BACKGROUND
Jim Burton, representing Fred's Tire Company, has requested approval to move a 20
by 24 foot pre -built garage onto their site north of Highway 212 (see Location Map,
attached) for the purpose of storing old tires and junk casings. The request to allow
the auto repair operation as a conditional use on the site has recently been made.
A public hearing for the request was held at the 11 May 1981 City Council meeting
and the CUP was approved contingent upon several conditions, as follows:
1. Individual entrance and exists.
2. Removal of existing canopy.
3. Installation of perimeter curbing and grassy area.
4. Submission of details on colors and materials.
5. Provision for noise control .
6. Proper site drainage with approval of the City Engineer.
As these conditions have not yet been completely satisfied, no CUP has been granted.
ISSUES AND ANALYSIS
According to the City Attorney, the request to add an accessory building may be con-
sidered an amendment to the original conditional use permit request and can be subject
to the consideration of the City Council . The Council may determine whether or not
another public hearing is necessary.
No site plan was provided for the request, but the appl icant stated that the structure
would be placed in one of the back corners of the lot.

Exhibit B, attached, illustrates a logical placement of the structure in accordance with
the setback requirements of accessory buildings ( front - 30 feet, side - 10 feet, rear -
8 feet). In addition, placement in the northeast corner will preclude interference with
the possible future extension of Omaha Avenue along the west lot line. Placement of
the structure in this location allows sufficient maneuvering and circulating area and does
not affect parking provisions.
There are no City ordinances that apply specifically to moving structures from lot to lot
or into the City. However, the structure is subject to Building Code requirements enforced
by the City Building Official.
The City Council should determine whether the architectural character of the structure is
compatible and desirable with relation to the area. Since the structure is already existing,
the submission of photographs should be required.
RECOMMENDATION
It is felt that the request to move a garage onto the site may be considered an addition to
the original conditional use permit request for Fred's Tire Company and that the City
Council may decide to waive a second public hearing.
The site is deemed to have sufficient area to accommodate the accessory building as
located on Exhibit B, however, the architectural character of the structure should be
subject to the satisfaction of the City Council and the structure should be approved
by the City Building Official.
