Dear Mr. Knutson,
On Tuesda March 14, 2000, the Cit Council approved the Variance Re for the
NSP coolin cell tower at - plant. You are hereb informed that prior to the issuin
of Buildin Permits for the construction of the electrical e buildin and the
coolin towers, you must compl with all of the conditions of the Variance as approved
b the Cit Council il at their meetin of March 14, 2000. For y our convenience, I have
enclosed a cop of the Cit Planner's memo, dated March I O' 2000 citin these .
conditions. I wish to remind y ou that the Buildin Permit issued for this project is onl
for the construction of the footin / foundation pads for these structures, with the
condition that y ou were proceedin at y our own risk.
Item #3 in the Cit Planners Report states that y ou are to submit to the Cit written
approvals from the Corps of En Minnesota Pollution Control A
c and the
Department of Natural Resources fo the proposed NSP Structures. To date the Cit has
not received written statements from these departme approvin y our pro but we
have received a phone call from Moll Shodeen in re to the pro It is m

RE: Oak Park Heights — NSP —A.S. King Plat: coaling Tower
Expansion Variance
ILE NO: 8-02 - 00-05
The Planning Commission, at their March 9, 2000 meeting, voted to recommend
approval of the variance and site plan for the addition of cooling towers and an
electrical equipment facility at the A.S. King Plant. A variance is being requested
in that the cooling towers are proposed to be 61 feet in height. The building
height maximum for the 1, Industrial District is 46 feet. Site plan and Design
Guideline review is also required for any major project requiring a building permit.
Representatives of NSP were present at the meeting. No adjacent property
owners were present for the public hearing.
The Planning Commission recommended the variance and site plan with minor
changes to the conditions of the March 1, 2000 planning report as follows:
A variance is granted to allow construction of the towers to not more
than 62 feet in height.
2. Additional trees and landscaping or appropriate screening as agreed
to by the city staff is provided between the cooling towers and the
man -made channel. specifications and locations of trees and T
landscaping shall be subject to review and approval of the city
Arborist.
3. Written approvals are received from the corps of Engineers,
Minnesota Pollution control Agency, and the Department of Natural
Resources for the proposed NSP structures.
4. The city will not require conformance with the Design Guidelines for
the cooling towers and electrical equipment building.

5. The cooling towers and electrical equipment building shall comply with
all Uniform Building Code requirements subject to Building Official
approval.
6. Any other conditions of city staff, the Planning commission, and city
Council.
