RE: Coolin Tower Construction Issues, Cit of Oak Park Hei Washin Count
Dm Mr. Knutson:
The DNR is in receipt of a Joint Notification Form (JNF) for the construction of new coolin tower
cells at the NSP Plant in Oak Park Hei No DNR Protected Waters Permit is re for this
tower construction or the access road. A dewaterin permit has alread been obtained from us.
There are however, some local zonin issues that have not been covered. The Cit of Oak Park
Hei has a Lower St. Croix ordinance that re a 3 5' hei Emit, a 100 foot structure setback
from the ordinar hi water elevation (OHwj (675.0') and a 40'blufffine (12% slope) setback. To
m knowled the Cit did not consider their St. Croix ordinance when makin decisions. It is likel
that hardship can be shown and the variances can be certified, but it is our opinion that NP must g o
throu the appropriate local processes. For our part, the DNR will move q uickl y to complete
certification process once we receive the hearin decisions from the Cit

construction must be consistent with the Cit Floodplain Ordinance, as well as the State Buildin
Code Floodproofin Standards.
