RE: King Plant Ash Landfill — Relocation of Equipment Storage Garage:
Request for Continuation of Conditional Use Permit Decision
NSP requests that the Hearing for its Conditional Use Permit for the King
Landfill Garage be continued to the Planning Commission's March meeting. The
reason for this continuation request is to provide time to assess permit conditions
recommended in Scott Richards' Planner's Report. This Report was submitted to
Tom Meiena on February 3 and was forwarded to NSP on February 7
Recommended permit conditions that NSP believes need clarification include
the following:
• "NSP shall contribute a proportionate share of the costs related to storm water
runoff improvements required for the Perro Creek Pond."
While NSP recognizes there are storm water management problems associated
with the Perro Creek Watershed, NSP has not been directly involved in
developing improvements nor assessing the Landfill's role.
• "Landscaping shall be placed on the northerly berm area subject to the City
Arborist review and approval."
Landscaping requirements are influenced by MPCA Permit conditions, site
security needs, possible future use of closed areas, and other factors. It may be
that landscaping should have both short and long term plans.
• "The access road from Beach Road shall be paved ...." and "The City will require
the non-conforming billboard to be removed ...."
NSP expected both conditions would have been addressed via the South
Frontage Road plan that was part of the original St. Croix Bridge design. While it

may 170 longer be appropriate to link resolution of the proposed conditions to the
eventual Bridge event, NSP wants to assure that any modifications to entrance
areas on both ends of the site are consistent with the City's and MnDOT's plans.
Trails shall be constructed within the fly ash site and along NSP power line
corridors .... subject to approval of City staff and included in the development
agreement with NSP."
NSP has indicated willingness to cooperate with the City's trail plans, but we are
not sure of the specifics of those plans. 1 expect we share the same absolute
requirement that any trails must be reasonably safe. Additionally, the landfill site
and the power line corridors are managed by separate areas within NSP, thus
there may be the need for separate development agreements.
I appreciate the City's patience as we work through this permit process and
look forward to meeting with City staff to resolve the issues. !further appreciate your
advice as to how to make the process as efficient as possible.
