HomeMy WebLinkAbout1993-11-20 Sullivan Ltr to OPH Re Pooley To: Oak Park Heights Council Members From: Mike Sullivan, Resident Re: Pooley Property Drainage Date: November 20, 1993 We own one of the properties affected by Mr. Pooley's retaining wall. The letter we received on November 16, 1993 raised many questions and concerns. 1) Who made the proposed decision? 2) Who will make the final decision? 3) Who was invited to the decision making meetings (professionals, staff members, etc...)? 4) Why weren't all property owners affected notified? 5) What was the professional and staff recommendations? (Documentation please) 6) Did Mr. Pooley obtain permission from the city to build in the easement? 7) If this decision stands as it is, is the city willing to absorb any damages which may occur in the future due to the decision? �8) Will Oak Park Heights be setting a precedent by allowing the disputed issue to stand? Comments: 1) While we were building our home the building inspector asked our excavator to come back three times to insure proper drainage of my lot and the 12 lots above to a catch basin Mr. Pooley has restricted. 2) It is my understanding that this easement is to be distributed equally. All possible water damage, soil erosion, and debris settlement from the 12 lots have been diverted into my lot soley. 3) As new property owners in Oak Park Heights, I feel I'm entitled to meet with all parties involved in the same setting as Mr.Pooley was given, a workshop meeting. Due to family involvement, I am unable to attend tonights meeting but ask that you contact me to set up arrangements. I am willing to work on a fair and equitable solution for everyone. Michael J.
