Dear Scott:
This letter is to follow -up on our recent telephone conversation
and is intended to promote a thorough understanding of the tasks
remaining to be done to complete the PUD plan submittal.
It is my understanding that there are several tasks remaining to be
done following on the City Council's approval of the development
stage submittal. I understand that these tasks generally are
identified in your October 21, 1993 report. There may be
additional items from your September 23, 1993 report to the extent
that items are not included in the October 21st report. In some
instances recommendations from these two reports are conflicting.
I will assume, based on our discussions that in such cases, the
later report is correct.
The developer's attorney, Mr. Barry McKee, is working on the
developer's agreement with the City Attorney. I understand that
document will incorporate your recommendation that the City reserve
the right of the development agreement to retain access agreements
for the private roadway and the right to dedicate all or a portion
thereof as a public right -of -way as the need necessitates.
A revised snow removal plan must be submitted. A copy of a draft
of that is enclosed. A similar snow removal plan shall be outlined
in the Homeowner's Association Declaration of Covenants.
It is my understanding that the declaration of covenants
restrictions and easements is being prepared by Mr. Barry McKee to
be submitted to the City Attorney.
The cash park dedication fee of $10,400.00 is payable at the time
of the finalization of the development agreement.

The grading and drainage plan and the utility plan for the project
has been submitted for review and has been approved by the City
Engineer.
Our plans and specifications for grading of this site include
requirements for engineered control fills to insure that proper
soil compaction is provided.
The site plan has been revised with the redesigned driveway
configuration for Lots 21 and 22. A copy of that is included
herewith for your review and approval. I am sending a separate
copy of that plan to the City Engineer.
The Owner has retained a landscape designer to prepare the
landscape plan that is required to meet the requirements of your
condition numbers 9, 10 and 11.
The final plat is being prepared by the developer's surveyor, Mr.
Barry Stack. He informs me that it will be ready for submittal at
around the end of this month, or very early January.
Condition number 14 in your October 21st report was that the City
Council shall determine if two story buildings shall be allowed
throughout the development or limited to lots that will comply with
the height requirement of the PUD. I have asked for a copy of the
minutes of that Council meeting so that I can determine if that was
decided with the Council approval of the development plan. Please
review this matter and let us know where this issue now stands.
If signage is to be provided on the site, a detailed site plan will
be submitted by the developer.
We have applied for an access permit from Mn /DOT for the proposed
connection to 60th Street North. They have a concern about
drainage which we are in the process of addressing through a minor
plan revision. We will add approximately 100 lineal feet of
bituminous curb along the south edge of the existing frontage road,
west of our proposed access driveway. We understand that this will
allow Mn /DOT to approve the access permit.
We have received a letter of approval from the Middle St. Croix
Watershed Management Organization. A copy of that letter was
furnished to Barb O'Neal, Mayor of the City of Oak Park Heights.
Nonetheless, to be sure that our approval from the Watershed
District Staff is valid, we have asked to be on the agenda of the
Watershed Management Organization Board on December 16th.
Upon review of the September 23rd report, I find no conditions in
that report that were not covered in the October 21st report except
those which were addressed by revisions to plans submitted after
September 23rd.

We are requesting that you confirm that the statements above are
materially correct as to the status of this project.

DEVELOPMENT PHASE
SNOW REMOVAL PLAN
This snow removal plan is to be in effect while the developer is
responsible for street maintenance.
Immediately after any snow fall, the streets will be plowed from
curb to curb.
Snow should be windrowed on the boulevard areas behind the curb.
Snow from resident's driveways shall be stored along the driveways,
and shall not be placed on street pavement.
When windrows reach a height of six feet, additional snow shall be
stored as follows:
1. If there are any unbuilt -on lots, snow shall be stored
first on those lots off the right -of -way.
2. In storm water detention basins.
3. If there are no unbuilt -on lots and if it is impossible
or impractical to store snow in storm water detention basins,
snow shall be removed from the site and deposited on other
lands on the basis of a contractual agreement with the owners
of those properties.
Not withstanding the above, it shall not be necessary to plow snow
if less than one inch of snow has accumulated by 7:00 a.m. and
above freezing temperatures are forecast for the remainder of the
day.
