Dear Mrs. Wilson:
Upon your phone call on 26 March, e, 4aterined the Proposed
which exists or will be added to ,'ter Fred's Tire operation in Oak
Park Heights. This information was, compared to the Zoning Ordinance
provisions goveniing signing. Our conclusion is that Fred's Tire is
allotted two wall signs, one on the L atest face of the building, the
second on the south face of the building. They are also allowed one
pylon sign. The signs which exist, or a,re, proposed :fall within the
area requirements permitted.
It should be noted that the Fred',s Tire operation has somewhat of a
unique advantage in the fact that they have a corner lot, erg pu
frontage being the 212/36 frontage ,road the ether being the :undeveloped,
but platted, Omaha right -of- way. In this regard, the ordinance .
references only platted streets and not necessarily developed streets.
While the intent was possibly that an extra wall sign (totalling two)
be permitted in the case of developed streets, the reference to public
right -of -way leaves the matter squat open.
Part of Mr. Leier's concern relative to the signing was that two of the
signs indicate product name. Under the aefinitlon of advertising signs
in the Zoning Ordinance, signs which advertise products for sale on the
premises ere not considered advertising communication devices. Adver-
tising signs are signs indicating product or other advertising located
on a site other than where a business or operation is located:
