Johnson Subject: Burger Deck Conversion Hi Mark - Jim is at the State offices until approximately 11:00 a.m. today, so I hope you don't mind my thoughts on your note, since it was copied to me. First I am sorry that you are receiving complaints from residents about the expenses associated with home improvements. In my opinion the Burgers would be taking the right first step in having a consultation with Jim. Generally it is done by their contacting Jim or myself to schedule an appointment with him to go over their plans and ideas. Project planning appointments have been had at the office and at the residents homes. Ideally it is nice to have this appointment scheduled so that Jim and the homeowner can have exclusive time with one another and be on the same page of understanding. At minimum, Jim will need to know where they plan to place the it (eg. same size as existing deck or alteration of size and shape) and he needs to know the size being proposed. These two things will help him determine whether or not the proposed project will meet local ordinance requirements for setbacks and size. At this time it is also imperative for Jim to have definite information /verification of the Burger's property lines in order to measure the setback requirements established by our local ordinance. With a pre - project meeting for something like this and information about property lines, setbacks, building size, height being confirmed, Jim should be able to determine if the proposed construction will meet local ordinance requirments and advise the homeowners whether or not a variance would be required. After this and assuming the homeowner wants to move forward with the project, they can begin the process of requesting a variance, if one is needed. Or if one is not needed, they can begin the building permit process by completing their building permit application and providing all of the information needed for the construction as necessary in order for it to be reviewed, processed and issued for them. I hope that I have been accurate in interpreting the messages shared in that the Burger's simply want some guidance as to whether or not they can convert their deck into a four season porch and as their first step are attempting to learn if they would need a variance in order to do so. Please advise me of any misinterpretation. If you happen to have the Burger's telephone number, I would be hapy to call them to coordinate a preproject meeting between them and Jim to discuss the project as it relates to the variance concern. It is important that they understand that verification of their property lines is a must in order for Jim to assist to this end. Also that any conversion of the deck will require whatever is necessary to comply with the building code and local ordinance requirements for construction of a 4- season porch (eg. change in footing size, building material, etc..). Jim will discuss these kinds of things with them also and will need to ensure that specs are noted upon their construction plans with submission of their bulding permit. I feel that the residents are due a pre permit view in order to see if the permit is even possible. Our residents have voiced this concern prior to this issue to me. It is not to much of our residents to ask nor should it be that our permitting official can look over the project to give any insight or help.
