outs and tie in points for all utilities. 4. Multi- family and commercial lots must provide, in addition to the above, professional as built drawings confirmed by field survey, showing the required information. In addition Engineering grade GPS coordinates in the Washington County coordinate system shall be supplied by the builder. These will allow the coordinates to be electronically incorporated in to future city mapping. 5. All installations will require pins be installed directly above all utility lines where they cross lot lines. A corrosion protected trace wire shall be installed six inches below final grade directly above all new utility installations at a minimum through the right of way. The trace wire and tail shall be terminated in a capped vertical conduit that is within two inches of the final grade and pin located at the lot line. 6. The Developer shall hold harmless and indemnify the City of Oak Park Heights from any and all loss or damage resulting from its failure to comply with these requirements including but not limited to expenses the City incurs in correcting errors in information provided by Developer its agents or contractors or remediating problems resulting there from in the right of way. 7. Upon failure to provide full documentation as required the City shall notify he Developer who shall have 30 days to secure full compliance. Failure to comply will result in the work being assigned by the City to an outside professional for completion of 5 the necessary work. Any costs incurred in resolving these requirements shall be assessed to the property or offset from security required under this agreement. 8. City staff shall document the time and materials required to review, confirm and accept the installation documentation and shall invoice Developer for the costs based on the actual work involved or on a fee schedule adopted by the City Council. P. Underground Installation of Electrical Distribution Lines. Pursuant to City ordinance Chapter 1008 all electrical distribution lines located or to be located upon the site shall be installed and maintained underground 2. Irrigation systems $14,000.00 2 The project construction items and costs therefore are based on estimate. Actual costs will vary and final approved plans and specifications will control over line items set forth above. Security releases will be adjusted based on actual costs incurred and may be adjusted from the estimates provided above. Partial security releases will be controlled by opinion and recommendation of the City Engineer. 6 r. Retaining Walls $7,500.00 TOTAL ESTIMATED CONSTRUCTION COST OF PLAN A IMPROVEMENTS: $404,630.00 ESTIMATED ENGINEERING, LEGAL AND ADMINISTRATIVE (20 %): $80,926.00 SECURITY (25 %) $121,390.00 Total Plan A Security $606,945.00 3. CONSTRUCTION OF PLAN A & B IMPROVEMENTS. A. Construction. The construction, installation, materials and equipment shall be in accordance with the plans and specifications approved by the City. B. Inspection. All of the work shall be under and subject to the inspection and approval of the City and, where appropriate, any other governmental agency having jurisdiction. C. Easements. The Developers shall dedicate to the City, upon approval of the final plat, at no cost to the City, all permanent or temporary easements necessary for the construction and installation of the Plan A and Plan B Improvements as determined by the City. All such easements required by the City shall be in writing, and in recordable form, containing such terms and conditions as the City shall determine. If within the platted area, all such easements shall be dedicated to the City and specifically described within the Plat. As it affects all easements located outside the platted area, the same shall be dedicated by separate easement conveyed to the City of Oak Park Heights prior to the execution of the Development Agreement. D. Faithful Performance of Construction Contracts. The Developer will fully and faithfully comply with all terms and conditions of any and all contracts entered into by the Developer for the installation and construction of all Plan A & B Improvements and hereby guarantees the workmanship and materials for a period of one year following the City's final acceptance of the Plan A & B Improvements. Concurrently with the execution of this Agreement, Developer or its general contractor shall provide a Letter of Credit to the City of Oak Park Heights in a form to be approved by the City Attorney, 1 j guaranteeing the performance by Developer of the construction of the Plan A & B Improvements in a timely and proper manner. Additionally, Developer guarantees and agrees that, should the City of Oak Park Heights need to apply a claim on said Letter of Credit, that Developer shall pay all attorney's fees and administrative expenses associated with said action. E. That prior to the Developer ordering the installation and awarding the contracts as it relates to the Plan A improvements and the costs therefor, the Developer shall deposit with the City of Oak Park Heights, the total estimated cost of the Plan A & B improvements $606,945.00 in the form of a letter of credit to be approved by the city attorney. The City may pay from said deposit all expenses related to the construction of the Plan A & B improvements providing for the construction of same in the event of Developer's default: F. Ownership of Plan A & B Improvements. All such improvements as constructed, excepting those improvements approved by the city and located within public rights of way shall become the property of the Developer. The Developer shall dedicate to the City prior to approval of the final plat at no cost to the City all permanent and temporary easements necessary for the construction of the public improvements as determined by the City. Street systems internal to this development shall remain private streets as shall internal water and sewer distribution lines. Storm water ponds are public and part of the city's storm sewer systems. Storm water collection systems are private