Thank y ou for sharin y our time with Mark Fritsch and me on Jul 31, to allow us an opportunit to better understand some of y our personal and business concerns with re to the current construction pro at the A. S. Kin Landfill. This was also an opportunit for Mark to share with y ou the fact that we had investi other situations involvin Xcel Ener construction pro that ,could have had an impact on nei g hbors, and to be certain y ou were bein treated e fair in our responses. One item in y our letter that concerns me is the reference that we are knowin operatin outside the parameters of the Conditional Use Permit ( CUP) issued for this site and that we are aware our doin so is a ne effect on both y our famil personal and business well bein As mentioned at our meetin the onl area that would q ualif y as a CUP issue was the completion of the "Stop Si will be installed" at the landfill exit onto Beach Ave. The stop si was permanentl installed toda Au 12, 2002, as well as a 5mph speed limit si to control traffic flow inside the landfill area. Xcel Ener is in compliance with the CUP. The heav e loadin and unloadin that has occurred outside of normal workin hours was for the most part to keep the contractor compliant with MnDot's "Wide" or lar than normal load road restrictions durin hi traffic periods of the da Since our meetin 1 have had the landfill locks chan that allows traffic into or out of the site to occur onl when our construction superintendent is on site. He has instructions to contact me personall if there is a need to conduct an e activit outside of restricted hours. If I can not be contacted, the work activit will not occur. I hope we have been able to address y our concerns and that y ou can remain assured we will continue to conduct our work activit in compliance with all permittin re as well as state, count and local ordinances.
