MEMORANDUM T O: Oak Park Heights Mayor and City Council FROM: Anne Bronken DATE: April 23, 1981 RE: Fred's Tire Company CUP FILE NO: 798.02 - 81.07 BACKGROUND The applicant has submitted site and building plans for a lot that has in the past been the A &W site located on the north side of Highway 212 (see Site Location Map, attached). The proposed use is an auto repair and alignment operation and the retailing of auto parts. The plans include an addition to and remodelling of the existing structure. The site is zoned B -2, General Business District, in which an auto repair operation is a conditional use. The land adjacent to the site on the north, east and south is also zoned B -2. The site is bordered on the west by the Oak Park Heights City boundary. Surrounding land uses are as follows: North - Vacant East - Auto Fuel and Service Station South - Fast Food Operations Abutting Highway 212 West - Warehouse Food Market ISSUES AND ANALYSIS In accordance with the procedures for granting a conditional use permit as set out in the Zoning Ordinance, the Council will need to make a determination as to the general acceptability of the proposed use based on (but not limited to): • The relationship to the Comprehensive Plan. • The geographic area involved. • The character of the surrounding area. • The demonstrated need for such a use. 4820 minnetonka boulevard, suite 420 minneapolis, mn 55416 612/925 -9420 • • Oak Park Heights Mayor and City Council April 23, 1981 Page Two In the event that the proposal is considered a compatible and desirable use, some concerns regarding the site plan will need to be resolved. The on -site circulation appears to work well . There is sufficient space to allow ease of parking, backing and maneuvering. However, a requirement of the Zoning Ordinance states that only one driveway is allowed per 125 feet of lot frontage. The subject site has two existing driveways, but only 200 feet of lot frontage. In order to improve the site one of the driveways would need to be eliminated. The applicant could either rework the on -site circulation to utilize one driveway or develop a lease agreement to share a driveway with the adjacent fuel station to the east. The existing company that has been designated on the site plan "to remain" encroaches on the front yard setback (40 feet) and will need to be shortened or removed. The site plan would need to show the placement of curbing around the perimeter of all driving areas on the site and a planting strip at least 5 feet wide along the lot boundaries. The amount of existing bituminous surface on the site appears to be in excess of what the proposed use requires, particularly along the north side of the lot. If curbing is installed, it is recommended that the amount of hard surfaced area be reduced. The amount of off - street parking provided on the site is sufficient. Twelve spaces are required by ordinance standards and eighteen spaces have been provided. One of the conditions required of an auto repair operation is that the architectural appearance of the structure be a positive element in the area. Therefore, the applicant would need to supply information as to the materials and colors to be used for the facade of the building. Provisions to control and reduce noise are also required of an auto repair operation. Considering the location and surrounding area, special sound provisions do not appear necessary at this time. However, the City should reserve the prerogative to require a sound barrier device(s) at any time in the future if deemed necessary. The City Engineer should ascertain that no drainage problems exist or would develop as a result of the proposed development. • Oak Park Heights Mayor and City Council April 23, 1981 Page Three RECOMMENDATION It is recommended that the Council review the proposed use based on the considera- tions mentioned in the above report to determine its acceptability.