improvements. G. Construction schedules. All schedules for construction of the Plan A and B improvements shall be subject to the approval of the City Engineer. Failure to construct the improvements pursuant to the schedules so established shall constitute a condition of default H. Connection Charges All connection charges and fees shall be paid by Developer. The City Engineer shall compute the connection fee as prescribed by ordinance /resolution as to this development and advise the City Clerk as to the appropriate fee to be collected. Connection fees for all lots and blocks are due and payable upon execution of this agreement and are as follows: 3 As with Park Dedication Fees some portions of the property have already paid connections fees others being the former Baytown home sites have not. These calculations include only those sites not having paid the connection fees. a Sanitary Sewer $ 17,447.56 Water $ 90,664.73 Storm Sewer $ 6,352.45 The City reserves the right to modify or adjust the manner of computation of connection fees from time to time which may adjust or increase the connection fees on the outlots at such time as they become due. I. EMS services and 911 calls (a) Emergency Services via Bayport Fire Department. At such time when the Development exceeds 5 percent of all City emergency calls responded to by the Bayport Fire Department (including fire, good intent, false alarm and EMS /rescue, etc but excluding calls to the Boutwell's landing campus)), the Developers shall make an annual payment to the City an amount equal to the cost impact the Development has on the City's cost contribution to the Bayport Fire Department for services over the 5 percent. (b) Billing. The City will directly bill the Developers after the City determines the annual use generated by the Development and its impact on the City Fair Share Formula or other future contribution protocol. The City will determine annual use at the Development based on information provided by the Bayport Fire Department `actual -run' data or other reliable source data. (c) Change of Fire/EMS provider to City. Should the City's relationship with the Bayport Fire Department and/or is financial relationships substantially change, the City reserves the right to amend this language as may be needed to compensate for new Fire and/or EMS service vendor costs. (d) Disclaimer. While it is anticipated that the City can provide adequate emergency responses to the Development, the City does not guaranty that it has adequate resources to respond to all emergencies or provide same in perpetuity. The City further indicates to the Developers that it should consider the implementation of necessary "on- site" staff and other emergency mitigation resources so that emergency EMS /Rescue calls could be handled internally and directly with appropriate health care providers and potentially deleting the need of the City responses. 9 J. NEIGHBORHOOD NOTICES. Developer shall notify neighboring owners within 500 feet of the development of times and dates of construction taking place within the public rights of way and any detouring that will be implemented to reroute traffic during that construction. K. MARKETING NOTICES. Developer will notify all purchasers of its housing units of the possible reconstruction of TH 36 and the St. Croix River crossing and its projected impact on Oakgreen Ave adjacent to this development should that project ever be built by the Minnesota Department of Transportation. 5. CASH ESCROW ACCOUNT. The Developer shall provide a cash escrow account to the City of Oak Park Heights in the amount of $20,000.00 to reimburse the City of Oak Park Heights for previous billed expenses relating to this development. 6. COUNCIL IMPOSED CONDITIONS: The following conditions have been imposed by the City Council on this development and must be satisfied in order to obtain initial and or final permits: 1. The preliminary and final plat shall be approved by the City Engineer and City Attorney. The plat shall dedicate the right -of -way for Oakgreen Avenue. 2. The applicant shall provide a graphic indicating which easements shall be vacated as part of the process, subject to review and approval of the City Engineer and City Attorney. 3. The City Council is favorable to the proposed setbacks as part of the approval process for the PUD. 4. The traffic numbers are subject to review and approval of the City Engineer. 5. All tree removal and landscape plans shall be subject to review and approval of the City Arborist. 6. The grading and drainage plans shall be subject to City Engineer and applicable watershed authority review and approval. 7. The Fire Marshal and Police Chief should review the plans and determine the accessibility of emergency vehicles throughout the development. 10 J M 8. The City Council is favorable to the proposed private and public trail system. 9. All utility plans shall be subject to review and approval of the City Engineer. 10. The site plan shall be revised to indicate 28 proof of parking stalls in addition to the stalls provided. The plans for proof of parking shall be subject to the review and approval of City staff and the City Engineer. 11. The trails and sidewalks shall be constructed in accordance with the City Engineer's review and approvals. 12. The City Council is favorable to the final building plans. The applicant shall provide a materials board for both buildings to be discussed at the City Council meeting. 13. The City Council is favorable to the conditional use permit for the building height. 14. The snow storage area shall be subject to review and approval of the City Engineer. 15. All lighting fixtures shall be full cut off and the maximum height of all freestanding light fixtures shall be no more than 25 feet. 16. The City Council is favorable to the use of bollard light fixtures if thy include an internal cut off fixture. The lighting for the monument signs shall be compliant with the Zoning Ordinance and be subject to review and approval of City staff 17. The site plans shall be revised to include electrical transformers subject to review and approval of City staff 18. The applicant shall supply the homeowner's association documents as required by the City Attorney for review and approval. 