Based on that previous understandin it is the Cit position that the land ac fulfills their obli for cost sharin for the Trunk Hi 5 improvements and can not a to the third "Whereas" contained in the Supplemental A No. 5. This request was requested by the City of Oak Park Heights in a letter dated April 30, 1997 and signed by the City Administrator, Mike Robertson. In this letter and a subsequent letter dated May 13, 1997 the City agreed to pay fifty percent of all costs necessary to make the plan changes. The City Administrator also agreed to acquisition of all additional R/'W needed to facilitate the change at no cost to Mn/DOT. Please sign the enclosed agreement and return to ran office so that I Y may complete the final payment process for this Contract. All work shall be performed in accordance with appropriate Contract Provisions and Specifications P and as stated and directed by the Engineer. 4. It is my understanding from Construction Manager Paul Juckle that the costs for the left turn lanes have already been reduced from the original estimates. The City is willing to sit down with you and discuss a cooperative agreement covering this and the other items- associated with the improvements to Trunk Highway 5. As stated in my previous Letter of April 30, 1997, the city will pay 100- of the costs associated with the Southeast Frontage Road changes and the turn lanes on 58th street assuming that a Supplemental Agreement is negotiated. Because of unit prices which are in place with the existing contract, reasonable negotiations should be achievable The City also understands that it will be responsible for the design, construction, and costs for providing the additional lanes on 58th street as well as the signal system at 58th street and the southeast Frontage Road and that work cannot proceed until 58th street is no longer required as a MNDOT detour route Thank you for your assistance in this matter. However, that work cannot proceed until 58th street is no longer required as a MNDoT detour route. The City is also requesting that MNDOT make the necessary modification to the plans for TH - 5 improvements to provide for dual Left turn lanes on southbound TH-5 to eastbound 58th street This modi f icat ion would include changes required for the signal system at this intersection. Realizing that MI DOT can not move quickly in securing additional right-of-way, the City will acquire the 12 feet of right-of-way necessary to accommodate the additional lane on TH -5 . This acquisition will be financed by the City with the understanding that all other costs for the improvements on TH -5 will be financed with state and Federal. funds. Tree City U.S.A.
