Per your request our office has investigated the issues involved with the request by the
East Oaks Home Owners Association for the City to accept Oxboro Avenue North as a
public street. This street was constructed as part of the East Oaks Planned Unit
Development, which was approved by the City of Oak Park Heights in 1994. The Home
Owners Association for East Oaks is currently responsible for the maintenance of this
street, however, they no longer wish to maintain the street, therefore, are offering to
dedicate the right -of -way to the City. The following provides a summary of issues for the
City to consider in determining whether or not to accept the street as public right -of -way.
• Right - -of -way width. Section 402.01 Subd. C.15 of the Subdivision Ordinance, the
subject street is classified as a local street, therefore, the right -of -way must be at
least 60 -feet wide. The subject right -of -way is 60 -feet wide.
► Paved surface. The City's street constructions standards require that the paved
width of local streets is to be 32 feet. The paved surface width of the subject street
is 32 feet.
► Cul - sac radius. Per Section 402.01 Subd.C.2 of the Subdivision Ordinance,
the right of way for a cul -de -sac radius shall not be less than 60 feet. The subject
cul -de -sac radius is 47.5 feet, therefore, does not meet the Ordinance requirement.
The paved surface radius of the cul -de -sac is 45 feet; this was the minimum radius
allowed by the City Engineer as part of the PUD approval. As demonstrated on the
Final Plat, there is virtually no right -of -way area at the end of the cul -de -sac to
provide for snow storage.

► Cul -de -sac length. Per Section 402.01 Subd.C.2 of the Subdivision Ordinance,
a cul -de -sac shall not exceed 500 feet in length. The subject cul -de -sac is 800 feet
long, therefore, exceeds the City requirement. This arrangement is seen as
acceptable given the steep slopes to the south that would prevent a roadway
connection and the NSP site to the east, which will likely not be developed given
the existing use of the site.
► Cul-de -sac turn around. The Final Plat indicates a turn around cul -de -sac at the
entrance to the development, however, question is raised as to whether it has ever
been constructed. Originally East Oaks was to have a gate at its entrance,
therefore, in the instance that the gate was closed, there was an area for vehicles
to turn around.
► Setbacks. The subject development is zoned PUD, therefore, was only required
to maintain a 30 -foot perimeter setback. The underlying zoning district is R -B,
Residential /Business Transitional and requires a front yard setback of 30 feet, side
yard setback of 10 feet, and a rear yard setback of 30 feet. Six (6) of the 26 units
have twenty (20) foot front yard setbacks, and two of the units have 28 foot front
yard setbacks. The remaining units meet the 30 foot front yard requirement. All of
the units meet the side and rear yard setback requirements.
► Lot Size. Per Section 401.15.C.3, the minimum lot size for a two - family dwelling
is 6,000 square feet. As shown on the Final Plat, 18 of the 26 lots do not meet the
minimum 6,000 square foot lot size requirement. The reduced lot sizes where
allowed as part of the PUD.
► Common Open Space. As shown on the Final Plat, Outlot C has been platted as
"Common Open Space ", with a 10 -foot trail accessing the area from the road. Due
to poor access and lack of available parking for automobiles, the City, under no
circumstances should accept this lot as a City Park.