19. The applicant is required to enter into an amended development agreement with the City in a form acceptable to the City, subject to the review and approval of the City Attorney. 20. The applicant has indicated in his application for Tax Increment Financing (TIF) that this project will not move forward without TIF approval. The approval of the planned unit development is contingent upon approval of the TIF. 21. All existing wells shall be capped and septic systems removed in accordance with State and local requirements subject to review and approval of the City Engineer. 11 � r 22. Maintenance of the fence, and any retaining wall structures, along the 58th Street trail shall be the responsibility of the applicant and any subsequent cooperative / association. 22. Any other conditions of City staff and the City Council. 7. GENERAL: A. Binding Effect. The terms and provisions hereof shall be binding upon and inure to the benefit of the heirs, representatives, successors and assigns of the parties hereto and shall be binding upon all future owners of all or any part of the Subdivision and shall be deemed covenants running with the land. References herein to Developer, if there be more than one, shall mean each and all of them. The Agreement, at the option of the City, shall be placed on record so as to give notice hereof to subsequent purchasers and encumbrances of all or any part of the Subdivision and all recording fees, if any, shall be paid by the Developer. B. Final Plat Approval. The City has given final approval to the plat of OAKGREEN VILLAGE AND CARRIAGE HOUSE COOPERATIVE upon execution and delivery of this Developer's Agreement and the Planned Unit Development Agreement and Conditional Use Permit Agreement, and of all required documents and security, subject to compliance with the Ordinances of the City and terms and provisions hereof, permits may be issued by the City. C. Incorporation of Reference. All plans, special provisions, proposals, specifications and contracts for the improvements furnished and let pursuant to this Agreement shall be and hereby are made a part of this Agreement by reference as fully as if set out herein in full. Specifically the following Planning Reports and Engineering files and final documentation approved by the City Planner and the City Engineer are specifically incorporated by reference herein and included herein as if originally made part of this agreement. May 6, 2009 Planner report with attachments July 16, 2009 Bonestroo report July 22, 2009 Arborist report (e -mail) 12 D. P.U.D. Permit. The City of Oak Park Heights shall file the Planned Unit Development Permit of record in the office of the County Recorder. Providing that the Developer is not in default under the terms of the Development Agreement, the City shall provide appropriate releases to the financial aspects of same and documentation to individual buyers of lots. E. Administrative and Miscellaneous Expenses. As to any and all administrative, legal or engineering costs which the Developer is expected to pay to the City of Oak Park Heights, which costs may be offset against the Performance Bond which the Developer has filed and provided to the City of Oak Park Heights, the Developer shall be given the opportunity to review and comment on such costs prior to the application by the City of Oak Park Heights to the bonding company for the payment of same. Should the Developer dispute the reasonableness of any of the City's charges, Developer shall have the right to submit any such dispute to arbitration at Developer's sole and exclusive expense. Arbitration shall be conducted by the American Arbitration Association and shall be initiated and paid for by Developer. F. Establishment of Construction Schedules. The City Engineer shall control construction schedules for Plan A and Plan B improvements and shall consult with Developer prior to establishing same. G. Zoning. Oakgreen Commons and Carriage House Cooperative PUD/ Addition has been designated a zoning classification of PUD by the City Council. All future use and development shall comply with the applicable provisions of this Developer's Agreement and the relevant zoning ordinance of the City of Oak Park Heights relating thereto. All Outlots remain zoned "0" Open Space — conservancy until building permits are issued therefore. H. Street Grades. The grades of all private and public streets shall not exceed 8% and the minimum grade shall not be less than .5 %. J. Phase I Development. Developer's Development is approved for Phased development upon schedules established and approved by the City Engineer. K. Handicapped Parking. Location of disability/ handicapped stalls shall be made more efficient with regard to serving all of the areas of the proposed facilities. All disability stalls currently shown as 13 oriented to the north half of the parking lot directly across from the grocery store will be re- distributed throughout the entire parking complex to provide reasonable handicapped access throughout the development. The applicant will be required to demonstrate within the site plan and provide, at a minimum, four disability stalls in the southern half of the parking lot across from the retail strip center. L. Landscaping. A final landscaping plan shall be developed and submitted to the City Planner by Developer. In addition modifications to the landscape plan may be implemented subject to approval by the City Planner. Arborist and Administrator. M. Trash Receptacles. Trash receptacle areas must been designated on the site plan for the each building. All tenants of the building will be required to utilize these trash receptacles or will be required to store trash internally. N. Lighting. Developers must submit a lighting plan to the City Council. A photo- metric lighting plan shall be submitted and subject to review and