Please be advised that Planning commissioner Ann Wasescha contacted nee
today to let me know that her family has a direct interest in the billboard
property at the NSP fly ash disposal site. commissioner Wasescha was
concerned that there would be a conflict of interest for her in considerin g the
NSP application.
have spoken with the City Attorney who has advised me that since Planning
Commissioners are not elected officials, individual members are not subject to
the State of Minnesota Conflict Rule. The Conflict Rule applies to decision
makers only (City Council) ,not recommending bodies (Parks and Planning
Commissions).
However the Attorney considers this to be a circumstance where personal
ethics need to be applied and from the standpoint of comfort and fair dealing
recommends that commissioner Wasescha abstain in the deliberations and in
the recommendation on the conditional use Permit.
