This approval is contingent upon confor to locating the structure as noted in our report of 8 July 1981 and upon approval of the structure itself by Mr. Frank toter, the City Building Official I hay, attached copies of the Council minutes outlining this action. Present: O'Neal, Westphal, Seggelke, Eckherg, Lemberg, Licht and Wilson. Acting Mayor Lang called for a moment of si lenee in remembrance of former Mayor Dewey Mondor. Seggelke moved that the City of Oak Park ileiOts bold .a public hearing to reconsider the off sale transfer of the liquor license from Kristin Investments to Discount Liquors of Stillwater, Inc. on Thursday, September 10, 1981 at 7:00 P. M. with a court reporter to he present. Proper notification to he furnished applicant and notice published in local newspaper. Seconded by O'Neal. 4 ayes. Carried. Clerk read public hearing notice, presented affidavit of publication and mailing list for hearing on application for Conditional Use Permit, Rezoning and Subdivision from Swager Bros., Inc. Westphal moved to table the hearing until a later date in order to formulate better plans. Seconded by Seggelke. 4 aye votes. Carried. O'Neal moved to close the hearing, seconded by Seggelke. 4 aye votes. Carried. Clerk read public hearing notice, presented affidavit of publication for Proposed Use of General Revenue Sharing Funds. Notice posted at Senior Citizen's.High Rise. The following Revenue Sharing committments were made. 1) St. Croix Valley Youth Service Bureau - $2680.00. 2) Maintenance Equipment - S60,714.00. Final review of Revenue Sharing Funds with the 1982 City Budget is set for September 28, 1981 at 7:00 P.M. Sidewalks from the Senior Citizen's High Rise to the Mall area will he considered at the 1982 budget meeting. Seggelke moved to close the hearing with O'Neal seconding. 4 aye votes. Carried. O'Neal moved to approve the above committments with Seggelke seconding. 4 aye votes. Carried. Mr. Robert Schunicht and Mr. Mark R. Rolfs of the City Engineering office made an excellent presentation of the report on storm drainage improvements. Seggelke moved to accept the report with O'Neal seconding. 4 aye votes. Carried. Westphal moved to authorize Engineer and Attorney to proceed to gather information regarding costs on the above project and present report at first meeting in November. Also, to inform School District #834, Washington County, City of Stillwater and Fiscal Agent. Seconded by O'Neal. 4 aye votes. Carried. Seggelke moved to grant a sign permit to Goodyear Tire for the substitution of "Ethridge Tire Center" for the existing "Stillwater Tire Center" on the east side of the building contingent on the rest of the signage being brought into conformance with the current Ordinance and.its modi- fications which are anticipated in one or two months. III Minutes of meeting held Monday, August 24, l981 Page two - continued , O'Neal moved to amend the original Conditional Ilse Permit for Fred's Tire Company to include the placement of a pre -built garage on the northeast corner of the property subject to he Building Code requirements and enforced by the City Building Official and the Planner's recommendations in their 3 doted July 8, 1 Seconded by Westphal. 4 aye votes. Carried. Seggelke moved to authorize City Planner to initiate public hearing and prepare appropriate reports with regard to the amendment to the OPI1 Comprehensive Plan annexing the proposed Kimmel addition of approximately thirty five acres, west of Osgood and south of the 1)NR property. Public Hearing to be scheduled Monday, September 14, 1981 at 8:15 P.M. Seconded by O'Neal. 4 aye votes. Carried. Seggelke moved to waive the one million dollar general liability insurance from Horak Trucking and reduce it to five hundred thousand dollars and authorize Mayor and Clerk to sign agreement for diseased tree removal. Seconded by O'Neal. 4 aye votes. Carried. Seggelke moved to direct clerk to contact Washington County regarding clean up of brush in ravine south of 6142 Paris Avenue due to a- citizen complaint. Seconded by Westphal. 4 aye votes. Carried. O'Neal moved to accept the Auditing /Accounting Services for 1981/1982 of DeLa Hunt Voto & Co., LTD and direct Mayor and Clerk to sign the agreement. Seconded by Seggelke. 4 aye votes. Carried. Seggelke moved to direct Mayor and Clerk to sign the 1981 Shade Tree Program agreement. Seconded by Westphal. 4 aye votes. Carried. Seggelke moved to approve banking transactions. Details available at Clerk's office. Seconded by O'Neal. 4 aye votes. Carried. Seggelke moved to direct acting Mayor Lang to sign agreement with DeLallunt Voto & Co., LTD dealing with financial management and planning services and concurring with their letter dated August 18, 1981. Seconded by Westphal. 4 aye votes. Carried. O'Neal moved to table and delay the selection process for appointment of vacancy of Mayor until September 14th meeting. Seconded by Westphal. 4 aye votes.