specific approval of City Staff and City Council. All lighting shall be hooded and controlled so as not to direct light source to adjacent lands and not to be visible from the public right - of -way or from adjacent properties in compliance with Section 401.15B.7 of the Zoning Ordinance. O. Signage. A master signage plan shall be developed by the Developers and submitted to the office of the City Planner for approval. All signage shall be conformed to the master signage plan so approved by the City Planner. P. Landscaping Plan. Any changes to the submitted landscape plan resulting from changes to the stormwater ponding areas shall be subject to review and approval of the City Council. Q. Indemnification: To the fullest extent permitted by law, the Developers shall indemnify and hold harmless the City of Oak Park Heights, its agents and employees from and against any and all claims, damages, losses or expenses, including but not limited to attorney's fees, arising out of the issuance of this Developer's Agreement by the City of Oak Park Heights and/or arising out of the performance or non - performance of its obligations hereunder by Developer. 14 8. Notice/Remedies on Default or Violation of this Agreement 1. Except as otherwise provided in this Agreement, if the Developer fails to cure the event of default or failure to perform within 10 days after the date of the mailed notice or fails to undertake said cure and diligently pursue the same if it cannot reasonably be done within said 10 day period, in addition to any other remedy provided in this Agreement and without waiver of any such right, the City may, after providing written notice of default to the Developer, avail itself of any or all of the following remedies for as long as the Developer and/or any other Lot Owner is in default. a. Halt all plat development work and construction of development improvements on the Lot of the defaulting Lot Owner until such time as the event of default is cured. b. Apply on security provided and complete those items of work remaining to be completed. 15 c. Refuse to issue building permits or occupancy permits as to the Lot of the defaulting Lot Owner until such time as the event of default is cured. d. Apply to a court of competent jurisdiction to enjoin continuation of the event of default. e. If the event of default is a failure of the Developer to complete, construct, install or correct the Plan A Activities or the Plan C Improvements in accordance with the plans and specifications under this Agreement, the City may perform such construction or work and the Developer shall reimburse the City for its out of pocket expenses incurred. This provision shall be a license granted by the Developer and/or any other Lot Owner to the City to so act, but shall not require the City to take any such action. A PUD concept plan application for two 48 unit senior cooperative rental buildings, referred to as the Carriage House Cooperative, was filed in July 2008. The project was to be constructed in two phases and is located near the intersection of 58 Street North and Oakgreen Avenue. The City Council approved the PUD concept plan at their August 26, 2008 meeting. In October 2008, the applicant submitted a PUD general plan request to allow the construction of the first phase of the Carriage House Cooperative. The applicant withdrew this request prior to the Planning Commission public hearing. The applicant is now proposing a general plan approval for the 48 unit Carriage House Cooperative building at the corner of Oakgreen Avenue and 58 Street. The second building, the Oakgreen Commons, is a 110 assisted living facility and is to be constructed north of the Carriage House Cooperative on Oakgreen Avenue. See materials submitted as part of the request for Tax Increment Financing. Comprehensive Plan. A Comprehensive Plan amendment was approved in July 2005, removing the Central Business District (CBD) designation and replacing it with a commercial land use designation. The current draft Proposed Land Use Map of the 2008 Comprehensive Plan designates this area for medium density residential. The Land Use Map would be changed in the final draft of the Comprehensive Plan to indicate this area as high density residential if the project moves forward. Zoning. This property has been designated as B -4, Limited Business which accommodates residential development as a conditional use. As such, the underlying base zoning district will be B -4, Limited Business with a PUD overlay. The B -4, Limited Business District lists two family, townhomes and multiple family dwellings as a conditional use. The project is being developed as a planned unit development. Subdivision. A preliminary plat was submitted as part of this application. Lot 1, Block 1 will be created for the Carriage House Cooperative and Lot 2, Block 1 is created for the Oakgreen Commons. Outlot A will be established as the common area. With removal of the townhome at 13930 Lower 59 Street, Block 15, Lot 4 of the Oakgreen Village plat would be incorporated into Lot 2 for the Oakgreen Commons project. The appropriate drainage and utility easements would also be vacated as part of this process. The applicant shall provide a graphic indicating which easements will be vacated as part of this process. The preliminary and final plat, as well as the vacation of easements, shall be subject to review and approval of the City Engineer and the City Attorney. Park Dedication. Park dedication has been satisfied for this area. The applicant paid the maximum percentage (14 %) of equivalent cash value as part of the original approvals in 2006. Project Density. Section 401.15.C.3 of the Zoning Ordinance establishes the density thresholds for residential properties. Two family dwellings require 6,000 square feet of lot area per dwelling unit. Townhomes require 4,000 square feet of lot area per dwelling unit. Multiple family units with one or two bedrooms require 2,500 square feet per dwelling unit. 3 The total development area for Phase 1 to include Oakgreen Village