Re: Wolszon v. City of Oak Park Heights, et al.
Dear Mr. Vierling:
Please recall that on August 21, 1991, I sent to you
correspondence accepting the general terms of the proposed
settlement offer put forth by you on behalf of your clients
and your correspondence dated August 14, 1991. Please also
recall that in my letter of August 21, 1991, I requested
that the City Engineer provide a more detailed set of plans
and specifications for the proposed remedial improvement,
with special attention to the decision to increase the size
of the storm system from the existing 18 -inch system to a
system sized at only 24 inches. As of this date, I have
received no responsive communication or correspondence on
these particular technical issues from either yourself or
Mr. Anderlik. I have communicated verbally with both
yourself and Mr. Anderlik on more than one occasion with
respect to a timely response to this request. Our concern,
of course, is that the remedial improvements be completed
before the end of the building season for 1991 so that my
client is not faced with the prospect of the very real
potential for flooding as a result of the run -off from the
spring thaws and melt -down as well as the very likely
prospect that the improvements could not be undertaken
until after the spring load restrictions are lifted from
the roadways. Our concern is that if such a delay is
encountered, Mr. Wolszon would realistically be facing the
issue of site restoration and restricted use of his rear
yard well into the summer of 1992.
I understand and appreciate that a great deal of time,
effort, and activity is being commanded by the on -going
preparations, issues, and negotiations surrounding the new
High School project. In an aside to a conversation with
Mr. Anderlik last week, he indicated that he was uncomfortable
in addressing his attention to this issue in the face of the
demands made upon him for responses to issues related to the
High School project absent a directive from the City Council

to do so. I would hereby request that the Council direct
Mr. Anderlik to attend to this matter in such a fashion as
to allow these improvements to be undertaken and completed
yet this fall so that we can remain pro- active on this
matter and avoid some of those potential issues or setbacks
alluded to above.
It is not my intent to imply that this matter or issue
has intentionally been delayed by the City or any representative
or employee thereof. It is important, however, that I address
my client's frustration with the apparent delay in achieving
final resolution of this matter. They were pleased and
happy that we had apparently achieved a proposed resolution
of the matter that appeared equitable and satisfactory to
both sides, but they are experiencing growing frustration with
our apparent inability to achieve "closure" on this matter
and the completion of the agreed upon remedial improvement.
Since Mr. Anderlik indicated to me that he wished a
specific directive from the City Council, I am advising
them of the contents of this letter by copy of the same.
