Re: Your Building Permit Application for Chain Link Fence -
Obstruction Within City Drainage Easement
Dear Mr. Pooley:
This office has conferred with the City's building office to
whom you have made an application to locate a fence upon a property
line.
Upon inspection of your property, it is clear that you have
erected within the City drainage easement a retaining wall or other
structure which has had the effect of diverting drainage upon to
neighboring properties.
We are herewith advising you that you are directed to
immediately remove the retaining wall and to restore the area of
your back yard to its original grade prior to the construction of
that retaining wall. No building permits for any purposes will be
issued for your property until such time as the retaining wall is
removed and the grade to the area restored. Should the City be
required to enter onto the right -of -way to remove the retaining
wall to restore existing drainage patterns to that which they were
prior to its construction, that cost will be assessed to your
property.
Please make immediate arrangements with the building inspector
of the City to establish a time table for the removal of your
retaining wall and, thereafter, the City will consider your
application for a building permit to establis _fence. In the
meantime, you are not permitted to const or p ce any fencing
upon your property or do any other ork whic would require a
building permit under the City ord' ances.