and the Oakgreen Ponds as well as Phase 2 to include the Carriage House Cooperative and Oakgreen Commons is 781,699 square feet. The resulting density calculations are as follows: Twinhomes: 7 X 6,000 square feet = 42,000 square feet Townhomes: 49 X 4,000 square feet = 196,000 square feet Multiple Family: 158 X 2,500 square feet = 395,000 square feet 633,000 square feet The development requires at least 633,000 square feet. With a total of 781,699 square feet, the project is well within the density requirements of the Zoning Ordinance. Proposed Street/Access. Access for the Carriage House Cooperative and Oakgreen Commons would be from Lower 59 Street and Upper 58 Street, the two private streets that are accessed off of Nova Scotia Avenue North. The streets would end in a parking lot with separate turnarounds in front of each building. A driveway provides access to the two underground parking areas. There would be no direct access allowed from 58 Street or from Oakgreen Avenue. The plans also include the 50 foot right -of -way dedication for Oakgreen Avenue, as required by the City Engineer. This dedication has been indicated on the preliminary/ final plat. Please note that the plans also indicate the future MnDOT alignment of the Oakgreen /Highway 36 intersection as currently planned. Setbacks. Within a PUD, the base district setback requirements (R -3) are applied only to the perimeter of the project. The R -3 District specifies setback requirements as follows: 30 feet front yard, 30 feet rear yard, and 20 feet side yard. If the lot is on a corner, not less than 30 feet from a lot line is required for side yards. The PUD section of the Zoning Ordinance specifies that buildings should be located at least 20 feet from the back of a curb line from roadways as part of the internal street pattern. Additionally, the ordinance specifies that no building within the project shall be nearer to another building by one -half the sum of the building heights of the two buildings. In its approval of the concept plans for the Carriage House Cooperative in August 2008, the City Council specified that the buildings maintain a 30 foot setback to 58 Street and a 20 foot setback to Oakgreen Avenue. The Carriage House Cooperative building is set back 32.5 feet to the property line on 58 Street North and 25.5 feet to the Oakgreen Avenue right -of -way. The Oakgreen Commons building would be a minimum of 40 feet from the Oakgreen Avenue property line. From the curb of 58 Street, the Carriage House Cooperative building would be 41.2 feet and from Oakgreen Avenue, it would be 66 feet. The Oakgreen Commons building would be 79.4 feet from the edge of Oakgreen Avenue. Recognizing that the Oakgreen Commons building would be four stories with a gable roof, staff worked with the applicant to provide as much setback from Oakgreen Avenue as possible. As a result, the applicant decided to remove one of the existing townhome units (13930 Lower 59 Street) and move the building further west on the site. The two 4 buildings will be closer than one -half the sum of the building heights of the two buildings. That is addressed as part of the PUD approvals and building height conditional use permit. All of the parking lot and driveway setbacks are within the requirements of the Zoning Ordinance and PUD. The Planning Commission and City Council should discuss the proposed setbacks as part of the approval process. Traffic. The applicant has provided projected vehicle count information for the proposed development in the Traffic and Street Sign Plan (Exhibit 10). The traffic numbers are subject to review and approval of the City Engineer. Tree Preservation /Landscaping. The applicant has provided tree removal plans and detailed landscape plans for both buildings and the surrounding area. The City Arborist has done a review of the project and has provided comments. All tree removal and landscape plans shall be subject to review and approval of the City Arborist. Grading and Drainage. Grading and drainage plans have been submitted. The grading and drainage plans shall be subject to City Engineer and applicable watershed authority review and approval. Utilities. A utility plan has been submitted. The utility plans shall be subject to City Engineer review and approval. Parking. The Zoning Ordinance requires the following for elderly housing: "m. ' Elderly (Senior Citizen) Housing. Reservation of area equal to one (1) parking space per unit. Initial development is, however, required for only one -half (1/2) space per unit and said number of spaces can continue until such time as the City considers a need for additional parking spaces has been demonstrated." The Carriage House Cooperative is planned with a total of 48 units. The lower level parking area will have a total of 63 parking stalls, six of which are disability accessible. The Oakgreen Commons building will have a total of 110 dwelling units. The lower level parking has a total of 29 spaces of which two are disability accessible. There are 48 surface parking stalls, four of which are disability accessible also planned. With a total of 140 stalls, and 158 dwelling units, the project does not comply with ordinance standards for parking. The site plan will need to be revised to show 18 proof of parking stalls in addition to the stalls provided. Trails /Sidewalk. The plans indicate a trail to be constructed on the north side of 58 Street to Nova Scotia. Additionally, a trail would extend along Oakgreen Avenue from 58 Street to the existing trail in the Xcel power line easement. A significant number of private sidewalk connections have also been shown throughout the project. The trail system is subject to review and approval of the City Engineer. The Engineer has made 5 specific comments about the crosswalk and pedestrian ramps at 58 Street and Oakgreen Avenue. Architectural Appearance. The application materials include building elevations and color elevations of the two buildings in the project. Both buildings will feature brick exteriors and lap siding with porches and other architectural detailing. The roofs will be asphalt shingles and the siding will be a cement board such as Hardi - Plank. The Planning Commission and City Council should comment in general on the building plans. The applicant shall provide a materials board for both buildings to be discussed at the meetings. Of note, the Planning Commission and City Council may want to comment on the long horizontal roof expanses and ways to break up the appearance of the roof on the Oakgreen Commons building. Building Height. Section 401.301.E.10 of the Zoning Ordinance allows building heights in excess of three stories or 35 feet within the B -4 Zoning District as a conditional use. Staff had advertised this for a variance, but has since realized that the proposed height of the Oakgreen Commons building can be pursued as a conditional use permit as part of the PUD. The Oakgreen Commons building is proposed at 49 feet, 2 inches at the midpoint of the highest gable and is four stories in height. The Carriage House Cooperative building will be 25 feet, 5 inches to the mid point of the gable and is two stories in height. The Carriage House Cooperative building is well within the allowances of the 35 foot height limit. Review of the conditional use permit for building height is as follows: a. The site is capable of accommodating the increased intensity of use. Comment: The site is adequate for the two buildings and the project exceeds density requirements. b. The increased intensity of use does not cause an increase in traffic volumes beyond the capacity of the surrounding streets. Comment: The existing roadway network will be able to handle the traffic. c. Public utilities and services are adequate. Comment: The utility and service capacity is adequate for this development. d. For each additional story over three (3) stories or for each additional ten (10) feet above thirty -five (35) feet, front and side yard setback requirements shall be increased five (5) feet, except for elderly public housing. Comment: Not required — elderly housing. 6 e. The provisions of Section 401.03.A.8 of this Ordinance are considered and satisfactorily met. Comment: The health, safety and welfare issues have been addressed and there should be no negative impacts. Trash /Recycling. All of the trash storage and recycling will be internal to the buildings. The design of the driveway accommodates roll out containers for pickup. Snow Storage. The plans indicate an area for snow storage. The City Engineer should comment on the adequacy of this area. Signage. The plans indicate three monument signs for the project. There would be a sign at the corner of 58 Street and Oakgreen Avenue that would feature both the Carriage House and the Oakgreen Commons. The other two monument signs are located in the landscaped areas in front of each of the two buildings. The two monument signs in the front of the buildings are approximately 30 square feet each. The development sign at the corner is about 40 square feet. The signs are less than eight feet in height and are appropriately landscaped. There are no wall signs proposed. The sign plan is consistent with the requirements of the Zoning Ordinance. Mechanical Equipment. The applicant's architect has indicated that the mechanical equipment is located within the buildings. The plans should be revised to include the locations of electric transformers. Lighting. The freestanding driveway and parking lot lights are consistent with the features that have been installed in Oakgreen Village. The fixtures are full cut off. They shall have a maximum height of 25 feet to the top of the fixture and pole. The building lights are also designed to be full cut off and are compliant. The applicant has proposed bollard lights in four locations on the site to provide pathway lighting. The bollard fixtures are not full cut off. The lighting would assist the elderly residents in those areas where the other fixtures do not provide illumination. The Planning Commission and City Council should comment on the use of bollard fixtures. A photometric plan has been submitted with the application materials. The lighting plan would comply with requirements for intensity of lighting. B -4, Limited Business Standards. Section 401.301.E.9 of the Zoning Ordinance provides the CUP standards for allowing residential use in the B -4 District. The standards are as follows: Two family, townhomes and multiple family dwellings provided that: a. At least two parking spaces per unit must be provided for on site, or proof is shown of arrangements for private parking nearby. 7 The development will need to comply with the specific Zoning Ordinance requirements for senior housing. The plans shall be revised to indicate at least 18 proof of parking stalls. b. No physical improvements, either interior or exterior, may preclude future re -use for commercial purposes. The development could be converted to future office use, but highly unlikely. c. Unit floor areas must comply with Section 401.15.C.6. All of the units are at least 600 square feet for one bedroom and 720 square feet for two bedrooms as required by the Zoning Ordinance. d. Compliance with conditional use requirements of Section 401.03.A.8. The requirements will be complied with. e. The development does not conflict with existing or potential future commercial uses and activities. There would be no conflict. f. The density, setbacks, and building height standards imposed as part of the R -3 Zoning District are complied with. The building setbacks are consistent with the requirements set by the City Council with the concept plan approvals. g. Adequate open space and recreational space is provided on site for the benefit of the occupants. Adequate open space is provided. h. The development does not conflict or result in incompatible land use arrangements as related to abutting residential uses or commercial uses. No incompatible land use arrangements are created. Residential use can be governed by all applicable standards of the Zoning Ordinance, Building Code, Housing Code and Fire Codes. All standards will be complied with. j. Residential and non - residential uses shall not be contained on the same floor. Not applicable. 8 k. Residential uses shall be provided with a separate entrance, and separately identified parking stalls. Not applicable. The architectural appearance, design and building materials of residential structures shall be consistent with the Design Guidelines and subject to approval of the City Council. The Planning Commission and City Council should comment on the architectural appearance. RECOMMENDATION / CONCLUSION Based upon the preceding review, City staff recommends that the request for a general plan approval of the 48 unit Carriage House Cooperative building, concept and general plan approval for the 110 unit Oakgreen Commons, preliminary and final plat, and building height conditional use permit subject to the following conditions: 1. The preliminary and final plat shall be approved by the City Engineer and City Attorney. The plat shall dedicate the right -of -way for Oakgreen Avenue. 2. The applicant shall provide a graphic indicating which easements shall be vacated as part of the process, subject to review and approval of the City Engineer and City Attorney. 3. The Planning Commission and City Council shall discuss the proposed setbacks as part of the approval process for the PUD. 4. The traffic numbers are subject to review and approval of the City Engineer. 5. All tree removal and landscape plans shall be subject to review and approval of the City Arborist. 6. The grading and drainage plans shall be subject to City Engineer and applicable watershed authority review and approval. 7. The Fire Marshal and Police Chief should review the plans and determine the accessibility of emergency vehicles throughout the development. 8. The Planning Commission and Park Commission should comment on the proposed private and public trail system. 9. All utility plans shall be subject to review and approval of the City Engineer. 9 10. The site plan shall be revised to indicate 18 proof of parking stalls in addition to the stalls provided. 11. The trails and sidewalks shall be constructed in accordance with the City Engineer's review and approvals. 12. The Planning Commission and City Council shall comment on the final building plans. The applicant shall provide a materials board for both buildings to be discussed at the Planning Commission and City Council meetings. 13. The Planning Commission shall make a recommendation and the City Council make a determination on the conditional use permit for the building height. 14. The snow storage area shall be subject to review and approval of the City Engineer. 15. All lighting fixtures shall be full cut off and the maximum height of all freestanding light fixtures shall be no more than 25 feet. 16. The Planning Commission and City Council should comment on the use of bollard light fixtures. 17. The site plans shall be revised to include electrical transformers subject to review and approval of City staff. 18. The applicant shall supply the homeowner's association documents as required by the City Attorney for review and approval. 19. The applicant is required to enter into an amended development agreement with the City in a form acceptable to the City, subject to the review and approval of the City Attorney. 20. The applicant has indicated in his application for Tax Increment Financing (TIF) that this project will not more forward without TIF approval. The approval of the Planned Unit Development is contingent upon approval of the TIF. 21. Following are our comments /recommendations for your consideration. Sheet C1.1 1. Show the locations of the existing wells and spetics for the homes along Oakgreen Avenue. Sheet C1.2 1. Attached is the record plan for the utility improvements on Oakgreen Avenue N. The following information is needed for the removal plan: a. The existing 8" water has an 8" x 6" tee for the hydrant lead and not a 6" reducer as shown on the drawings. b. There is a 4" PVC sanitary sewer stub that was installed south of the hydrant. This stub should be removed to the wye and plugged at the main line. 2. The existing hydrant and 8" x 6" tee on Oakgreen Avenue N. shall be salvaged and delivered to the City of Oak Park Heights Public Works department. 3. Full width removal and replacement of the bituminous pavement on Oakgreen Avenue N. should be shown at the connection to the existing sanitary manhole. The typical section on Oakgreen Avenue N. is as follows: 2" MVWE35035E 3" MVNW35035B 8" Class 5 24" Aggregate Backfill 4. Show the removal /abandonment of the sanitary and water service for the townhome that is being razed. St. Paul St. Cloud Rochester Milwaukee Chicago Engineering Planning Innovation Sheet C2.2 1. The pedestrian ramp at 58 Street N. and Oakgreen Avenue N. should be directed to the south. On the south side of 58 Street N. a pedestrian ramp should be added that faces to the north. In addition, a zebra striped cross walk and pedestrian crossing signs should be added at this crossing. 2. It is not recommended to have parking stalls directly accessing the through roadway. Sheet C3.1 1. The west 941 contour along Oakgreen Avenue should be extended south by approximately 30'. The existing 941 contour is in conflict with the proposed 942 contour. 2. On the east side and southwest areas of the property the grading will impact the existing trees. Will the trees survive these grading limits? 3. On the north side of the property there is a ten foot high hill at a 3:1 slope that is directly adjacent to the existing trail. Incorporate a design that will ensure permanent erosion control on the slope and over the trail. Sheet C3.2 1. For pedestrian and bicyclist safety, a fence is required at the top of the boulder retaining wall. 2. To keep storm water /snowmelt from discharging directly over the path it is recommended that the path and boulevard be sloped a minimum of 2% towards the street. 3. Detailed design drawings and calculations for the retaining walls signed by an engineer licensed in Minnesota shall be submitted to the City for review and approval prior to construction. 4. The wall will be sitting directly on top of an existing 30" RCP storm sewer. Bridge the wall over the pipe. Sheet C4.1 1. The attached record drawings for Oakgreen Avenue N. shows an invert on the existing sanitary manhole at 923.61. It is recommended that the sewer line enters at the bottom of the structure and the invert of the structure be reconstructed. 2. For your information there is an 8" steel gas main in the west boulevard along Osgood Avenue. You may want to identify this main with a "Caution" note at the sanitary service /gas main crossing and at the connection to the water main. 3. Insulation shall be placed at all water main /storm sewer crossings. 4. At CB119 there are storm sewer pipes that extend into both buildings. What is the pipe material, size and invert? Do these pipes connect to something? 5. Verify with the Director of Public Works that HDPE flared ends sections are acceptable within the City maintained ponds. Preliminary Plat 1. Show /define the easement required for the bituminous pathway along the north side of 58 Street north. General items to submit for review 1. The detail plates need to be submitted for review. 2. Species - these are basically the same as in the previous landscape plans and are acceptable, many being native species (or improved cultivars of same) which are hardy and relatively free of serious insect and disease problems. 2. In some places, where rooting area was tight, ornamental trees were substituted for larger deciduous trees. 3. Aesthetics - plans are attractive and should complement the buildings and site. 4. "Planting Detail" - add the language "for evergreen or deciduous balled & burlapped (B &B) plant material, the top rungs of any wire basket around the root ball should be removed before back - filling the planting hole ". *5. Carriage House Cooperative plan - six large deciduous trees on the east side of the building appear to be specified to be planted in the road right -of -way. Any trees planted should be on private property. These trees may need to be replaced with smaller ornamental trees. 6. Tree Replacement Requirement - after removing boxelders and trees under 8 in. dbh from consideration, the total caliper inches of trees on the site is 1943 inches, and the total caliper inches of trees to be removed is 1491 inches. The calculated tree replacement requirement is 1521 caliper inches - 235 caliper inches to be planted as part of the landscape plans = 1286 caliper inches. Payment in lieu of tree planting = 1286 in. x $50. /cal. in. _ $64,300. 7. An inspection of trees to be retained along Oakgreen Ave. revealed two trees which should be removed due to storm damage and poor structure : #25132 and #25135. Remaining deciduous trees to be retained along Oakgreen Ave. should be pruned by a professional tree service company, especially #2506 which has branches extending into the roadway. All previous comments for construction of Oakgreen Commons & Carriage House Co-Op have been addressed. 2. The current construction plans submitted are for the development of the north end of the lot. This includes the looped roadway, parking areas and the drop off circle for Oakgreen Commons. In addition, the sanitary sewer, water main and part of the storm sewer will be constructed. The southern area of the development (Carriage House Co -Op) will be graded to provide positive drainage and restored. Plat 1. There is an existing 10' utility easement along the north side of 58 Street north near Oakgreen Avenue. FFE, Inc. will submit a separate document to include this utility easement as a trail easement. a. A proposed glacier boulder retaining wall and split rail fence (see attachment) will be constructed within the trail easement. A number of these trees have been damaged by heat from the fires used to destroy the houses on the west side of Oakgreen Ave.. My observations and comments regarding tree removal and pruning are as follows, going from S to N along Oakgreen Ave.: 1. #25067 - silver maple - has broken branches from prior storm damage - prune 2. no tag - boxelder - 8 in. diam. - misshapen, should be removed 3. no tag - ash - 5 in. diam. - growing next to bur oak - remove 4. no tag - bur oak - 6 in. diam. - heat damage but re- leafing and will probably survive 5. #25131 - ash - 18 in. diam.- has several broken, hanging branches - prune 6. #25132 - willow - 15 in. diam. - has decay at base and is a risk - remove 7. #25186 - Colo. spruce - 16 in. diam. - has many branches on the top portion of the tree which have been damaged as a result of heat injury and will not re- foliate - remove 8. no tag - Norway maple - 18 in. diam. - trunk decay and defects - heat injury and only re- leafing a little - remove 9. #25215 - red maple - 28 in. diam. - heat injury but is re- leafing - may lose some limbs 10. #25236 - willow - >60 in. diam. - trunk decay and a risk - tree must be removed 11. #25240 - catalpa - 16 in. diam. - some heat injury to top of the tree but is re- leafing - may lose some limbs Most of the trees with heat injury should recover, though the canopies will undoubtedly be thinner next year due to damage from the fires. The only tree which should be removed as a result of the heat injury is #25186 and removal of this tree should not change the previously calculated tree replacement requirement. The other trees which are recommended for removal are either too small or pose a risk so that they were not included in the original tree removal /replacement calculations. Note: now that other nearby trees and the houses have been removed, it is evident that a number of the spruce left on the Oakgreen Ave. frontage are in poor condition and will probably not be good landscape specimens once the project is built and landscaping completed. The developer should consider removal and replacement with 12 -14 foot evergreens in good condition. Please contact me if you have any questions regarding this inspection and report.
